OK, check this out. United Yachts Sales is tired of Robert's games. In order to help clear their name, they've posted the Florida Department of Business and Professional Regulations (DBPR) report on this issue. Very interesting to see what they had to say. Bottom line is, the boat was seized by Ocean Key House for back dockage and auctioned off. The dock agreement conveyed to Robert when he purchased the dive business from Fred Gatchell allowed them to do just that.

I have been following this post now for several months and decided to look into this matter due to there being so much inconsistincies in these story's. I called the Department of Business and Professional Regulation (DBPR) to verify if they even did an investigation into this auctioneer and they confirmed yes. I was then told the investigation was finished on their end and it was in Monroe County at the State Attorney's office.
I called the State Attorney's office in Monroe County Florida and quickly learned the case from this DBPR is there and being reviewed. I also asked If the e-mail I had sen online recently was true and was the file going to a prosecutor? The answer was yes. I also looked into the state statute reguarding auctioneers in Florida and called a few auctioneers to get their input into this matter. The auctioneers said yes there is an exemtion for atorneys where they do not need a license IF the person hiring them owns the property.
I cannot say who owns the peoperty myself but have read e-mail form the Department of Highway,Safety and Motor vehicles where them confirm under statute 328.17 that taking a yacht and bringing it back to your possession is theft, they even go on to say in the e-mail that if the vessel has left a marina's possession you then have a civil matter for the courts to dcide.

As of yesterday over 500 have read my blog. Many of you have e mailed some brokers in the industry. As i have said to everyone my goal is not to destroy united yachts but make everyone aware of my story and what was done to my family. United yachts peter schmidt can end this anytime and continues to want to drag this out. The letter above from the United Yacht Sales broker clearly confirms the lies and false statements they are making to customers. The U.S Coast Guard doesn't get involved in giving titles to vessels just because someone claims they owe money. In this case it was the opposite, and the Coast Guard quickly got involved confirming this was illegal. This broker tried to file suit against you to silence you which hasnt worked. I saw where over 6,000 visitors have already visited your soul cast united yachts web blog. Anyone that has read or researched any of these lies told by the yacht broker definately wouldn"t do business with them on any day. This clearly shows how desperate people get when caught in lies and have no where to go. I have read and followed this story and feel you have proven above and beyond a reasonable doubt, these people not only broke the law, but have lied on many occasions.

Thanks for the heads up. If this is the same character from Ohio, he had a boat with an enormous amount of back storage due. Apparently, the boat yard tried repeatedly to contact the owner including with registered mail. Then the Coast Guard stepped in and authorized an auction with the proceedes going to the yard to clear up the sale. I am told that the United Broker involved represented a buyer and received a commission for his efforts. The former owner was sore about it and started to slander the broker and United Yacht Sales in every web site he could. United Yacht has been exonerated and he was removed from most of the sites. Our guess is that he has started up again and may be using a new email address.
At any rate, I sure appreciate your input and will forward your links to our office in Stuart Florida. Meanwhile, I will try to find the information from our earlier confrontation with this guy and will send it along to you for your reading.

I have a small boat (gotta win the Lotto to have a yacht.) and if I owe dockage fees (I pay for a slip) and I move my boat, by WHAT RIGHT can the previous marina come take my boat, return it to the marina, and chain it up? In NY that is grand theft! Seems to me that the marina that was owed could have simply gone to court and had a lien put against the yacht. That would have lawfully prevented any sale of the yacht untill the matter was settled.
Did the marina get a court order or lien against the yacht? It doesn't seem they did based on the owner rebuttal. So why not???
If I had heard a rumor that the previous marina was going to auction my boat, I would have done the following:
Criminal complaint with law enforcement in the jurisdiction where the marina is located.
Considering the value of the yacht I propably would have flown down there to personnally see what's going on and to spur law enforcement into action for stealing my yacht.""

