In working for this company for the short period of Feb. 05 and resignation as of Oct. 05,following training in Memphis, Tn Dec. 04. Recommend that nobody put thereself through what I endured while employed, finding that such unethical business practices are common practice for this company.

It is a sad realality that this company ripds off its drivers daily. In ways of short changing miles paid to actual miles ran, refusal of break down pay / repair time,unpaid layovers, short changing detention pay if paid at all, extending pay owed, unauthorized deductions, refusal of reimbursements, attaching miles to previous trips / misrepresenting pay, Assign advances as personal instead of company costs ( which can be monitered simply by advance code ends in a 4 digit number is personal and company ends in a 9 digit) etc....

Though the DM is advised to tell you whatever you want to hear, basically flat out lie in order to keep you running. Though all costs of running the truck are basically deducted from your check. So you are never getting paid what you earn. Word of advice copy all receipts and BOL's as they are counting on drivers not doing so as they will not reimburse w/o them.As well log all the time on your logs for detention and delays as they use logs to support there claims for non-payment.I would advise to do the same for the unpaid miles that they do not pay.As in attach empty mile diff. at time up p/u, and loaded miles at drop on logs to support claims of miles driven unpaid.

For those of you who are unaware there is a clas action suit for unpaid miles at hagens-berman.com, in which you may sign up for unpaid miles litigation.

Though in the event of doing so you may be subject to unpresidented safety holds, layovers,brk-downs and so forth in berating by your terminal in retaliation.As most of you should know would also be hard to get home time though policy states every 10-14 days.

It is only a matter of time before Swift gets whats coming to them, as long as they continue to get complaints. This all the more reason to make notations on your logs as it supports the reality of unpaid wages. Muchless, it proves that there unethical busines practices will not be tolerated.

Hopefully most of you will do so as well report report there illegal practices to DOT. As they are not unfamilier with them as they are barely holding on to there satisfactory rating. If they do lose this rating as I should they would also lose accounts that have clauses that they must hold a satisfactory rating in order to hold there accounts.

So bottom line is keep copies of all work performed, in the event of unethical/illegal practices get witness statements, even if you can obtain statements at a shipper or consignee off your qualcomm is worth it. Believe me they will lie through there teeth on facts or statements made on qualcomm. As in the harassment that I know is standard practice, get proof of your claims you'll need it.

As well do not fall for that safety dept. places you on safety holds, log classes, and log violations. Your Dm/Terminal control this and use them as a scape goat so you don't know. As it is standard practice in attempts to control what you do or berate you.

For those of you that get threats of DAC report negative marks you may obtain a copy of your DAC report in Tulsa, OK and if there are false reports get them for Blackballing.

This all may seem extreme though you'll feel diff. if your ripped off. Incompetence at it's best should be SWIFT'S motto- Or bad business is good business. How just hav'nt figured out how they have found so many dishonest people that have no problem carrying out there unethical practices. I figure you have to be pretty low in values to do as your told even if its wrong. I can only hope what comes around goes around if not to them but there family and see if they maybe understand then, though doubtful.

As a current Swift employee, i feel the need to rebuttal most of the complaints on this report. First a little background, I started with Swift in July 04, I went to a swift school in Utah. Spent 6 weeks with a mentor and then recieved my truck.

My first 6 months were tough, but you should expect that starting in any industry with no experience. You have to learn the ropes, figure out how the system works,etc.. I
toughed it out. It was not easy, i will abmit that but once you figure these things out it does get easier. Swift is not a perfect company, they are a huge corperation, as with any big company there are things they do that i dont agree, but thats life.

My over all experience with this company has been satisfactory, I here all the war stories and i come away with the feeling that alot of these people set themselves up for failure. They dont plan ahead They dont cover their butts and when problems arise
they are quick to start the blame game and not take responsilbility for their own actions
or short commings.

I am now a mentor and do pretty well for myself and my family. Again this takes time and effort on MY part. Here are some tips to consider if you are getting into this industry.

