In December '05 I borrowed $340 from this company. They sent me one confirmation email to confirm my loan. I then started to pay them back 2 weeks later at $90 every Friday from my bank account.

After a few months probably February '06 I began to get suspicious as to how much I still owed them and why they hadn't sent me a statement or emailed me anything since I took out the loan. I am always very diligent and check my bank account online at least every other day to make sure I am not overextending myself and to see when things I buy or pay for are posted. As I said they never emailed me a statement of what I still owed, though I did have to original email that said it would be $90 every 2 weeks and it would be automatic renewel. Wel the thing is that I didn't really need or want to renew after the first time. I went on their website and emailed them with no reply, I even called the customer service # on their website and it was a big maze.

In february I tallied up how much they had taken from me so far and it was almost $600. In March I put a stop payment on them wtih my bank since I figured if they were not going to respond to me then I was not going to continue to give them my money. I put the stop payment on a Wednesday and that same Friday my very smart bank Wells Fargo, still authorized the ACH debit of $90 plus United Cash Loans also took and additional $50 for a total of $140 in one day. Well of course I caused a stink at my bank since I put a stop payment on them and they still paid them. My bank recognized their error and promptly credited my account for the $90 but not the $50.

Then 1 1/2 weeks later on a Thursday I got my paycheck and went into my bank to close my account and open a new one so they couldn't get anymore of my money, my personal banker suggested this. So I arranged for her to close my checking account the next day and open me a new one ( I still had a payment pending on my account). Well..... that same day United Cash Loans decided it would me a good idea to present a paper check to my bank for $415. Well you guessed it Wells Fargo cashed it even though there was a 3 week paper trail of me complaining about this company and not to give them any of my money.

I found out about this check on Saturday morning when i checked my account online (diligence!). Friday is when I saw that I only had $8 in my account.

The check they produced to my bank for deposit was fraudulent in every way imaginable. It was printed off of their computer and said on the signature line that "Signature Not Required" and on the memo line said "Telephone/Fax autorization obtained 3/14/06" As I said before I had not been able to get in contact with anyone there! I also do not have a fax machine and my # they had on file was not in service on that that or that week for that matter.

I promptly called the Police and made a report about this and then went to my bank that same day. What they did was called a "Demand Draft" and it is in the process of being made illegal by almost all 50 state Attorney Generals. They commited a Federal Crime by conjuring up a check without my autorization and presenting it for payment. So I submitted a fraud report through my bank that very day. My bank made a huge error by honoring the check from the company and the company commited a crime. They bold faced lied on a legal document (the check)by saying I autorized it (which i would love for them to take me to court to prove) and profitting from bank robbery.

They cannot do this!!!! I doubt I will see any money coming from them for all this over payment but the fact that I can prove they commited a crime is a very good start. I do not know if they will be able to harrass me because of this because my bank did withdraw the money that they gave them and credit me back. That account is now closed by the way.

I wanted to know if anyone else has ever experienced this with this company or any other? And what are my legal grounds to sue them? Also can they still come after me for any payment or not? I have given them about $1000 since January '06 for a $340 loan.

PARAGON VICTIM

AUTHOR: Mimi - (U.S.A.)

I took a loan out with fsm/paragon 4months ago. i paid it of or thought it was paid for in two payments. i never got a letter or a confirming that the loan was paid in full. well 2 weeks ago while i was on vacation my boss informed me that i had numerous phone call and when i checked my voicemail and all 20 messages ( i was only out 4 days )were from a man named andrew flintoff who claimed to be with united federal prossesing deparment.... while reading this ...my phone rang and it was Andrew.

