I ordered an email and telephone contact list to market my offering to on 06/02/2014 for $250. The list subject was "unemploed americans". The list was to contain Names, Email addresses and Telephone numbers.

The list that they sent to me  out of the first 21 names had the following results

12 disconnected numbers

04 wrong numbers

04 numbers that just kept ringing

01 person whos wife stated her husband had been dead 5 years. 

 

I spot checked the rest of the list with similar results.

 

I contacted Ellen Greenfield at The Data Boutique and she resent the same list with the names rearanged. I demanded a refund and the Data Boutique refused.  Also this transaction occured on 6/02/14. They kept BSing me around until 06/16/2014 when I finally said I will take it up with my credit card company.

I'm puting a fraud claim through to my CC company.

P.S. Ellen Greefield of the Data Boutique has custumers Fax an authorization to charge the credit card. I should have been more suspicious...20/20 hindsight.

 Hi Fellow Marketers.

 

As you can see from the rebuttal Ms. Greefield is educated, well spoken and writes very professionally. But the FACT is at the time Data Boutique asked for my $250 they did not even have the specific list I asked for, which was a list of "Unemployed Americans". Data Boutique never varified even ONE of the contacts. I was required to to spend my own time substantiating that the list they gave me was not only NOT a list of Unemployed Americans but it was YEARS old as well. I spent 2 weeks rangling around and got SQUAT!

The list I ordered is not a usual type of list as out of 20 places I contacted 15 of them said WE DON'T HAVE SUCH A LIST. The fact of the matter is DATA BOUTIQUE did not have the list eigther but they took my money and tried to pass a GENERAL CONSUMERS LIST off as the TARGETED one I asked for. Data Boutique might have gotten away with it if the list they sent was not so old. A significant portion of the list had AOL AND HOTMAIL email addresses....come on! That list is just as old as she is.

All I'm really saying here is BUYER BE WARE AND DON'T SIGN ANY CREDIT CARD AUTHORIZATION FORMS! The Data Boutique will use it to counteract a FRAUD claim.....YOU HAVE BEEN WARNED!

Hello, I am Ellen Greenfield, owner of the Data Boutique.  Below is the actual email response sent to the customer on Monday June 16th.  This outlines all the facts of the issue that he is stating.  Please feel free to contact me directly at 877.663.5536 oron my cell at 305.785.8226.  I 100% stand behind all my products and make sure that all my clients needs are met.  

Hi Mark,
 
I received your voice mail and wanted to email you regarding what is going on.
 
You placed your order on: 6/1/2014 for 2500 records with telephones numbers, nationwide for unemployed people.
 
I delivered the list to you on 6/2/2014. 
 
You then called me back to let me know that there were disconnects and fax numbers, along with people that were on SSI or were now working for the past few months.  I went ahead and asked you to send me over samples to verify what you were experiencing.  I asked for documentation so that all of our bases would be covered and told you that any issue would be corrected, if need be.  I received the sample 3 pages and went ahead and did some additional verification for you.  Most of what you stated was correct, but there were some where people were indeed at the residence, just not at home.  SSI qualifies under unemployed.  I explained that to you and you stated that that was not what you wanted and the data was old.  I went ahead and asked if you would please do me a favor and call on some more names and not just ones in Alabama so we could see if there was indeed an issue.  You agreed and I went ahead and sorted the list for you in random order.  You were going to call on the list for 2 days and get back to me. Well, you called approximately 21 additional names and stopped calling.  You followed up with me and told me you did not want to call on this list anymore. I explained that the list would have approximately 20% wrong, fax, and/or disconnected numbers.  That has to deal with the DNC list and the telephone numbers that are on it.  I also explained the list was updated quarterly and you knew that 100% going into this.
 
I then went ahead and decided that I would locate to additional list sources for you to make this program work for you.  I did just that and sent over the email confirming what I could get.  We spoke on Friday afternoon and you started to tell me that you needed more that the allotted amount of names that we could provide.  (One list being, exactly what you were looking for- with 3k names available).  My company is on an order by order basis and not on going subscription.  We provide the quantity that you request and you are not obligated to anything more than what you pay for.  IF you want to order again, we enter into another order.  I can only provide what I can Provide based on the order.  I fulfilled my obligation and then some by trying to make you happy.  On Friday, you asked if I could get you a sample of the new list for you to try.  My answer was 100% YES.  You agreed to that and I went ahead and made arrangements with the vendor to secure that list for you.
 
Now, today, Monday May 16th, I was ready to deliver the list before noon, as you requested, as additional good will and you leave me a voice mail telling me that you do not want the list and you spoke with someone at Angie’s list and you can get names from The DOJ for $45 in the Los Angeles County area and you want a refund of your money.   You ordered a Nationwide list from me, not one from a single county in California. You told me on the telephone, Friday that if we could not get you a lot of names that you would change your business model.  That is not my issue.  My issue is to provide you with the product you originally ordered and handle any issues that may arise.  I have been doing this for 17 years and my clients are always taken care of 100%.  If they are any issues, I handle it as needed. 
 
I went above and beyond to make this work and accommodate you.  This went far beyond what you had paid for.  I cannot be responsible for your ongoing  changes to your business model.  You were 100% fine with sampling the new list that I would provide you with today.  I can still provide that list to you.  I am not responsible for anything more that fulfilling the 2500 name order that you placed with me.  You ordered and I fulfilled and have gone above and beyond to work with you to make your campaign successful.  Every time you called, you had a different model.  I spent time on the telephone going over all the possible criteria you would accept.  I was filling the order based on your criteria.  I am not responsible for changes after that.
 
From this point, I will be happy to provide you with the list I ordered for you, on Friday, per our Conversation.  I will not be providing anything more after that.

Correction of misspelled words on previous report
