must have been wronged somewhere in his life
because, he feel's everyone owe's him something other than being responcible to himself or the regulation's that are in plce under the law's listed in the F.M.C.R. (Federal Motor Carrier Regulation's) and those listed in the Federal Hazmat Regulation's. and he must not have read the Employee Handbook either. Because had he done so he would have found out, if you are not qualified, under NO CIRCUMSTANCE is a driver allowed to take a load or accept a load that he is not qualified to accept, pickup, or deliver.
All he had to do is say he made a mistake in accepting, because he didn't realize it was a hazmat load.
And call his driver manager, if he still felt something was wrong notify the Safety Department
in Phoenix. Under NO CIRCUMSTANCE would this driver been forced to take this load PERIOD.
That is the law and is followed to the letter,
not only that you are required to send in a qualcom msg. to the safety department and then call the safety department as a follow up to verify all information on your Bill of Lading
the you are correctly placarded and that you are qualified to carry this load.
This is a check's and balances system that is in place to avoid issue's such as this.
So I find this highly unlikely that this occured
by this driver. second even if he did'nt know about HazMat Regulation's which I doubt seriously
because when you go to a school, this is drilled into your head NEVER, NEVER, NEVER ACCEPT A HAZMAT LOAD if you don't have a HAZMAT Endorsement on your licence because your going to jail or will be fined heavily and you could lose your licence for 5 year's. and the company
will be fined,which could be in the million's.
Why would anyone want to take that kind of risk.
Lastly, as far as the Terminal Manager, well
I have never been treated so fairly by any company or terminal that I have worked for this man has done nothing but treat me and my family fairly and has went out of his way to make sure if a situation arose that he would have an open door. I have nothing but the upmost respect, and loyalty to this terminal and and to all those that apart of the Gary Terminal. I am apart of a team and feel that they are my family when the chip's are down they will listen in good time's and hard time's we have all made it work together.