1. This industry IS NOT FOR EVERYBODY. You will make sacrifices in order to make it in this industry. Time with family is the biggest
2.Dont blow your money n trk stops, eat out of the truck, ie lunch box cooker, Most people are to lazy to do this and yes i know, its easier to swing by Mcdonalds and
get a burger but to me its just as easy to pull in to a rest area throw a pot roast n the cooker and it will be done in a hour, its better for u anyway.

3. Cover your but, make copies of all of your bols. Swift does loose them from time to time but i have NEVER had any problems with them when i resubmitted a lost bill,yea its inconvienant but i do get paid.

4. Be flexible, Especially with the way frieght is today. You have to be willing to go anywhere at any time
5. Quit whinning! This is a tough industry, But you look out for your self always. I cant stress that enough. If you are dependable, have a good attitude and are not always complaining to your driver manager about whatever then you can make it.
6. Your dm has a very stressful job, just like you. Give him/her a break, try to figure out solutions your self. Take the initiative, and when you do have to call your dm,present solutions to him/her that make sense and most of the time they will concur with you.

Finally, If you do have questions, ask! There are lots of drivers out there that are willing to share their knowledge and experience to you if you just ask, you can even
ask me 541-240-1288. I will try and answer your questions. Im not the perfect super
trucker but i feel that i have made this career a sucessful one and im planning on staying with Swift for the forseeable future.

hmmm...40k?

You said you made a couple hundred shy of 40K @ 25 cents per mile. Let's do the math. $40,000 divided by .25 is 160,000 miles for that year. 160,000 miles divided by 52 weeks is 3076. 3076 miles divided by an average speed of 55 mph is roughly 56 hours for that week of just driving. I would assume it is safe to say you put in at least, being real conservative here, an additional 20 hours for loading, unloading, fueling..all that good stuff that comes with the trucking life.

We are at 76 hours a week now....and those of us who have driven OTR know that is a real CONSERVATIVE number..probably more like 100 hours but we will stick with 76. At 40K a year, you are grossing approx. 769 dollars or $10.12 per hour. Averaging that kind of mileage per week tells me you were seldom at home. Hope you dont have a family. Oh, lets look at home time. 1 day for every 7 out. Ok, I start July 1 and run 14 days. It is July 15 and I take the 16th and 17th off. I go back out and run 14 days. It is now Aug. Wow....I was home 2 days out of the month.

Now you are an Owner-Operator, or is that lease operator? Big difference in owning a truck and leasing one...just ask someone who went to Peterbuilt and financed their truck and can take it to any company they wish. But if Swift says you are an Owner Operator, you see they really care, then you must be. What company out there pays 10...or even 12 bucks an hour, with no overtime, and allows you to be home 2 days each month? They love their slaves, er uh, drivers.

I worked for Swift in the office and seen first hand how they operate. Never would I recommend them to anyone. I told every student who came through the Academy to do their time, get the loan paid off and some experience and get the hell out. I have been with other companies that are far better than this entity called Swift. I see positive reports here occasionally but they come from rookies and people who never drove for any other company. I have worked for this company....of course I would never have driven for them....but know they are at the bottom when it comes to standards of safety, drivers, managers, you name it.

Good luck with your lease operation....I hope you dont succumb to the giant like thousands of drivers before you.

The real info about Swift

First of all, I have driven for Swift for the last 3 yrs. Next, a little enlightenment on the proccess that we are talking about.

First of all, swift is not a forced dispatch company and a driver has the option and right to refuse any load. Second, you are given a preplan to accept or decline the load with the miles written in the preplan. Once accepted, you are given the addresses and particulars of the trip. And the last thing you are given is a fuel routing. That is to say, they route you according to the fuel stops they are getting discounts from.

#1. I have a map program on my laptop and the miles paid have ALWAYS been within 2% of actual miles and in about 25% of the the cases, I can route myself to run less than paid miles. If you are "get shorted" on paid miles, you are being lazy and not using your motor carriers map guide or computer program to find the shortest route possible to make the trip.

