My mother, a disabled woman was SCAMMED by this company! As her daughter, I usually handle her financial buisness. She ordered the trial slim-patch for 20.00 and like most of you was sent the trial with 2 extra months about 4 weeks after ordering. When she recieved the package, and the bill for 199.00 we called Treehouse that day. After speaking with someone named Shea, we were informed that if we sent the extras back within 30 days we would only be charged for the original trial package.

A week later I sent the package back via US postal services. Included was a letter informing them of the mistake, what we had done to correct it, and the instructions from Shea to remove any further charges from our bill.

Since then we have been recieving phone calls from SEAN OHARA supposedy from a company called Rocky Mountain collections (a division of treehouse). Not only does he claim no record of recieving the package we sent back, he is always very rude, cursing, and threatening. He also refused to let me speak with a supervisor, tell me what state the company is based out of or give me any other information on Treehouse or Rocky Mountain collections.

To add insult to injury he also informed me that he would be calling DAILY and HARRASSING my mother untill she authorized her credit card to accept the charges. He also told her that he would ruin her credit for seven years when she asked him if the phone calls about returning the product had been recorded. (this is when he started using abusive and offensive language).

After hearing the phone call from him today (12-12-02). I called him back and tried to professionally resolve this matter. In 20 minutes on the phone he successfully managed to escape giving me any information or letting me speak with a supervisor stating that "I will not give any information to you or your MOMMY while you are on the phone."

After hanging up I tried to search the BBB in Utah and national database for any information they have on either of these companies. Big Surprise when there was NO LISTING. Hmmmm. Then I found this link and BEHOLD there it is. I found it interesting that one of the rebuttals for Treehouse is signed SEAN. (spelling is correct per Mr. Ohara).

As someone whose career is in telephone sales I am APPALLED to be treated this way by any company. I know the rules and regulations about misleading customers,customer service and the FCC regulations. For those of you who have have been scammed by this company...CALL YOUR CREDIT COMPANY NOW! Tell them the charges are not authorized and dispute them. Untill this matter is resolved you will not be responsible and your credit card company will look into the company and the charges and legally take care of the matter.

For those of you who have been scammed by this company and would like to get info on participating in a mass lawsuit please post your rebuttals to this report as we have contacted lawyers and are getting the ball rolling so to speak.

As I sit here reading all these messages, I honestly cannot believe what I'm reading. First of all, I'm NOT an elderly woman who forgets what she's been told and needs to be taken off her checking/credit account. (Such a disrespectful little comment/excuse from the person(s) who made it anyway. Like one person said, we should PROTECT our elderly from this type of treatment since they DID live at one time in a world where most people were honest. PLEASE, oh please, don't suggest that we lock them up now INSTEAD of those doing the dishonesty!)

I, too, have been scammed by this company for $220.00 total. What I'm reading here is a variation of the same plot by Treehouse Marketing...send the product LATE or in unauthorized/unexpected quantities, debit the card EARLY, LIE, PROMISE, HALFWAY APOLOGIZE TO "APPEAR CONCERNED/SORRY", DISPLAY RUDENESS AT TIMES TO INTIMIDATE, THREATEN, DELAY, MORE EXCUSES, and on and on and on. I've been at this for at least 8 months now. I WILL NOT GIVE UP, though...because these people MUST be stopped!!! I figure if our military can go risk their lives to stop EVIL, I can surely pursue this to the end to stop the same evil here in the U.S.!

Through my MANY telephone calls to Treehouse Marketing, most of the young representatives appear to be "somewhat concerned and hopeful" that a resolution can be found with my particular problem. Anyway, that's how they've treated me since they KNOW I've followed all their little rules and regulations. It's been more a matter of delays, excuses, lies, and empty promises from them about returning my money. I think we must be on Excuse #37 by now! So, don't feel badly if you can't get anywhere with them either. I've done it all, and I have all the my ducks in a row, and they STILL refuse to refund my money.

After reading the message from one of the employees who is standing up for this company, I can only envision a "cult type atmosphere" these people must work in. I have no doubt that Jason Turley is probably a very up-beat, enthusiastic, dynamic personality kind of guy...along with all those other characteristics we've read that most cult leaders possess. SOMETHING must be screwing with these young people's minds to convince them that this is an up and up kind of company that "has to protect itself from us bad, bad people, the customers".