I don't work for ANYONE. Can you say self-employed computer consultant?
I wouldn't know about Florida law (first hand) because I don't live in Florida, I'm in Buffalo, NY Also, I don't know you or Schmidt.
As to your comments about 20 days to respond, I assume that's 20 days AFTER YOU HAVE BEEN SERVED. From your own blatherings and those of Schmidt, it appears that you haven't been served.
I've warned you that you cannot avoid a judgment against you by dodging service, and that is true. No court is going to let that continue indefinitely. Sooner or later you will either have to respond to the lawsuit against you, or Schmidt will be awarded an ex parte judgment against you.
Now we see that you have filed a couple of lawsuits in Monroe County. In a previous blathering about this Schmidt claims he can't find out where you live to have you served. All Schmidt has to do now is contact the clerk of the court of Monroe County to determine the address you claimed as your residence.

As to your comments about 20 days to respond, I assume that's 20 days AFTER YOU HAVE BEEN SERVED. From your own blatherings and those of Schmidt, it appears that you haven't been served.
I've warned you that you cannot avoid a judgment against you by dodging service, and that is true. No court is going to let that continue indefinitely. Sooner or later you will either have to respond to the lawsuit against you, or Schmidt will be awarded an ex parte judgment against you.
Now we see that you have filed a couple of lawsuits in Monroe County. In a previous blathering about this Schmidt claims he can't find out where you live to have you served. All Schmidt has to do now is contact the clerk of the court of Monroe County to determine the address you claimed as your residence.

Readers, (if there are any, except Robert) I have never written on any blog under any other name. Robert does it on a daily basis, pretending he's other people. Sometimes its so obvious, it's hard to believe he's serious.
Imagine for a minute someone accuses you of a number of crimes. He then goes to several government agencies and authorities and they tell him that there was no wrong doing, only that he caused his own problems. No agency believes him or his claims. No charges have ever been brought, even after Robert pressing them over and over again. This includes the local police, the state police, the state attorney general, a federal court, the DPBR, various bonding companies to name just a few. Yet that someone (Robert) keeps blasting you on the internet claiming every crime imaginable. Hundreds of blogs. He even contends that many people agree with him. He claims other yacht brokers agree, when no broker has ever said that United Yacht Sales did anyting wrong. They were asked hypothetical questions by Robert that never resembled the actual facts. Here's an example of Robert's questioning technique.
Quote 'Thank you for your call and the heads-up about this situation. Obviously, this person completely misrepresented himself and the context of the situation. He has twisted what I said below to his end. In a transaction such as you described to me where the boat was sold at auction to a buyer without brokerage involvment in handling the money, there would have been no requirement to run it through an escrow account.
I have copied this man with this e-mail and by this he is informed to cease and desist mis-quoting or misrepresenting my communication with him.'

Any broker that knows the facts knows that United Yacht Sales did nothing wrong. The DPBR, the regulatory agency which oversees yacht brokers in Florida, did an intensive investigation at Robert's request and has publically proclaimed that United did nothing wrong, nothing unethical, nothing illegal. They found there was no basis for any of Robert Krutko's claims. Case # 2007 03 8311. The Florida Yacht Brokers Association in it's most recent newsletter confirms the DPBR findings.
Robert also claims that the state agrees that his boat was stolen. The State of Florida and no one has ever agreed that Robert's boat stolen. He quotes Dee Dee Holley, who knows nothing about admiralty law.

Anyone interested, call her and ask her if Robert forgot to mention that his boat already had a mechanics lien placed on it and that Robert had the boat removed from the marina in the middle of the night. There are a number of State and local law enforcement agencies that know about this situation and no one that knows the facts has agreed that the boat was ever stolen. In fact a Federal court finally ruled that the marina had every right to seize the boat, hold it for collateral and eventually auction it off.
Robert is making a concerted effort to ruin our reputation by slander and libel. Would any reasonable person sit by and let this happen? Robert never stops; he just keeps making his unsubstaniated claims on the internet blogs (his Kangaroo court). His claims and statements are vile and disgusting.
Yes, indeed, we have now filed a libel suit and now Robert is hiding for the server, trying to avoid his day in court.
I hope that anyone reading this blog researches the whole thing. Google ' Robert Krutko' This is one of the worst cases of libel that anyone has seen in a long time.

Hey Robert, why are you hiding from the civil process server? You started this whole complaint and continue to slander this company on several websites. If everything you said was true, why are you avoiding the courtroom?

