I received a phone call from a company about a weight loss patch. I asked if the patch was safe for breastfeeding moms. I was told yes and there was a full 30 day money back guarantee. I would be billed 19.90 initially and $199.95 after 30 days for 90 days worth of product. I specifically asked if all was refundable to the rep and to the second person I talked to who confirmed the order and told me she was management.
Product package stated on the back that it was not recommended for pregnant or nursing mothers. To contact doctor first. I looked up the ingredients. None of them were safe for babies who breastfeed.
I called about a refund and was told it would have to be approved after a review of the tapes to hear if the rep told me that it was safe for nursing moms. The guy said he would call me back the next day. I argued I was told initially that I could return for any reason and he said that it was not true. Never called. Didn't even take my name or number.
I called back in two days. I talked to Sharmaine. She told me to send the product back at my expense even though the lady lied to me about safety.I asked about letter from Monterey Financial stating money would be withdrawn from my account on April 20, 2003. I asked if that would be stopped and was told yes. They also said that $19.90 was not refundable because it was shipping charges that were never refunded.
Sharmaine said that money back guarantee only applied to $199.95. I asked how they could give you a full 30 day money back guarantee on money they had not received yet. ($199.95 is not taken out until after 30 days is up so guarantee could only apply to $19.90 taken out initially) She said I misunderstood the guarantee and also that I would not be refunded the amount it cost for shipping it back even though I was lied to. I told her that was not fair because I never would have ordered the product if I had known it was not safe while breastfeeding.
I sent the product back by April 17,2003. I sent it by confirmed delivery with the USPS and received confirmation on delivery date and time. I have called about a refund 9 times since that day and still have not received a refund. I talked to Lana on 05-28-03 and she said the check was sent dated for 05-08-03. She was to make sure if it was sent and if not she would send one on 05-29-03.
I called on 06-16-03 and spoke with Lana again. She checked on refund and told me that there was a hold on refund checks and it would be another week before they were released. I asked how could there be a hold on a check that was supposed to be mailed on 05-08-03 or on 05-29-03. She said she could not give me any more information except there was a delay in the refund department. Also that she was the assistant customer service manager.
I asked to speak to a supervisor and she said she knew as much as anyone else. I even called back and spoke with another girl(I asked if her name was Lana she said no)I asked her to let me speak to a supervisor and not Lana. She would not let me speak to anyone else. She said Lana knew as much information as anyone else did (must be what they are told to say).
I told her about the internet site. She said she didn't know what I was talking about. I also asked her to give me the address. She gave me the same one Lana did. I told her that I was contacting my attorney on 06-17-03 ( which I really do have an appointment with) about another matter but plan to talk with him about this situation and the website. She said to do what ever I felt was necessary.
I guess I will have to sue them to get my money back. If anyone else is having the same problem with them, please e-mail me. I would like to get all the help I can to get my money back.
