I initially opened an account w/Spiegel/FCNB back in 1992 under my maiden name of Sonia Gonzalez. After several purchases I decided to close out my accout. I paid off my entire balance and closed the account...or so I thought.

In 1996, Spiegel turned me over to a collection agency & charged off an account they claim I opened in 1995. I disputed that. However,somehow in a country where I apparently was the only Sonia Gonzalez and the reality of identity theft or fraud was light years away or not even a consideration, it appears these fools continue to hold me responsible for something completely out of my control.

To make matters more complicated they destroyed my credit history and now that I am in the process of attempting to qualify for a home mortgage loan while my husband sacrifices his life in Iraq as an American soldier, I will not be able to get the loan due to this travesty.

I demand & require their immediate removal of this debt, I have attempted hundreds of phone calls & e-mails. I have had no helpful response except: "take it up with the Midland Credit Management Corporation who is now in control of the account". They outright have refused to deal with me and the account. They rebuttal and demean me. The insult my intelligence and have on numerous occassions told me they will get their money no matter what.

This poor attitude and lack of business ethic is sickening.
This is due to come off my credit reports in May of this year but at this point it is a matter of not only necessity but honor and principle to get this company's poor practices exposed immediately for the fraudulent and thievery they committ upon its customers.

My home closing is supposed to be April 30, 2003, it is my hope that this step can help me to resolve my issue with them and have the opportunity of pursuing the American dream with my American soldier.

Hey Murray, notice that my suggestion was sprinkled with "I assume"'s & "seems like"'s. What is TRUE is that if you dispute a claim & the company who posted it can not PROVE to the credit agency that such a claim exists than your credit report must be restored. Trust me, I have been there. Sometimes, when companies merge or file ch 11 or undergo any type of financial reorg, they lose paperwork that has either already been reported to a collection agency or is considered an overdue debt. Hence the prose "it is worth a try". In the future, it might be worth a try for you to TRY READING the post.

First of all to max, i dont know where you get your information but fcnb is not going under. Spiegal group filed for chapter 11 bankruptcy to help rebuild them. They didnt have to funds to give people credit so fcnb had to close all of our accounts.

But regards if the account is closed or fcnb is "gone under" which isnt true a bad debt is still vaild and account agreement is still vaild. and we can report to the credit report all we want.

I believe that following is the case now:

1. Retail stores like Speigel & Eddie Bauer are no longer affiliated with FCNB.

2. FCNB is no longer accepting applications & I am assuming are either going under or are no longer acting as a credit medium. They have also stopped current people from using their FCNB cards.

Either way, the contract with you as far as credit is null & void. I do not believe that a company can keep bad credit on your credit report if they are no longer an entity. Moreover, if the company can not prove that you (or the fraudulent you) has an account with them, they definitely can not keep a bad credit report listed on you. A lot of times, when companies disassociate themselves with other companies (as with Speigel), your files are lost or detroyed. If you write to the credit agency that has you listed, tell them this. They will research the validity of the claim. It is certainly worth a try.