Robert is so far out there that he now claims I am lying about filing a suit against him. He knows we have filed a suit. He's hiding from the server and when confronted once by the server he claimed he was the son and hadn't seen his father in years. Robert doesn't have a son and we know exactly where he is; hiding in his hotel room avoiding the precessor. We (United Yacht Sales) have sued Robert Krutko for defamation and libel. He has posted several times that we didn't dare sue him, as the truth would come out and we would be embarrased. Quite the contrary, we would love the truth to come out on the Internet, as it has through thorough investigations by a number of authorities. Now Robert can have his day in court, where this belongs. If Robert is so convinced we wronged him and that we did unethical and illegal things, its now time for him to stand in front of a court.
We know he won't win and we suspect he will never show up. Robert is presently hiding from the process server in Columus Ohio. He is staying in a hotel and avoiding being served. He will not tell us what room he is in and the hotel's policy is not to give out that kind of information. The server encountered Robert once and Robert claimed he was the son. There is no son. Robert calls our office quite often and harasses our employees with obscene phone calls. We are keeping a log of all the calls and their disgusting content.

On Jan 29, Robert wrote that we did not have the courage to file a suit against him. Well, we have filed a suit against him, but we can not get him served because he is hiding from the server. The server did confront Robert once, but he claimed to be Robert's son. He doesn't have a son and fooled the server. Robert has been avoiding the server ever since.
Robert, if you are so sure that you've been wronged by United Yacht Sales, we're giving you the opportunity to prove it in court. Do the right thing and put this issue in front of a court of law, not in your kangaroo internet court.

It is clear United Yachts /Peter Schmidt screw their own customers. These people are liars/crooks/law breakers. Clearly, no one believes the turdburglar but himself and his alias false postings. Many have watched the evolution of his tales of inconsistancies. I saw his scam in the very first thread of his that I read. What ever happened to the poor people who you allegedly sold the boat to and it broke down 20 minutes later? You tried - and succeeded so far to the tune of $20,000 - to screw someone out of $100,000 for a broken down boat.

When looking at this web site you will see email confirmations from state agencies who confirm they broke the law..
You will see e mails from fellow brokers throughout florida confirming what they did was illegal...
you will see nobody as far as board members with the f.y.b.a. have put their signature along with the signature of the f.y.b.a. saying schmidt didnt break the law.
Why? its simle most board mebers of the f.y.b.a. are yacht brokerage owners who know schmidt broke the law but choose to ignore it. If he didnt break the law or misrepresent his fellow f.y.b.a. board members would say this and put their and the organizations reputation on the line and they havent yet( i personally would love to see them do it)
which brings us to another good point... the f.y.b.a. clearly states in its by laws its there to protect te public from just this sort of incident,isnt it funny they havent even done a FULL investigation Into this?

Its a scumbag like schmidt who knew 3 months before our yacht was stolen because his company had the listing agreement to sell it. He then went behind our backs with the thieves to represent a buyer who bought the yacht. oh yes the coast guard documentation center wouldnt allow the transfer of sale because they had no court order to do so..