#2. Fuel routing is a SUGGESTED routing. Any truckstop that accepts Comdata fuel cards can be authorized simply by sending the comdata number for that fuel stop to swift via the qualcom. ANY comdata store will be authorized by Swift.

#3. The first year I worked with Swift I was being paid 25 cents per mile and was within a couple hundered dollars of making Forty Thousand that year and have progressively made more each year.

Copying all of your bills of lading is manditory. With 23,000 trucks(17k company and 6k owners) you can imagine that the booking can become a nightmare and papers do get lost. It covers you AND the company to have a photocopy of the bills.

On the subject of the Logs. There is a Department of Tranportation office set in Swift's headquarters in Phoenix Az to keep an eye on the logs. Swift has its driver logs monitored by an outside company in order to ensure compliance with the laws. If you are being told by a DM to falsify your logs, then you need to report him.

NEVER allow a dispatcher, planner or customer service rep, tell you how to drive your truck. You are given a copy of the motor carrier law book when you are hired with swift and if you aren't smart enough to read it for yourself and cover yourself, then you deserve the violations and legal problems that come with it.

Swift goes so far as to give you violations for things the DOT doesnt.

For instance: Questionable speed. This violation is representative of a driver going too fast on his logs for his truck- Swift governs company trucks at 65 MPH and you cannot average 65 MPH on your logs. You do not get into your truck, start it an instantly move at 65 so they do not allow for a truck to have averaged more than 63 miles per hour.

If you dont flag your fuel stops, or place the fuel stops in the wrong place they will issue a violation. And they base log classes for violations on percentages NOT number of violations or type. IE- 8 fuel stops and 2 were wrong. that's 25% and above acceptable so you are put on safety hold til the class is complete.

Again, Swift is not perfect and I personally had to take a class for questionable fueling after a dalight savings time error in which all of my fuel stops were recorded in the wrong time zone and for the wrong time making all of my fuel flags 2 hrs off.

Further, the logs are scanned by computer and if your handwriting is less than perfect, the computer misreads it and spit out another violation.

And lastly, it's not just driving. You who whine about Swift need to drive for other companies and make comparrisons. I have worked for companies that continually pay you 20% less than actual miles driven and that is after figuring the shortest route possible. Detention and reimbursements for 23,000 drivers is a pain to handle let alone everything else.

Yes it's tedious to resubmit, yes it gets annoying but yes it gets paid. Hassles are actually a rarity and the person filing this complaint is obviously to lazy to do the work neccissary to be a truck driver let alone a driver with a company as big as swift. Please go elsewhere and annoy them as you will get no sympathy from me.

Oh.... I am now an owner operator with Swift.


Side note. Swift get a lot of flack due to the fact that they are the largest training company in america. They have more rookie drivers than anyone. As a result, rookie mistakes are everywhere, with being largest we are highly visable, with detention pay starting after 2 hrs of waiting, a driver that got there first might be bumped due to that shipper not wanting to pay swifts detention fine and there are a lot of want to be drivers that were fired from swift telling rumor not fact and it spreads because we are so visible.

Swift relies on the ability of its drivers to be courteous, professional and intelligent enough to ask the questions they need to ask in order to improve themselves and all the while maintaining safety.

Rule #1- if it aint safe, tell em on the qualcom and they cant argue with you.

I did not take the job with swift, all though swift approved me for their company paid driving school, If i knew swift would have accepted me two years ago I would not have wasted my time with schneider but after getting treated like dirt by schneider I did not trust any of them. I should have applied with swift two years ago I could have already been driving by know but things don't always work out the way you want, everything is sad right know for me still angered by the way schneider has treated me!. I even got accepted by cr england but I did not take it everything is to depressing know. I am going to frame my prehire letter & hang it on my wall.

Well all of you employee's that feel the need to respond? Unless you were in my truck and been in my shoes -- don't tell me what happened!!!!!!!!!!!!!! I was there.

