US Airways is the worst airline.  They delayed my baggage and when I finally got them.  I was missing two scuba regulators that I spent a year saving up for.  Their answer to me was that it was TSA's fault.  Really.  Us Airways took custody of my bags and then rerouted the bags.  Then handed them to another company to deliver them from the airport which took 10 hours to go 45 minutes away.  I AM GOING TO KEEP SCREAMING UNTIL THEY TAKE RESPONSIBILITY !  I have just started a non-profit to help troubled kids and people with disabilities diving and now I am without my equipment.  My wife who has Lupus used her regulator to help relieve her symptoms for a little while.  She is having a tough summer because she hasn't been able to dive.  For $1100 USAirways could do the right thing.  Jarrod ,  St George, Utah

Yes you are upset that your regulators are gone..but saying that you will keep screaming until they take responsibility has you coming off like a toddler who says they will hold their breath until they get what they want.

Now, unfortunatly US Air is right.  When you check your bags they accept only a limited amount of liability.  This is all spelled out in the terms and conditions (Contract of Carriage) of the ticket you bought.  Trying to prove that THEY are responsible for any stolen items is next to impossible because of

a)They have no proof that you actually had those items in your bags,

b)They don't control the bag during the entire process.  Because as soon as you check it ALL bags to through TSA Screening.  Then once through screening some airports hire 3rd party contractors that actually route and load your luggage onto the airplane.  When it arrives at the destination..the same thing applies there may be another company that sends your bags to baggage claim.  This is not even mentioing if you had a transfer and you have yet another airport(or more) involved.

c) Their Terms limit their liability.  They are responsible if your bags are lost or damaged.  They do not generally cover "stolen" items mainly for the reasons above...oh and before you say that no other airline does this..EVERY airline has basically the same exclusion.

It is pretty much standard that any "valuable" item..and apparently one that is needed for a medical purpose should NOT be checked but carried in your Carry-On.    While I commend you for trying to start a Non-Profit, I am really at a loss how logical a SCUBA organization is with you living in the middle of the desert in Southern Utah.

If you really wanted to push it you could try filing a Police Report..but they are going to basically tell you the same thing and you may end up having to file a separate report in each of the cities that your bag went through.

If it is TSA, there should be a note inside your bag saying that TSA has inpsected your bag. My cousin came to visit me from outside of the country and he lost a gift which was supposed to be given to me. It was some kind of dried food, so I understood why they took it. But there was a notification of TSA inspection. Not every bag will have the notification after the TSA has inspected. However, I believe, every bag, which has inpsected and missing items, would have a notification.
