TMB Motors Sports dba DV Auto Sales I wanted to buy a car there, it needed repairs, I gave them all of the money up front, they didnt do repairs, now they have the car and my money and said theyd refund me but havent. Brooklyn, New York

I put money on a car, actually the whole amount at a used car dealer in Brooklyn, DMD Motors Sports dba DV Autos, 2079 Utica Avenue, Brooklyn, NY. I wanted to buy a 2000 Ford Explorer Limited there, on Saturday July 10, 2012, but it needed repairs and James, the salesman, said that all of the repairs would be taken care of in a couple of days, he even was saying that he would do things that I didnt even notice. Long story short, I gave them $2600., $1900. for the car, and $700. for sales tax, destination charge, inspection and them getting the registration and tags for it.

They didnt make the repairs, i asked for the money back, they said they would give me a full refund and have been dodging me since. The latest was last week, when a woman named Amita called me and said she was away for 2 months, and that she would have the check for me by yesterday, Thursday, August 30, 2012. I told her I couldnt get over to Brooklyn until Saturday, September 1, 2012, and she would leave the money with Anna a worker there. [continued below]....

..... I called today just to confirm that the check was there, and they put me on hold for 20 minutes, I finally hung up, called back again, no answer.

Called one of their other phone numbers, got some guy named Rick, he said Amita went out and wouldnt be back for half an hour. I said she kept me on hold for 20 minutes, and leaves and doesnt even talk to me, he said call back in half an hour. I called back. She was out talking to someone about a car this time, I spoke to Anna, and Anna said she would call me back. Anna never called me back, so I called Anna back and she said Amita left. I asked Anna if Amita left her the check as promised to me, and Anna said no. Anna went on to say that the boss had to sign the check, and I said who is the boss, she said his name was Dan,

I said what about John, I thought he was the boss, I had been talking with him before this, he was the one who had told me to fax over a letter almost a month ago to say I wanted a full refund, she got quiet and then said they were both the bosses. I said call both of them please and get them to sign a refund check for me, Anna said oh its so hard to get in touch with any of them, and theyre hardly in the office.

I said I dont care, they dont want to give me my money back thats what the situation is I told her, she said she would try to get in touch with them. After that, I called John's cell and he answered the phone and I said John, and he immediately hung up on me. I called right back and it went right to voicemail. I left him a message that he had stolen my money and for him to have a check ready for me tomorrow or I was going to get the media involved.

I have already filed papers with the BBB, the NY Bureau of Consumer Affairs, and spoken to the Attorney General's office. I also made a complaint early on to 9 on your side, the television Consumer Advocate, early on but have not heard anything back. Can you please help me get my money back? I know now that this dealership has no intentions of giving it back to me and I am disabled, on Social Security Disability for 18 years, and this was all of the money I had to buy a car. I will never get this opportunity again to buy a car if I dont get this money back.

I am 55 years old, they have gotten me so stressed and depressed, that im fatigued all of the time and have a hard time eating. On top of this i lost a nephew in Afghanistan almost 2 weeks ago, when the Black Hawk helicopter he was piloting was shot down in hostile fire. I cannot handle all of this anymore, I just want my money back, mourn the loss of my 29 year old nephew, and start looking for another car.