This is mainly to HEATHER AND BRYAN, as I see you have another new emplyee to screw that is bending over for u as of now -- CHARLES, so have at it.

There are to many drivers w/ the same claims of the exact same events. So I hope you are all proud of what you do to them (drivers), can only hope it is done to u in the future. This is what gives me piece of mind, because carma a bitch in the life of Swift... if enjoy working there you must know what you are doing to stay ....taking it like the divers, your superiors have you in the game of lying,cheating,licking ass!!! More power to you!!!!!!!!!

Last but not least I have been working since I left and the company does not treat it's divers in the same manner!!!!!!!!
So all of you whom claim that is the trucking business, keep preaching it to the new drivers because its B.S.!!!!

I just got accepted into swifts company-paid training school, soon I will be a full time driver for swift I am know part of the swift team! I have just received my prehire letter. I am grateful swift is giving me this chance when others turned me down for their driving school I will work hard & do my best work for swift, I am excited to be accepted into swifts training school were I can be begin making money & saving money I have been waiting a long time to drive a truck I am very excited swift is giving me this chance. I look forward in driving cross country! I have been waiting my whole life I hope I will be with swift for a long time, I am a little bit nervous & scared because this will be the first time in my life I will leave home so i know for sure I will be homesick & again I thank swift for giving me this chance.

1. PER THE FMCSR 395.1 ALL LOGS MUST BE DONE LEGAL AND CORRECTLY- ALSO, PER 395.8 THERE ARE CERTIAN THINGS ON THE LOGS THAT MUST BE ON THERE (I.E. MILES,DATE,COMPANY NAME AND ADDRESS,TRK AND TRL NUMBER,RECAP,EVERYTHING ON THE GRAPH LINES 1-4) PLUS THE SHIPPER MANFEST NUMBER AND TYPE OF FR8T.

2. EVERY SWINGING DICK SHOULD KNOW THE 11/14/ HRS AND 70 HR RULES. IF NOT, YOU DIDNT PAY 2 MUCH ATTN IN LOG CLASS DIDNT YOU? NOW IF SOME DESK WENNIE THAT SITS BEHIND 3 FT OF BULLIETPROOF GLASS TELLS ME THAT I HAVE 2 RUN A LOAD ILLEGAL NOT ONLY NO, BUT HELL 2 THE NO! OK NOW IF THEY GET PISSY ABOUT NOT RUNNING FR8T, AND U HAVE IT ON THE QC ABOUT NOT HAVEING HRS, THEN 2 BAD FOR THE PLANNER

3. AS FOR NEW DRIVERS, IT WILL TAKE U ABOUT SIX MONTHS TO FIGURE OUT THE SYSTEM.YEA DO EVERYTHING VIA QUALCOMM IT WILL SAVE YOU A LOT OF TROUBLE. OPEN COMMUNCATION IS A KEY FACTOR WITH YOUR DM.THAT QC WILL HELP YOU IN MILLLONS OF WAYS POSSIBLE. TAKE EVERYING THAT THEY THROW AT YOU-- BUT DO IT LEGALLY. THATS THE KEY WORD LEGALLY.

4. AS FOR NOT GETTING DET PAY (DETETION PAY FOR U FNG'S)OR NOT REIMBUSRED FOR EXPENSES OCCURED. HMM.DID U EVER THINK TO MAYBE WRITE YOUR TRK, TRIP, AND DRIVER CODE ON THE RECIEPT AND KEEP A COPY FOR YOURSELF? I AGAIN FIND IT HARD 2 BELIVE THAT IM THE ONLY ONE SWIFT THAT EVER GOT REIMBUSRED FOR EXPENSES AND STILL FIND IT INCONIVEABLE THAT IM THE ONLY ONE WHO GETS DET PAY. YOU DO GET PAID FOR DRIVER UNLOADS ETC ETC BUT DID YOU KNOW U GET PAID FOR SWEEPING OUT A TRL ? ITS A LOUSY 15 BUCKS BUT HEY THATS 15 BUCKS I DIDNT HAVE.