The statement that did scare me the most, though, is when the employee wrote that THEY will be our lawyers, doctors, etc. First of all, HEAVEN HELP US ALL, if this is the kind of generation coming up the ranks. Secondly, I honestly believe that this "college student" IS fooling herself when she makes this comment, so I can breathe a sigh of relief. ANY person intelligent enough to make it through law school or medical school WOULD figure this company out within the first week of employment! So, dream on, whoever made that stupid little statement, because you obviously DON'T have what it takes to reach that level of personal success if you're so NAIVE and can't see what's actually going on here with your beloved company!

Now hear this, Clarissa, or any other TMG employee, friend, or scam artist.
I too ordered one of your products, I couldnt afford the 200.00 so I did the 19.95.

#1. THe product totally sucked.

#2. It was sent back overnight mail because I was told, if you didnt receive it by the due date I would still be charged and there was no way to get refunded.

#3. I was still charged 199.95.
#4. Your debit caused 3 bounced checks @ 30.00 each.

#5. You people actually acknowleded YOUR mistake by faxing a letter to my bank, asking them to waive the bank fees. Bank said "NO", get it from TMG.

#6. It was a debit, when I asked to have my money redebited back to my acct, Clarissa, Joanne, Charmaigne all said oh, we dont do that.

#7. You agreed to send me a check.

#8. You cant refund the overdraft fees.

#9. My check has been approved to be sent out get this, April 17.

#10. No apologies, no regrets from any of your employees.

#11. After asking to talk to a bigger boss than customer service, them practically lost there marbles, oh we cant do that.

12. Wouldnt tell me owners name, number, or address.

Now, I'm still waiting for my money, cant pay bills that were supposed to be paid this pay, and you people are trying to defend your actions.
I will work out a way to see this company is spread as far over the internet as it can be.
You people need to stop preying on innocent people.

Just because you get them recorded and on a script doesnt mean you arent ripping them off, what are you saying before its all recorded.
And what about after when they need you to understand. Thats what makes you bottom feeders.

And if you are still working for this company after reading all these complaints, all these rebuttals are right about you telemarketers.

Have to apologize wouldn't like to, or need to, or any thing other then have to apologize
be more fitting the only thing you people are sorry about is the fact that you're business dealings have been exposed and you're employees continue to dig a deeper hole by exposing the true attitude of Treehouse marketing. Im sick of reading about poor Treehouse being taken advantage of by lying customers. There is a problem here you cant cover up.

As far as contacting Treehouse Marketing customer service. We All have read how that works.

One transfer after another then someone will get back to you then nothing. Face it you're word is not worth spit. I also appreciate how you continue to avoid answering direct questions. Readers see this failure and it helps to form there opinions.

You state you hope to get things cleared up. Ok how about starting with the phone calls from Sean Ohara what have you done about this nasty little cuss. You rember Sean Hobbies include Being rude threatening little old handicapped ladies and cussing out there children I've asked you about him three times.

You rember Josie In Bristol Virginia The Victim Who started this particular post. The one Shea told to send back the product for a refund. Have you refunded Her Money.

Are you going to stop posting charges before the trial period is up.

Apologize no, sorry yes, sorry there are informed consumers, who are willing to spread the word Treehouse Marketing A.K.A. Thompson/Turkey

First of all I would have to appologize to the customers who trully and really feel that they were ripped off. I can understand how workers at TMG must feel when reading reports about the company that we work for and get upset because we really are not trying to scam anyone. And for the customers who feel this way I would like to try and explain as best as I can where we are coming from.

Now from what I read I know you guys know about the compliance tape. The taping is not only there to cover our backs but the customers as well. On that compliance tape everything, and I mean everything that is needed is explained. If we can't produce the tape then we have no choice but to issue a refund if the customer feels that he or she was mislead. We charge $9.95 for shipping through UPS and the other $9.95 is the price paid to try our products without paying full price upfront.

The customers have 37 days from our shipping date to try the product and get it back to us if not fully satisfied. We give the extra 7 days for our shipping. If for some reason it takes alot longer than 7 days to get to you we will go 30 days from the day you receive it. On our compliance script it says that if not returned within your trial you will be charged the $199.95 which is the actual cost of the 90 day supply that we send out, because it only takes a couple of weeks to see if the product works for you and give you some time to get it back.

Now I am sure that there are customers who trully feel mislead for one reason or the other and for that I am sorry, I am also sure that there are people that are just trying to get out of paying the bill because they forgot to return the product on time or for what ever reason. I know this because I work in customer service and I have caught many people in lies. Our customer service department will work with you if it is a reasonable complaint. If we know that we are in the right and have proof then we can't refund people just because they are mad. If we did we would be taken advantage of.

