On or about October 24, 2011, I inadvertently went thru a Sunpass lane in Orlando. On my return trip, I asked the toll cashier what to do and he advised that they would send me a notice to pay.  When I received the notice, I checked their website for a pay station in my area.  I paid the toll violation on February 24, 2012.  No other notices were received after that date.

On May 7, 2012 I received a letter from the State of Florida, DMV, that my license was being suspended  effective May 23, 2012 for "unpaid ticket/summons", unless I pay a $285 fine, $60 re-instatement fee, etc.  Since I didn't have any tickets, I contacted the Clerk of Court for the City of Orlando, as stated on the letter, and they advised that it was for non-payment of a sunpass violation.  I advised the clerk that I had paid that ticket ($27.25 for a .75 toll) and she said I needed to straighten it out with Sunpass. .....  There was nothing she could do.

I immediately contacted Sunpass, and was advised they had never received payment.  I still had my receipt, so I faxed my receipt, along with the Unpaid Toll Violation Notice to Sunpass that day, May 7, 2012.  Since the receipt was a thermal receipt and some portions of the receipt had faded, I wrote those faded portions.   They advised me that a receipt with handwriting was not acceptable. 

I went to the pay station where I paid the fine, had the manager contact Sunpass to advise that the fine had, in fact, been paid.  They said they needed a clear original receipt. I got a printed receipt,  faxed it to Sunpass.  I called immediately to confirm that they received my fax. They said they did and this should resolve the matter, and they would call me back after their review.  I never heard back.  I again contacted them. I have even been dealing directly with a Supervisor (supposedly) at Sunpass by the name of Frances Lopez and all he keeps telling me is that the matter is being reviewed. They will not give me a phone, fax number or email address for the review department.

It's now May 21, 2012,  and no word from Sunpass.  I called and strongly demanded that they correct this error immediately and reiterated that my license was being suspended on May 23.  I also contacted the clerk of court in Orlando to advise of the situation, and she advised me that until Sunpass sends them a dismissal of the Notice of Suspension, which will take approximately two days to a week to get it into their system, my license is being suspended.  So my license is being suspended for no reason whatsoever and Sunpass has done nothing to clear up this matter. What else can I do. I have contacted them on a daily basis since I received the Suspension notice.

Sunpass Scam

Today my room mate got a sunpass "unpaid toll violation" in the mail with a picture of a white van and a tag number we've never heard of. The mailing address is one in Blountstown FL, but the receivig address for the $3.00 check is in Atlanta GA. This looked suspicious as we traded in a white van some 6-7 years ago and see no reason to send money to some obscure agency in GA when we live and pay taxes in fl. I wonder how may of these "fake darts" are thrown and people just pay them out of fright?

Is there any open investigation into this type of scam?

  My bad.   I was under the impression that Sunpass was a private toll collecting entity.    As a government entity all bets are off.    Even in AZ, more and more agencies are using drivers license suspension to get people to do what they want.   Due process seems to have flown out the window.

I have never seen any kind of license revoked where there was not also an appeals or hearing procedure.  In the notice you were sent there should be some information about filing an appeal and/or requesting a hearing.  Telephoning the a clerk of courts is not an appeal.  At this point, you are losing your driving privileges over a unilateral and unproven claim by Sunpass.  Demand your day in court.

One thing I noted though is that there was a four month gap between the time of the violation and the date you paid.  You do not mention when you received the notice.  Did the fine increase because it was not paid within a certain time frame?  Little fines have a way of growing into large fines if they are not paid on time.

"Sunpass" is the name of the toll transponder they use around here so that drivers don't need to stop and physically pay a toll on a toll road.  The Sunpass system is run by the Expressway Authority which is a government agency.  There are no private entities involved in this complaint.  I am, however, very impressed with how the OP has handled this and kept receipts etc.  One thing however is that emails and phone calls are VERY EASY to ignore.  I would advise the OP to take all their paperwork and show up IN PERSON at the administrative offices where, in person, he/she cannot be ignored.  When I say "administrative offices", I mean the office building...not the little building next to the toll booths.

Suggestion...

You might go into a DMV and speak with the manager. Some states have a provision that with a suspended license you can get a "work only" license. It enables you to drive directly to and from work. It's not as good as your regular license but it might be a way to legally drive for work while you straighten this out through the courts. Hope this is solved quickly for you.

Get a lawyer. File a civil lawsuit for your damages.

The ONLY way you will get this problem resolved in your favor is to IMMEDIATELY file a lawsuit the day your license is suspended, as that is when you have actually sustained damages due to their direct negligence/incompetence.

File that lawsuit right away.

  Contact as many of your local legislators as possible.   Ask them how a screw up by a private company can invalidate your state issued drivers license?  Be sure to point out who appears to have the power to control whether or not a license is suspended or reinstated.