5. TRAINING- ITS A NASTY JOB BUT HEY ITS NOT LIKE THE FIRST TIME IVE VOLUNTEERED FOR ANYTHING. YES MENTORS GET PAID FOR ALL THE MILES WHILE YOU ARE ON THE MENTORS TRK AND A PENNY FOR A YEAR (OR UNTILL U QUIT) HOWEVER IVE NEVER GONE ALONG WITH THE IDEA WITH STUDENTS BEING USED AS A 2ND LOGBOOK. STUDENTS ARE THERE 2 LEARN FORM OUR EXPERENCES, KNOWLEGE AND WISDOM, YEA I WORK MY STUDENTS AS HARD AS I CAN BUT POUND FOR POUND OUNCE FOR OUNCE, MILE FOR MILE EVERY FNG (THAT'S FUCKING NEW GUY/GAL FOR THE UNEDUCATED)THATS MADE OFF MY TRUCK HAS RAN (LEGALLY MIND YOU) AT OR ABOUT 3800 MILES A WEEK PLUS WHATEVER DET PAY THAT THEY HAVE ACCURED. AT THE SAME TIME I HAVEE NEVER AGREED WITH STUDENTS SAYING WELL THERE ONLY PAYING ME 350.00 A WEEK THATS ALL THERE GONNA GET OUT OF ME. WRONG ANSWER THERE BUCKY!!! 350 THE FIRST 2 WEEKS 400.00 THE 2ND TWO WEEKS AND 500.00 THE LAST TWO. MINUS TAXES AND ADVANCES YOU DO GET PAID AND U GET EXPERENCE OF SAFELY DRIVING A TRK AND DOING IT THE RIGHT WAY. NOW IF YOU ARE GETTIN A BUM DEAL FROM YOUR MENTOR (AGAIN NOT TRAINING YOU) GET A NEW ONE THAT SIMPLE

You obviously need some time behind the wheel.

Your statements and assumptions are way off.

As far as the Qualcomm LOGS, they can be kept indefinitely. It is up to the company. The time periods you refer to are how long they are kept on the system and available to all through the terminal. This is not what i was referring to.

Trust me, these logs are downloaded and archived, sometimes even transcribed and printed out and stored. I've seen this.

As far as the miles go, there are HHG miles known as short miles, there are practical miles which is the industry standard that most major carriers use, and then there are hub miles or log miles.

It is very rare, as an employee driver to be paid by the job, and in some states is illegal as all hours worked [15] in a day divided into the flat rate must be at least minimum wage.

Usually owner operators will flat rate jobs on low paying freight, as some shippers still want to do it by the hundred weight, such as HAY, or piece rate on cattle etc.. Not too common anymore.

Sounds like you work for Swift.

Misconceptions

The trucking industry is very difficult for most to understand. Many people believe that it is just a job that will allow them to see the county side. What many people dont realize is that when researching a carrier, on average, they have either researched or spoken to 4 other carriers before making their decision. With that in mind, its very easy to confuse the information. Who said what to me? I mave read many misconceptions on this cite. First to mind is the qualcom. Position history goes back 45 days, but message history will go back a averge of 10 days depending on volume. The next concern I see is paid mileage. Weather it be JB Hunt, Schneider, or Yahoo trucking, we all use the same mileage matrix. We do that as a whole because of fair trade. Realisticly, hub miles can not be paid. There is no way to regulate drivers from driving 2 hrs around the same block. Now, dont get me wrong, there are carriers that do that but those that do, I think you will find pay by job and not mileage. In that case the job pay will almost always exceed the mileage may. That is why that pay tarif has gone by the wayside. Those of us that are in "IN THE OFFICE," for more than a year do it for the respect of the driver. It takes alot to walk into work every day and know that maybe only one call out if yourr day will be good. We walk in knowing we will not only have the weight of our lives on our sholders, but yours. Your dispatcher chose to come in and help you though that day. Your dispatcher came in knowing that you were going to lay your personal, financial, and economical issues on them. Yet they are there. We know its cheeper to call us than home. Its a 800#, right?

