After filing discrimination charges against Chase they immediately retaliated against me. A position paying 10% shift premium was supposed to be assigned according to seniority, my name was on the list of people wanting to be on that shift.  Two people with less seniority than me were given the position, management gave the reason that I was off work and they did not know when I would return.  The fact is I was on a pre-approved 4 day vacation and would be back to work before the end of Nov.09, my pay stub shows this.  The people that were chosen were e told not to mention they were offered the position. My supervisor randomly gave me 7 unexcused absences trying to get me fired.  I proved all of them were incorrect.  I was not given a $500.referral reward for the hiring of a new employee.  I was given the wrong training information then documented that I did not know my job. 

My phone was monitored constantly, unemployment compensation judge Katie Bowers said it was illegal to monitor me that much each day. I was given files to work on each month that were not collectable, resulting in my not receiving a bonus.  On 9/15/10 I had authorization from management to interview for a position with Chase in a different department, I clocked out and was in an interview for about 2 hrs.  During that time my calls automatically went to other phones the same as if I were on another line, when I returned I was accused of hanging up on a customer.  I let management know it was not me, I was in an interview..  I asked if I could hear the calls I was accused of disconnecting.  My AVP refused to let me listen.  The next day I was fired for hanging up on customers.  There are many more times, and examples given to EEOC proving that JPMorgan Chase Bank retaliated against me for filing discrimination charges, proof beyond a doubt that Chase retaliated against me, and I was wrongly fired from my position.   EEOC did absolutely nothing to help me with all the proof I gave they closed the file stating the information given does not establish violations of statutes. The EEOC will review your case and even if they find you were retaliated against they, themselves won't litigate the matter.  They will provide you with a, "right to sue" letter.  The only times the EEOC actually litigates claims are if the events are so egregious. There are employment lawyers who handle discrimination and retaliation claims.  The EEOC letter will state whether your case has standing.  Even if they find, in their investigation, that you don't have standing, you will still receive a form letter and can have a lawyer file a case from there.  An employment lawyer can better explain these nuances during your consultation.  Some lawyers in the Phoenix area do free consultations but not many.  These are not personal injury lawyers.  The fees can vary.  Some lawyers will take certain cases on a contingency basis but don't count on it.  You will be asked to fund all or part of your case on an hourly basis.  You will probably have to pay for 5 hours (or ten) up front.  Plus you will incur the costs of the case.  If your case is settled or litigated in your favor you will most likely recoup your lawyer and court costs. Your best plan is to find a lawyer, hire him/her for one hour and get his advice on how to proceed.  Understand that the legal system takes time and employment lawsuits can take up to 18 months to go to trial.  Most of the time, lawyers will try for a reasonable settlement way before you go to trial.   This is not something as simple as, "I was mistreated at work and they can't do that, so I will make them pay."  In the State of Arizona, your boss can fire you for just about anything.  They can't fire you if you belong to one of the protected classes (sex, religion, disability, etc.) but if they have evidence you are not doing your job (as in being rude to a client) then, yes, they can fire you. Actually, they can fire you even if they don't have evidence or even if they don't like you...unless they don't like you because you belong to one of the protected classes.    As far as being fired as a retaliation against making a claim of discrimination, no, they cannot fire you.  Of course you have to prove that you were fired for that reason.  Your lawyer will explain further.   I didn't understand what you said about a judge claiming that a company cannot monitor your phone calls for a certain amount of time in a day.  Companies do have the right to monitor computers and phones as it relates to business.  Now if they are monitoring you more than your co worker for some un-explained reason...that may be an issue, but without all the facts it's hard go into that in this forum.  Your lawyer can help you with that.  The only way to help yourself in this situation is not to rely on others.  The EEOC is not going to litigate for you.  You are going to have to hire someone to fight this.  If you truly feel you were fired in retaliation for pursuing your legal right to make a claim regarding discrimination, then call a lawyer.  Bring all the paperwork you have regarding claims to unemployment and the EEOC and bring a check.  It also helps if you bring someone with you so you can have a second set of ears listening to what you are being told.  A friend or relative can take notes and just be there for moral support.  Remember, the attorney is the expert here, not you.  Answer his questions simply and without emotional histrionics.  You need information and advice and since you will be paying for this advice it is not wise to take up an hour's consultation time with you lamenting about how unfair this all is.  Time is money.

The eeoc don't help anyone unless they are black the eeoc goes to bat for them making sure the white employer pays the price blacks get millions of course you're a bigot if you say anything

I'm no expert on the EEOC, but they probably know what they're doing.  Why did you file a report in the first place?  What did they do that you considered discrimination? 

I'm guessing that after you filed a discrimination report, you didn't suddenly become the happiest person in the world.  If you were so upset with the company that you filed a discrimination report, it most likely affected your work.  The employee in the corner with the rain cloud over their head is obviously going to be passed over for a promotion.  And if you were pissed off at your job, it most likely showed when speaking to customers.  Your only pointing out what you claim the company did to you, but it sounds like a story that can definitely have two sides.

JP Mmorgan Chase Bank is guilty of rertaliation

This report is against JPMorgan Chase regarding the retaliation against me for my filing dfiscrimination charges against them. There reasons given for my being fired were all lies and I gave EEOC documentation proving this over and over again yet they denied my case. There is no question Chase fired me illegally, kept me from getting the pay I deserved, retaliated against me, and trying to make my work environment miserable.  In reading my review it states this charge is only against eeoc and saying they are a mortgage conpany. United States Equal Employment Opportunity Comission is a government agency, and I am also re[prtomg them because they did nothing to help me, actually ignored my report.  I wanted to clarify this report stating this against both of them.  I have not herd anything from Ripoff Report, and I only have till Dec 8th. to do something or my case will be closed by the eeoc.  Is there anything else I can do to rectify this situation?
