Swift Funds, LLC Beware Deceptive and Illegal Collections Practices Rolling Hills Estates, California

This collections agency represents ABC Financial who finances gym memberships for various companies.  In NC, that would be Sports & Fitness of Charlotte.  When contacted by phone, he did not read the required mini-miranda statement, attempted to make me believe he was an attorney, requested a balance that was much higher than the amount that I actually owed, and refused to provide the validation of the debt to me in writing.

I disputed the debt balance, in writing, and could never get a validation of the amount that the collector was requesting.  I offered a much smaller amount as settlement, the collector refused to accept it.  I again requested an accounting of additional fees, never provided.

I have filed a complaint regarding violation of Fair Debt Collections Practices with FTC, CA Atty General, NC Atty General, and BBB.  I also spoke to an attorney who has filed one case and actually won a judgement in AZ against this company but has not been able to collect anything on the judgement.  He also says he has another case but has not been able to serve the papers as the office listed is not valid.  He recommended not paying anything to this company directly and to only work with the original creditor ABC Financial.