In conclusion, if there is anyone who understands what I am saying and still feels that they are entitled to a refund you are always welcome to call customer service and explain your situation. Again I apologize for any inconvenience that we may have caused and hope that we can get things cleared up.

You're comments out right discussed me, Im sure this is more to the truth of how people are responded to when they call you're Low life bottom Feeding Company, With a dispute. As far as Everyone Knows that Old People, I do not Know this about Elderly People and you're Ignorance exposes you're youth. However I do know about Treehouse Marketing, and Their Telemarketer's.
I know They continually avoid the issue, and each week there is another air head, running off at the mouth. There are 27 posted reports on this site alone given 1 rebuttal per, that would equal out to 54 different reports, on Treehouse Marketing. As far as holding up to you're end of the deal!

Based on BBB files, this company has an unsatisfactory record with the Bureau due to a pattern of complaints which show the company has charged consumers prior to their stated 30 day trial offer period; as well as for failure to provide promised refunds and for failure to deliver promised goods. In addition, the company has a pattern of not resolving complaints within the Bureau's time frame.

Another uncompassionate, immoral, unethical response from a TMG rep. Nobody's trying to rip you off, the customer was more than willing to return the product, so how are you being ripped off? How is the customer benefitting from returning an unused product in return for the money she didn't realize she was required to pay?

Reminding customers that you have them on tape rather than trying to settle their issues fairly and ethically must be the cornerstone of your training, because it seems to be the only response you can come up with (other than making distasteful remarks about the mental capacities of the elderly). Yes, we all know verbal contracts tend to be quite binding when they are recorded, how does this excuse your company's blatantly unethical behavior? The question of whether or not someone was ripped off is not always a legal issue, but it is always an ethical one. Legally your company is probably in the right. Ethically, however, your company has displayed a complete lack of morals, and the vitriolic rebuttals of its representatives have only confirmed the depth to which this organizational amorality extends.

My suggestion to further TMG reps who wish to make such rude and inhumane comments as the one above is this: for the good of the company that you so readily come to the defense of, keep your mouths shut on this one. Thus far you have only made yourselves look like a pack of wolves preying on the naive elderly. Stop trying to defend your company with spiteful retorts about "compliance tapes" before too many people get wise to the way your company operates. The informed consumer is the unethical business' worst enemy.

This is a response to the lady with the old mother, if she is that old then that is where the misunderstanding might be. Everyone knows that old peole forget fast, don't hear well, and not to mention a few other things. And if that is the case she shouldn't be ordering things on her own, like a child she should of had some assistance . It is not our fault that she is old.

All sales are tape recorded and that is binding. If you think that you could scam us out of money that is rightfully ours you are wrong. If you people don't know how to conduct business then that is your fault.I can't help but think that other companies had trouble conducting business with you. DO NOT ORDER WHAT YOU CAN'T AFFORD!!!!!!

Treehouse marketing missing the point

Every time I read a Rebuttal, From an Employee or Friend of Treehouse Marketing,
I feel My I.Q. drop at least 10 points!
They keep missing The issue. This isn't about Telemarketing or Telemarketers.

The issue is how Treehouse Marketing conducts business, Or allows others To do business for Them. (Rocky Mountain Collections)

And I Personally Make sure I tell at least one Person a day, Usually More via E-mails, About the practices of both of these Bottom feeders. A little common sense Tells anyone with Half a Brain If you're honest and sell a good product, People will buy it WITH OUT COMPLAINT. However if you deceive people and do not Stand up to you're agreement Then you end up on sites such as Ripoff Report.

Talk about being dramatic, and You're right Tim didn't Ignorantly Stereotype all Telemarketer, but you did, and don't flatter yourself there are Just as many if not more, Lawyers, Doctors And Bosses coming out of McDonald, Burger king and Pizzahut. The difference being they work instead of reading a Sales pitch written by a Promotions Expert And I would be willing to bet they sleep Very soundly at night. And never wonder if they scammed anyone.
Now I could care less about What the better business bureau has to say, There has to be lawsuits pending and people up in arms and basically, you have to be a complete scumbag of a company to get an unsatisfactory rating from them. But I will use this one time to my advantage Treehouse marketing now has an UNSATISFACTORY Rating, From the Utah Better Business bureau.

Collection agencies for a telemarketer if you worked for a legit company, you wouldn't need one. telemarketing is mostly one sale one time. Not baiting them then charging them a fortune later with unauthorized charges that's theft by deception there is a hell of a difference between $19.95 and $199.95 .

