I went to their website and put in my information for the loan and my pre-approved invitation was denied! How can they send me a pre-approved offer then deny it? Doesn't that mean it really was not pre-approved! Which means they lied in their letter to me! This clearly demonstrates that the US FCRA rules were clearly not abided by.
Of course, when I tried to reach Mr. Christopher @ VISA I was told that he was much to busy to speak with me which is why his contact information is not included in the letter. My only recourse was to send a letter to Customer Service... why would I do that when I know it would just be ignored.
Is the credit critical to me - NO. I only applied because I am trying to reestablish my creditworthiness even if it means I have to accept a 23.90% rate. Am I angry about the fact that after making the agonizing choice to file for BK in an effort to "right my ship" and spending the Thousands of $$$ necessary to do so, that an "application" for credit which was denied will now be added to my credit reports and thereafter used as evidence of my supposed irresponsibilty - Hell Yes!!!
Companies should not be able to make blatant deceptively false offers and should be ashamed of themselves for doing so!
Shame on you VISA / Capitol One Bank!!!

Corrupt Congress changed the FCRA in 2003 so that you can't sue for this violation anymore

You used to be able to sue for these violations, but in the 2003 Fact Act CORRUPT Congress chose to allow the industry to bombard consumers with fake and false offers by removing the right to sue for violations by private parties.
Only the CORRUPT regulators can enforce this provision of the FCRA now and of course they do NOT enforce anything.
Since 2004 I've documented how both federal and state governments ignored my complaints about false mortgage advertising.
This FCRA change and the regulators' decision to ignore complaints were part of the master plan to redistribute wealth from the working people to the elite.
I'm sure everybody agrees that it worked beautifully, as evidenced by record foreclosures and the credit crisis.
Since the government completely sold out to the bankers, our only recourse is to STOP paying the banks. Google "Wamu 26% interest" and you can't miss my open letter to Washington Mutual.
Now is the time to get a clue and ACT accordingly.

Interestingly, I put this up because I wanted to put a little light on a disgraceful practice. Instead of an apology from the bank or a groudswell of support from my fellow man (which is what I was hoping for) I'm getting criticized by people who appear, by there very responses, to have little or no concept about either the nature or importance of credit in our society.
If you don't have anything intelligent or constructive to say please spew your venom somewhere else, were all full up here ;)
ps.......This is not a rip off, this was actually the best thing that could have happened to you and "pre-approval" does not mean you qualify!
Geshhhhhh......I am still in shock over this one!

Since you declared Bankruptcy I am actually surprised you have not received more of these letters. You are "fresh meat" to the sub-prime market, because they know you can't declare BK again for several years. So that one will not be the last "Pre-Approved" letter you will receive. If you want to stop receiving these notices you can by going to http://www.optoutprescreen.com which is the government mandated site to remove yourself from these lists.
Just an addition to what Cory said. A Chapter 7 BK will remain on your credit report for 10 years(not 7). Also, the credit report only lists the inquiry it does not record if you were approved or denied. So as long as you don't go applying for several credit cards in a short period the effect is minimal.