United Yacht Sales has come under repeated attacks on the Internet for the past several months by Robert of Columbus Ohio. Robert initially called for several investigations by different government agencies to investigate United Yacht Sales, Peter Schmidt ( CEO ), several brokers, a hotel/marina and an attorney representing the marina. Robert owned a dive boat in Key West, which was seized by the marina for past due dockage of tens of thousands of dollars and it was then auctioned off to the highest bidder. Without exception all investigations have cleared United Yacht Sales and all the parties of any wrongdoing and all claims by Robert have been determined to be baseless.
Robert continues to attack all the parties, making false accusations of fraud, illegal acts, scamming, lying and worse. Robert has spun a story that it is utterly unbelievable. Anyone who takes the time to investigate will come to that conclusion. The problem is that there are powerful web sites that will print just about anything. These sites are powerful enough to work their way up in the search engines like google, so that they are very much up front and center. Even worse is the fact they contain very derogatory headlines, so the casual reader simply sees a headline, which makes for a very bad first impression. Even if the reader choices to read the entire blog, there is no control of the content. If we respond to the accusations, it simply makes the blog stronger.
One may wonder why we don't simply sue Robert for liable and get a court order to make Robert stop posting on these web sites. It's not that simple. Yes we can sue for libel, but the courts take time and it's expensive. We have no doubt we will win. It is very clear that Robert has committed liable and is intentionally defaming United Yacht Sales and other parties with a vengeance.
Six months ago we were advised to do little or nothing and the problem would eventually go away, but it has not and Robert is still busy trying to ruin our business and several other people's lives. Given the current situation we have decided to go on the offensive and create this web site so readers have a chance to understand why they may see webs that are derogatory about United Yacht Sales.
For those who want to know the story, here it is. Robert and his wife bought a dive boat and the business in Key West. Robert had no experience in the business and it did not go well. He eventually ran up a huge dockage bill that he refused to pay. In the mean time he listed the boat for sale with one of United Yacht's local brokers in the Keys. Time passed and the boat did not sell. Finally and coincidently just as the boat was being seized by the marina, United found someone interested in buying the boat, but now the boat was literally chained to the dock. Upon further investigation our broker was directed to the marina's attorney, who told our broker the boat had in fact been seized for significant back dockage and was to be auctioned off within a couple of days to the highest bidder. Brokers were not invited to participate and no commissions would be paid. Our broker contacted the potential buyer explaining what had happened. The potential buyer contacted the attorney to verify the situation. The buyer then hired the broker to represent him at the auction and agreed to pay the broker to represent him, if he won the bid. He did win the bid and he paid the marina and the broker his fee. Robert has claimed that United commingled escrow funds but it has been determined we did not, as we did not represent the seller, never had any escrow funds and in fact the broker was paid the fee directly by the buyer. United Yacht Sales, per say, was never even involved in the auction and never received any money during this transaction. We gave the broker permission and our blessing to represent the buyer and to be paid directly by the buyer.
Time passed and Robert apparently was making all sorts of accusations, including that the marina had stolen his boat. In fact it was later determined that the marina did not steal the boat. Robert had someone take the boat out of the marina and hide it. The marina recovered it and as was later determined had every right to auction off the boat. No agency or authority has charged the marina with theft and a federal court gave the marina permission to auction off the boat a second time. Robert made so many false accusations that the marina gave the money back to the buyer and all hell broke loose.
Robert called United Yacht Sales (Peter Schmidt CEO) and demanded that United Yacht turn in the broker's license for a number of reasons, none of which have been determined to be valid. This was the first time United knew that there was a problem of any sort. United refused to simply ruin the broker's life and turn his license into the state. From that point on Robert's has been relentless in attacking United Yacht Sales on the Internet. Robert has never hired an attorney to sue for damages, as he knows he would loose. He simply uses the Internet to spin his story the way he wants to, without regard to the truth or the findings of the investigations he called for.
When the Florida Department of Business and Professional regulation investigated United Yacht and came back with a very lengthy and compete report that exonerated United Yacht totally, Robert simply claims that the agency is a friend of United and that they were biased in their investigation. When the Florida Yacht Brokers association did not censure United Yacht he claims they are also in the bag. Robert claims the State's attorney generals office is also corrupt for not pressing charges. It goes on and on and on. Robert has set up his own web sites using unitedyachtsales .net to spew his venom. He has set up similar web sites using the attorney's name involved in the auction, also one in the broker's name. His intent is to ruin the businesses and people involved in his problem. In these blogs he makes outrageous claims and then continually answers himself building his case of false statements. He makes claims that are totally unfounded, thinking that no one will do anything.

Rather than pay the bill or attempt to negotiate something with the marina that would have eventually satisfied them, Krutko attempted to totally ignore the situation and take his boat and hide it. When the proverbial hit the fan, Robert came out with all guns blasting, trying to take out everyone involved. He has lost the business and lost the boat and now continues to attempt to take everyone down through the Internet, which is free and in some ways like the Wild West. We wouldn't wish this type of attack on anyone. It's very frustrating, very serious and has caused us to loose a lot of potential business, as well as a lot of sleep.

