“Given your client's history and well-known reputation as a
landlord on Bond Street, bad faith will be easy to establish as your
client previously sought to evict Ms. Balcon on a claim that her
actual primary residence was a bus.”
Mrs. Roberts never engaged in the conduct above, she does not have the inferred bad reputation in the community and she never sued Ms. Balcon for eviction. Thus, Mr. Hillgardner's intentionally violated ethical codes and the attorney misconduct doctrine.
Therefore, Mrs Roberts is filing a complaint against Mr. Hillgardner with the Disciplinary Committee for the Second Judicial District and she is filing a civil lawsuit against Mr. Hillgardner for defamation.
