Tremont/Stature/University or whomever they are calling themselves this week,(they have numerous companies and LC's,LLC',LP's and DBA's) sold homes in Hyde Park Subdivison in Houston.
They knew these 44 homes had major defects especially to the roofs. These roof defects were causing water intrusion into the walls and attics of these homes. The builder knew some of the windows were installed upside down, and some of the plumming was not connnected properly.
Yet they denied, covered up, patched, delayed and tomented the homebuyers. They threatened that we would have to pay enormous legal fees, if we attempted to take them to court, threatened to sue us,and hid behind arbitration clauses.
They treated us as if our complaints were unfounded,we were stupid and gave ludicrous excuses. After 3 years, some houses had stood empty for over a year, some are uninhabitable, some owners had been forced into bankrupscy and foreclosure... unable to pay the enormous expense of repairs. Some oof the repairs over $100,000 dollars.
Many homeowners could not afford the unblievable costs associated with Arbitration, under the American Arbitration a*s.
We were offered free arbitration with the Better Business Bureau but the builder refused to participate and was subsequently thrown out of the BBB, They was also thrown out for hiding under different names to avoid responsibility.
The builder knew he could file, fast tract proceedures, in arbitration and get the homeowner in and out of arbitration... before they knew what was going on. The rulings would not follow the law, yet would be upheld by the court and there would be no recourse. We had no seventh amendment rights and some of us could not sue because they added arbitration cluses in the later sales.
The builders also knew that for a homeowner to file a counter claim, just filing fees and case managemnt fees would be $8500.00. So the builder continued on to destroy famiy after family. Some of these houses have been dumped on as many as 5 owners.
In Texas if houses go though foreclosure there is no disclosure of defects... Even if the walls are full of water and toxic mold is documented in the A/C units and duck work.
This company filed in Judge McCorkles' court 5th floor open records a suit against the roofer and subcontractors after he had sold all 44 of the homes. Stature VS Astec Roofers. Then in open court records testifies that the homes had roof defects, improper or no flashing, improperly sealed stucco, water intrusion and even a shower that had fallen out.
When one of their employees was questioned about ceilings falling in, he matter of factly stated this was typical on new homes.
These were homes that cost over $300,000. Most of us were seinior citizens or new young, working no children families. We have appeared before the city council we have gone to Austin we have gone to our represenatives, our senators the District attorney and the Attorney general. They tell us to go back to the TRCC.
The TRCC is a newly created buracracy bought by the builders. Represenative Coleman said, only in Texas can you buy your own state agency and regulate your self.
Many of us have paid ubelievable legal fees leading us down the rabbitt hole created by the builders to avoid any similance of moral behavior.
All State insurance says claims denied, substand constuction, and builder defects not covered.
My builder has been thrown out of the better business Bureau.
Fired building the bunkerhill Police station
Stole our homeowners dues
Created other defective properties all over Houston, including Tremont Towers, Knox Street, and Candlelight Estates.
Has numerous cases going on in AAA
Numerous cases against them in the courts
Have 52 civil cases listed in court records
Have unpaid judgements and leins
Continues to buid over 1000 houses in Houston.
It is one thing to be made homeless by an act of God, like Katrinia... but it is something entirely different to be made homeless.. by the unbridled greed of this renegade builder.
