Please see the following letter that was written to a Bistro staff person. I discovered this site after learning that their company name was changed. This was brought to my attention from a lawyer in my family and I was shocked. I wanted to inform any small business owner who works hard to hold on to what little we have in this economy. I am still upset that one business owner would do this to another. Lastly, I replaced my company name with the word us. I hope this helps so man out there from becoming victims just as I almost did.
You and I spoke last week and we confirmed the payment and The Bistros New Years Eve party. We confirmed the contracts start time as well as the payment. You asked about the $50 advertising money that was due between us and The Bistro. You asked about the $50 fee being bartered from the balance that the Bistro owed to us. I stated that the $50 fee can be deducted from the $400 balance and the remaining contract balance still stands of $350 to be paid the day of the event to us.
That all being said, there was a huge issue with payment at the end of the night for The Bistros New Years Eve party.
The party ended at 11:50 PM on 12/31/10. I went to seek payment and was told by Jillian that she did not know that there was a balance. Jillian told me that you said that we were bartering the whole balance. Jillian said that she could not call you because you were just an assistant.  I asked if she could call the person who signed the contract. She said she would try but, she had just got out the hospital the day before and that she would probably not answer the phone. After 2 attempts to that individual by her, Jillian was not able to get this problem resolved. The issue still stood that money was due. Payment had not been made. She said that she did not have any money to pay me and she had no checks because the Bistro had just changed banks (which was not an accepted as per the signed contract anyway).
After about an hour and a half of discussing this matter, she would not give me the phone number of the actual owner. She said to me that she was the owner however had introduced herself to me as the owner. After waiting for a call back from our legal counsel. I had decided to call the police for theft of services. When that was stated, Jillian made an immediate phone call and claimed 2 minutes later that her brother had dropped off money to pay the balance. Her brother was never seen. The money she did hand me at first was not the full balance. After walking around the building she pulled money from everywhere to pay the balance in full.
I am first thankful that the matter was resolved that evening after an hour and a half of complications. However, I felt very deceived by the Bistro. For the following reasons:
1I I said lets call Krissy to solve this situation to clear up the Bartering claim.
2I I wanted to talk to Ashley Stratton so that she can assist us with the payment.
Ashley Stratton did not put the correct contact information on the contract.4.
Jillian would not give me A. Strattons phone number to call her myself.
LL Lastly, the simple fact that she would to the degree of lying to state that her brother came through the back door to give her less than the balance that is due.
In conclusion, I am no longer interested in continuing any advertising or marketing through The Bistro of Exton. I feel as though this mistrust and blatant disrespect for not getting paid is something that I would not want to risk for my staff or anybody associated with us.
Effective immediately, please cancel the marketing contract between us. The last months marketing rent was paid in advance so we should all be finalized.