So please remember it takes 12 people to move 1 load. Be patient and remember, next time you go to Walmart, Target, or goofball exports, we in transportation are doing a very important thing. If you got it a truck brought it. Thanks to those who see what we do as important and stay in transportation. To those that dont, the BIG DOGS will still bring you your stuff.

DOT has an office located at Swift's HQ office and everyday randomly pulls logs and checks them

You guys who are claiming you've worked for Swift realy show everyone how much you didnt even pick up your employee driver manual not one time while driving. I see you didnt even comunicate with your DM's nor your terminal mgr. This is something you must to due to get that extra pay you're complaining you didnt get. Also those of you complaining that you didnt get your miles. Oh Please! Show me one trucking company that does and i will give you 500 dollars. FYI swift pays zip code to zip code. As far as the logs are concern you must keep your own records. Because logs are scanned into a computer system by an outside company that many major trucking companies use. The problem with this is if your hand writing isnt so good, the scanner will spit it out and not record your time. thus you now have a missing log and a log violation. Now if this continues the company will pull you in and make you take a log class. They give you a days pay and buy you luch. In the log class you learn how to fill out a log sheet correctly. Now everytime I have been to one I have learned something new. No harm ever done. So guys make such a big deal about it. What most drivers do not know is that DOT has an office located at Swift's HQ office and everyday randomly pulls logs and checks them. If there is a certain percentage pulled in violation the company or terminal can be shutdown. So now with that info in mind. Those of you screaming swift realy needs to understands that DOT has already spotted the driver and in most cases audit that same drivers logs every month. Also all responsibility is always resting ultimately on the drivers shoulders. Swift only does its part in bring the driver in and educating him. I have been driving for the company for 4 years. And yes i have had problems. I have always worked them out simply by understanding this a huge company and understanding the administration, communicating with the supervisors. Mostly, I read my employee had book. Something most drivers dont even look at.

Unfortunately, it will usually take a subpoena,, and even then they play the game of "they got erased" etc..

If there was anything incriminating on the logs, they are more than likely destroyed already.

The FMCSA can get them, after you file your complaint.

Where might I obtain the records of qualcomm?

I am still working with OSHA and it is a very slow process considering that they submitt depositions of there employee's?
I have been trying to obtain the Qualcomm records other than just what I have written, so any advice would be appreciated.

Secondly the other question of what else you might do , get an atty. also file a claim with the current class action suit that I had listed.

I am willing to work with anyone to stop a company such as this. They are crooked as it comes for honest hard working individuals. I noticed you did not list a contact so i will for myself PH # 605-692-7332 ask for BOBBI.

Good luck and if there is any informaton anyone could provide to help please contact as I have a hearing coming up.

Another way to protect yourself

Don't have any conversations over the phone, use your Qualcomm for everything when there is a bad situation you are dealing with.

Most companies keep logs of Qualcomm use for 1-3 years.

They can be obtained by subpoena.

When I was OTR, I logged everything on my log book, and it drove the DM crazy. They outright told me not to put ANY remarks on my log.

Then I asked, "are you telling me to falsify my log". Then there was silence.

Unfortunately, most companies run this way, as I have been thru several. I will not run illegal or unsafe for anyone. Period.

I had a dispatcher repeatedly calling me on my cell to move a load illegally, he would not use the Qualcomm because of the log evidence.

I hung up and got the DOT on the other line and then did three way with the dispatcher.

Took care of that problem. Also took care of my job. Oh well. NEXT.

My advice: Document EVERYTHING and make multiple copies.

swift does mess with logs

I am a ex employee with Swift. You are right they kept telling me that I had to take several training classes or else they would fire me . Among them was log classes for violations that I had not done. I have some paperwork that I had saved in case an attorney could use them. What else should I put together?
