For five years I worked on my job as a cook. I was a very good, faithful, dependable employee.
I have always passed the background check every year. Suddenly, this year, my employer, Sunrise Senior Living, was taken over by a new owner, Five Star.
An employee of Agency for Health Care Administration, Background Screening Service (AHCA BGS), the finger printing company, told the new employer a defamatory statement that I had been wanted by the police for 20 years. Felipe Gonzales, manager of Human Resources, made the same defamatory statement that I had been wanted by the police for 20 years. Rinal, an employee of Sunrise at Home made the defamatory statement to me that I had been wanted by the police
for 20 years.
Felipe Gonzales, manager of Human Resources, immediately terminated me on September 13, 2012, based on the false, defamatory statement of the AHCA BGS.
The next day I went to the courthouse and obtained proof that I am not wanted by the police whatsoever. I immediately submitted the proof to my employer and requested that I be given back my job. Felipe employer refused to accept the proof that the finger printing companys statement about me was and is false. The employer refused to give me back my job. Felipe employer fired me because I am black and because I am Haitian-American.
What is worse is that my employer terminated all of the blacks and none of the whites. Other black employees who were in the same position as I, discriminated against, and who were wrongfully terminated from the job include Cheryl Showers, lead server; Maggie; and Gitz, who was fired just because he fell on the floor. Sunrise Senior Living did not want to take care of him (compensate him) so they got rid of him without just cause.
I am now under tremendous stress due to the loss of my job. As a result, I am suffering chest pains/heart pains. I am seeing my doctor about it.
Relief I am seeking: I want my job back, I want compensatory and punitive damages from Sunrise Senior living, AHCA BGS, Felipe, Rinal, and the AHCA BGS employee for their defamatory remark, for wrongful termination based on the defamatory remark, for aggravation, pain and suffering, mental anguish, humiliation, and for chest pains/heart trouble due to the stress of losing my job. The employer took insurance money out of my vacation pay, which they are not supposed to do. I want back every dime they took. I want my sick days pay that the owe me, which I already earned and which they now refuse to pay me. They refuse to pay me the last check they owe me.
I urge you to investigate, expose, report, and punish Sunrise Senior Living and AHCA BGS for the malicious, unlawful manner that they have treated me and other Haitians and black American employees. ASCH BGS and Sunrise Senior Living have deliberately violated EEOC laws and my civil rights.