As far as not being able to tell who can and can't afford you're products, simply states you can't qualify a Buyer! That makes you a con artist. And its not Darlenes mother Who was taken by you're company it was Josies! Which takes me to my next point This is America and Our elderly need to be protected from slime ball Predators not taken off of checking accounts! its a shame, they grew up in a much more honest trusting time and companies prey upon them now! These people, the majority, Are full of wisdom and morals and tradition . And deserve respect. they do not need to be taken off of checking accounts. Scumbag companies like Thompson & TurKey/Treehouse Marketing Or what ever there calling Themselves this week, need to be shut down, prosecuted and Imprisoned.

More dramatic whining

First, let me point out that out of all the responses to this post from people involved with the organization in question, not one has offered any kind of advice as to what the victim might be able to do, or even offered any kind of apology for the treatment she has recieved. What you have done is concern yourself with correcting insignificant innacuracies and defended obviously unethical practices by TMG and the collections group. What does this say about your level of professionalism? I certainly hope that if some day these people become my doctors, lawyers, or bosses, that they pick up some ethics, professionalism, and self respect before doing so! By the way, in the future you may want to avoid making comments like that to people you know nothing about. If you knew who I was and what I do, you would recognize that most of that comment is absurd.

My beef, however, is not with the telemarketers, its with the industry they are a part of. The people doing the job are just trying to make a buck, and many of us have gotten wrapped up in crappy jobs before. Now that I know that the people performing this job are largely college students the siuation is a little clearer. Marketing companies that focus on recruiting college students do so because college students are much more likely to stick with a crappy job if they believe there is a potential (although usually there actually isn't) to make good money. People who have been around the block a few times recognize a crappy job when they see one, college kids are apt to think that ventures like door to door magazine sales are good career prospects. There are much better jobs out there guys, ones where people won't automatically think poorly of you when you tell them what you do (you might not believe me, but its the truth... people make huge judgements based on your occupation, maybe it's not good, but it's true).

Vicki, I've tried to figure it out, but I'm having a hard time discerning how you came to the conclusion that I was "whining" and being "dramatic." I was quoting actual statistics about the level of fraud in the telemarketing industry and pointing out how the company you are defending may not be acting with a solid ethical code, is this what you call whining? Well, sorry to say it, but I will continue to be a dramatic whiner, because I do have a sense of morality, and I don't like it when people are exploited, harassed, and threatened by rip-off artists. If you want to convince me that I am wrong (and I am not closed minded, I've reversed my opinion on companies reported here before) you will need to do more than engage in inaccurate personal attacks and repeat the part about the "compliance tape." I've been around the block enough to know that the reason there is a "compliance tape" is that these practices are on the fringes of legality and, unfortunately, our contract system is weak enought to allow the shadiest of practices with the slightest of verbal consent, as long as it's on tape. Let me ask you this, when offering people a reduced price trial period, do you give them the option of not automatically renewing the order? If you don't, it's because your company realizes that it will make a significant amount of money off people like the victim above, who aren't savvy enough to realize that they'll being taken for a ride if they don't pay close attention. I've said this many times and it never ceases to be true: quality products at reasonable prices are sold in stores, with straightforward pricing. Poor quality, overpriced products are sold door to door, over the phone, or via MLM with confusing or deceptive pricing. I look forward to hearing back on this, but I hope you guys can eiher offer the victim some decent advice or apologies, or show us why her treatment wasn't unethical.

Good thing you didn't ignorantly stereotype all telemarketers, I actually worked for TMG and know exactly what Clarissa's talking about. By the way, the phone calls ARE "wanted" every customer fills out an email generated by a separate lead company stating that if you want more information on these products give your state, phone number and email address and the best time to reach you. THEN, we call.

In response to "This practice of offering a cheap trial, and then automatically billing for the full package, is deceptive and reprehensible" AGAIN, the telemarketer tells the customer not only once during the presentation but a second time during compliance ON TAPE.

I hope Clarissa can sleep at night, she, like me, does her job and gets by. All those telemarketers are college students, that will eventually be YOUR lawyers, YOUR doctors, YOUR bosses. But hey, keep being dramatic Tim.

Do you hear that sound, Clarissa? That's me playing the world's tiniest violin for all the poor telemarketers out there who are victims of "fraudulent consumers." The National Center for White Collar Crime reports that Americans are defrauded to the tune of 40 billion (yes, billion with a b) dollars per year by telemarketers. That boils down to about a million dollars an hour, or 150 dollars per person that telemarketers rip off annually.