The conversation began with hhim asking me if i had ever been picked up for fradulent activity. i then asked him who he was and who he worked for and did not answer his question.. he then said he was with united federal department of investigations...( on the voicemails it was united federal processing department) he said he had just received my case file and started readind some stuff off i could not understand a word he said because he was talkin to fast and his accent was to strong.

i then interrupeted him and asked him to speak slower. he then said that paragon his client has pressed charges against me for the balance of 575.( the loan was 150) i asked him in order for me to continue this conversation i would need a paper case file or somethin stating all these charges.

he then said he would have an officer come and arrest me or take away my kid cause i refused to pay...he gave me the case file number and the arresting officers last name and hung up...well i then proceeded and called the police department and informed them of my conversation with this man. they advised me to press harrasment charges against him because he mentioned my child.

i then called him at the number he gave me which was a new jersey number and i live in las vegas. someone else picked up. i asked him for his rep number( all call centers give employeed id number so that thy can be identified instead of them usin there last name) he said he couldnt give it to me i then asked him for his companies name. he said federal bank department ...hmmm...different name i then asked him to explain the charges he said that he couldnt because. it was late...hmmm fishy.

i asked him to let me speak to a supervisor. he said he was the supervisor. ihe then started telling me that i was a criminal and his buddies in the background were sayin hang up on her she can be sued. professional huh for a gov company. lol. he then said that an officer was goin to pick up my kid and i told him next call they get would be from a police officer.

well to make a long story short tehy have harrased me threaten me my child. i was wonderin if someone new if i could possible sue them or how do i go about it i can show that the money was taken out of my account and the loan was paid.....can someone advise thanks

FSM?Paragon Same Company

AUTHOR: Ann - (U.S.A.)

I did business with FSM and the first time I just called them and had the full about debited from my checking in order to pay the loan off. The second time is when the problem started, I closed my bank account due to my personal information being comprised through another creditor. I mailed certified letters to everyone involved and never heard back from FSM and Paragon which are the same company and I had two small loans out, one with each. This is when the problems started they immediately turned me into some place called Pre Litigation which claims to have the right to file fraud charges against you if you close the account and the balance is paid off. Well they wanted all of this money sent to a money gram account by 5, plus they called me several times at work leaving me harrasing messages, called my coworkers asking them if they could identify me, called me a liar and demanded the money or else charges would be filed. I called the original lender and was given the number to 1st Credit of America who took payment arrangements for both loans combined, Ms. Wells assisted me and assured me that two people can't collect on the same debt and not to worry about what Pre Litigation was saying.... I continued to be harrassed at work until my boss got involved and put a stop to it, needless to say I was concerned about who I was really paying and who was really in charge of the account. I sent my paper work to FSM/Paragon with payment arrangement letter that 1st Credit sent me and one of the companies finally emailed me to say that they withdrew the paper work from Pre Litigation once I informed them that two people could not collect on the same debt.... I have called 1st Credit of America back to confirm my second payment to them and ask that a confirmation letter be sent to me regarding the 1st payment along with the arrangements since I received a letter in the mail that was different from the fax that I was sent regarding the payment arrangements.... Guess What Ms. Wells is no longer at 1st Credit so they say all in a matter of three weeks.... I turned all of my information over to the Attorney General in Florida where Pre Litigation claims to be as well as in my state. I received a call today from the ATG in Florida and she said that they really couldn't get involved unless they had several complaints before investigating, so if you should here from Pre Litigation regarding your FSM loan be sure and get as much information from them, which they would not give me an address and they changed their names on the phone call with my boss like three times. So just be ware and expect them to call you with threats, turn them into the Attorney General and whoever else that you can think of..... The only way to stop them is with our complaints, but that is a very strange story and to come to think of it they didn't require a signature from me and I never signed documents so make sure and ask them to provide you with documentation of the loan and confirm who you are really paying because the Attorney General agreed that this was very strange and she didn't have any information on the company trying to collect from me either.

ANY LUCK

AUTHOR: Jeffrey - (U.S.A.)

I am running into the same problem contacting this company to pay off my loan. I contacted a phone listed in a previous complant which was for their collections department. However since I was not in collections they showed no loan and refused to give me a number to contact to pay off my loan. Any suggestions?
