US BANK NA, US BANK HOME MORTGAGE, BANCORP, Did not credit payment, credit payments to another company, held payments for sixty days then return them to put us in default Owensboro Kentucky

In July 06 we began receiving paper work from Beverley a paralegal with McCalla,Raymer LLC stating that they represented our mortgage company Crescent Mortgage.They needed us to sign limited power of attorney over to them to convert it to real property, We have never paid a payment to this company, they sold our mortgage to US Bank before the first payment was due June 1, 2000. I tried to explain this to her and that I call our tax apprasial office and they confirmed that it was real property.

This went on for about six months, we would get a package in the front door with the same paper work. Around this same time we were informed by US Bank we were behind 3 months on our mortgage we had made Jan-Mays payment, missing Junes, and contacted them and worked out a repayment plan.

To this day we are now 6 months behind according to US Bank. In May 07 we filed bankruptcy to keep our home US BANK now claims we had not made a payment from Dec 06 - May 07.

On Nov 10, 2007 our home was destroyed by fire. I contacted US Bank to let them know of the fire. I was told then that they would be keeping the check from insurance company and it was a good idea if I shopped around for a different mortgage company. Our banktuptcy attorney filed a motion to substitute cash as colletral which judge approved on Jan 10,2008.

USBANK was mailed check for endorsement in March, On April 22, attorney filed motion for contempt. US BANK refuses to return check. There seems to be a problem with title or maybe note. I did a lein search and could only find Citifinacial listed.

We went to court and they tried to settle we said no. They then insulted us by offering us by their offer. The day before court they offered our attorney what he wanted.

We are not through with them, they have not credited us payments, they held payments and returned them sixty days later. They lied in their claim to the bankruptcy court and we have the proof.

We have filed complaints with the OCC & FTC. Its time they are stopped. There are hundreds of lawsuits against this company and thousands of complaints.
