State Farn State Farm Insurance - Refusing To Pay For Damages Caused By Their Client - Ooltewah, Tennessee

*Consumer Comment: The insurance commissioner office Is In cahoots with the insurance companies all they do Is cause you more grief and don't hold insurance companies accountable for how they wrongfully deny claims

*Consumer Comment: Statefarm treat's me the same way and my car home Is insured under them they even denied me because the other insurance company didn't pay all my medical bill's then they lied saying they I never told

After speaking with a claim rep by the name of Chris with the TN Claim Central Call Center, he states that his review of the case shows that there is not enough evidence for State Farm to accept liability for a collision where their client pulled out in front of my client and caused a collision at an intersection, therefore State Farm (Chris) states that they are refusing to pay for damages caused to my vehicle, since they can't determine who's fault it was and stated that I would be responsible for my own damages and getting the vehicle repaired on my own.  Furthermore, in the police / accident report it clearly states that Vehicle #1 pulled out in front of Vehicle #2 at the intersection per the narrative that the police officer wrote.  The client, Linda Jones who was at fault at the accident had stated to both the driver of my vehicle (Tara Westbrook - Fiancee`) as well as to Firefights/EMTs & the Police Officer that she was at fault and that she would pay for the damages because she 'didn't see' my vehicle.  Both vehicles were stopped at the red light, which my vehicle had the right of way, being the first vehicle stopped at the intersection.  After attempting to proceed through the intersection, Linda Jones decided she wanted to proceed at the same time, causing the collision.  My vehicle is in an unsafe condition to drive and because State Farm is refusing to accept liability and refusing to repair my vehicle, I am forced to drive an unsafe vehicle where I can't open the drivers door of the vehicle because of the damage.  The headlights of my vehicle are out of adjustment and shine directly on the road in front of the vehicle, making it difficult for night time driving which is required several days a week.  I do not have another vehicle to drive and this is my only transportation and it's currently unsafe.  I need this to be dealt with IMMEDIATELY!

The insurance commissioner lies on their website saying they are their for us!,  which Is a complete lie.  They have the authority to make insurance companies do the right thing.

We have insurance to "PROTECT" us but when we need help they turn a blind eye!

My local agent didn't file the claim & they lied,  to the main office saying they didn't know about the accident.

The department of insurance in alabama sided with them,  another win for statefarm.

File a claim with your insurance company to handle your damage under your collision coverage.  They will pay for the repairs related to the accident (less your collision deductible).

Assist your insurance company with their investigation into the claim, making sure to provide them with all of the evidence at your disposal showing the other driver was at fault.  The claim representative from your insurance company will provide you with their liability analysis, and let you know if the evidence supports your contention that the other driver was at fault.

If your insurance company agrees that the State Farm driver was at fault for the accident, your insurance company will file arbitration against State Farm seeking reimbursement of any payments they have made, plus your deductible.   State Farm is a member of Arbitration Forums, and the arbitration decision is binding.

This is a major reason YOU have insurance, to protect you!

Par for the course. Take them to court

This is what State Farm, and the others in their industry, do. Deny deny deny. Take them to court. Don't bother with a lawyer. Just pay the court fees. You have all you need to show their liability. They count on 99 percent of victims not to go that far. Granted with court, my case was just small claims, but even in regular civil court, if you just show them that you will appear and take the case to the limit, they will cave in. Contact the government agency in your state overseeing insurance companies too, and complain. After I did that in a similar situation with them, their a#%hole adjuster "adjusted" both his attitude and numbers very fast.