United Yacht Sales has come under repeated attacks on the Internet for the past several months by Robert of Columbus Ohio. Robert initially called for several investigations by different government agencies to investigate United Yacht Sales, Peter Schmidt ( CEO ), several brokers, a hotel/marina and an attorney representing the marina. Robert owned a dive boat in Key West, which was seized by the marina for past due dockage of tens of thousands of dollars and it was then auctioned off to the highest bidder. Without exception all investigations have cleared United Yacht Sales and all the parties of any wrongdoing and all claims by Robert have been determined to be baseless.
Robert continues to attack all the parties, making false accusations of fraud, illegal acts, scamming, lying and worse. Robert has spun a story that it is utterly unbelievable. Anyone who takes the time to investigate will come to that conclusion. The problem is that there are powerful web sites that will print just about anything. These sites are powerful enough to work their way up in the search engines like google, so that they are very much up front and center. Even worse is the fact they contain very derogatory headlines, so the casual reader simply sees a headline, which makes for a very bad first impression. Even if the reader choices to read the entire blog, there is no control of the content. If we respond to the accusations, it simply makes the blog stronger.
One may wonder why we don't simply sue Robert for liable and get a court order to make Robert stop posting on these web sites. It's not that simple. Yes we can sue for libel, but the courts take time and it's expensive. We have no doubt we will win. It is very clear that Robert has committed liable and is intentionally defaming United Yacht Sales and other parties with a vengeance.

Given the current situation we have decided to go on the offensive and create this web site so readers have a chance to understand why they may see webs that are derogatory about United Yacht Sales.

Finally and coincidently just as the boat was being seized by the marina, United found someone interested in buying the boat, but now the boat was literally chained to the dock. Upon further investigation our broker was directed to the marina's attorney, who told our broker the boat had in fact been seized for significant back dockage and was to be auctioned off within a couple of days to the highest bidder. Brokers were not invited to participate and no commissions would be paid. Our broker contacted the potential buyer explaining what had happened. The potential buyer contacted the attorney to verify the situation. The buyer then hired the broker to represent him at the auction and agreed to pay the broker to represent him, if he won the bid. He did win the bid and he paid the marina and the broker his fee. Robert has claimed that United commingled escrow funds but it has been determined we did not, as we did not represent the seller, never had any escrow funds and in fact the broker was paid the fee directly by the buyer. United Yacht Sales, per say, was never even involved in the auction and never received any money during this transaction. We gave the broker permission and our blessing to represent the buyer and to be paid directly by the buyer.
Time passed and Robert apparently was making all sorts of accusations, including that the marina had stolen his boat. In fact it was later determined that the marina did not steal the boat. Robert had someone take the boat out of the marina and hide it. The marina recovered it and as was later determined had every right to auction off the boat. No agency or authority has charged the marina with theft and a federal court gave the marina permission to auction off the boat a second time. Robert made so many false accusations that the marina gave the money back to the buyer and all hell broke loose.
Robert called United Yacht Sales (Peter Schmidt CEO) and demanded that United Yacht turn in the broker's license for a number of reasons, none of which have been determined to be valid. This was the first time United knew that there was a problem of any sort. United refused to simply ruin the broker's life and turn his license into the state. From that point on Robert's has been relentless in attacking United Yacht Sales on the Internet. Robert has never hired an attorney to sue for damages, as he knows he would loose. When the Florida Department of Business and Professional regulation investigated United Yacht and came back with a very lengthy and compete report that exonerated United Yacht totally, Robert simply claims that the agency is a friend of United and that they were biased in their investigation. When the Florida Yacht Brokers association did not censure United Yacht he claims they are also in the bag. Robert claims the State's attorney generals office is also corrupt for not pressing charges. It goes on and on and on. Robert has set up his own web sites using unitedyachtsales .net to spew his venom. He has set up similar web sites using the attorney's name involved in the auction, also one in the broker's name. His intent is to ruin the businesses and people involved in his problem. In these blogs he makes outrageous claims and then continually answers himself building his case of false statements. He makes claims that are totally unfounded, thinking that no one will do anything.
