As a victim of identity theft, I requested a validation of debt from this company when i saw their company on my credit report. They didn't respond to my request, but they DID retailiate by filing a lawsuit against me for filing a complaint against them with the Better Business Bureau and the Federal Trade Commission.

If the complaint made to the FTC and BBB constituted a malicious accusation rooted in falsehood or a reckless disregard for the truth, it could constitute defamation (slander/libel)

This is the only legal theory I could conceive of where they could file a complaint against the consumer.

I would love to see proof of this supposed filing, because I find it highly unlikely that it would be legal for them to sue you over your own credit report or your freedom to report fraudulent business.