I can't really say whether or not what you are doing would actually be considered fraud. What I can say is that as far as professional ethics go, telemarketers rank right down there with bookies and personal injury attorneys. The whole premise of telemarketing is morally corrupt: make unsolicited, uninvited calls to unsuspecting people and do everything you can to get them to buy your product, regardless of whether or not they need or even want it, and with no concern as to whether or not they can actually afford it. What happens when you tell a telemarketer that you can't afford, or just don't want to pay so much for their product? They proceed to tell you how you actually can afford it, and maybe offer you a reduced price trial option.

This is what happened in this case: a lady who was probably just too nice to hang up or flat out say no was prodded into buying a product that she really didn't want, a product which she explicitly stated she did not want to spend hundreds of dollars on. This poor woman was under the impression (unfortunately she was mistaken) that if she wanted to order some more of this product she would have to call and ask for more. Lo and behold, even though she had explicitly stated her reservations about paying so much, probably because she realized she could not afford such a high price tag, she is billed for the full package. This practice of offering a cheap trial, and then automatically billing for the full package, is deceptive and reprehensible. Why should we feel sorry for the telemarketer, when he was aware that this woman could not afford the product, yet he deceptively pawned it off on her anyways? Just because something is legal doesn't make it right!

If you were offering a quality product at a reasonable price you wouldn't have to conduct your business this way. I think it's a good thing that Josie decscribed her mother's condition, maybe it'll help people like you put a face to the masses of people you scam every day. Though I would be horribly guilt ridden if my job involved decieving and scamming people, I hope you can sleep at night, Clarissa. And if you can't sleep at night, please don't call me at 1 A.M. and try to sell me some of your overpriced garbage.

I am an employee of TMG,and have never even heard of there being a collection agency for TMG-but it does please me to find out that there is one. Countless times we, telemarketers, call people and are given false information and just have to eat it.

Darlene, your mother was taped on a compliance script acknowledging and verifying not only the information (address, credit card) but the fact that if she does not sent it back 37 days from the day shipped, she will be charged the $199.95. Unfortunately it matters not that she's disabled, the sale takes place via phone we can't see who can and can't afford this product. Take your mother's name off the checking account.

I had hoped to hit a few sore spots with my comments. And past experience dealing with collection agencies have taught me these people are completely convinced of there superiority to every one around them. And before you comment as to dealings I was 20 Years old my 3 month old daughter had just been rushed to the hospital diagnosed with a pyloric stenosis 4 Months later and emergency surgery a collection agency called me and scared me to death telling me I was going to jail if I didn't pay $1400. By 3 that afternoon. For one of the many medical bills. I've learned a lot since then . About state laws and collection agencies.

Now that I've gotten you're response
you've read the report does Sean Ohara work for you? Are these acceptable ways of doing business. Cursing and Threatening elderly Ladies? What about Treehouse Marketing You've read the reports. I will give you the benefit of a doubt Maybe you were unaware of these goings on.

That is a link to verify that Rocky Mountain Collections, LLC is indeed a collection agency, and corporation registered in Utah. You should do some basic research on a subject before you go whining about how a collection agency isn't listed in the PHONE BOOK. They're not even required too, sheesh.

Rocky Mountain Collections can be found by checking the Division of Corporations listed in Utah. As a collection agency, the only one that we are required to inform of our bond information, is an attorney, or law enforcement officer.

Further more, Rocky Mountain Collections, is not Treehouse Marketing, they are an outside agency, and collecting per the terms that are set forth by Treehouse Marketing.

The reason Rocky Mountain Collections does not show up in the BBB is that Collection Agencies as a whole, do not subscribe to the BBB. The very nature of their business would make it impossible to do work.

All BBB complaints about Rocky Mountain Collections are wasted, make sure you make the complaints about Treehouse Marketing, and then something more can be done.

In regards to Rocky Mountain Collections, There is no listing in the Utah Orem Phone book for any such company. however in the state of Utah a collections company must have a $10,000 Dollar secured bond on file with the state to do business as.

Failure to do so is a Class A Misdemeanor punishable by up to one year in jail and a $1,500 Dollar fine. They must provide a bond number if requested. If they fail to do so report them to the consumer affairs department and the Utah attorney generals office.

They have no business making you an accessory to a crime. once reported any further contact would make it tampering with a witness a felony. This might not help solve everything but it should be enough to stop the phone calls. Surprisingly I was unable through my local contacts to find anyone who had ever heard of Tree House Marketing or Rocky Mountain Collections. They do not seem to do buisness in Utah I plan on driving by 740 N 530 E Just to see whats there. I feel it is important to let Treehouse marketing know you cant scam people and not have them showup at youre door.
