I wish to register a complaint against the management of this facility. I had applied for an apartment even before the completion of the apartments; at the end of June 2012, I was called offering me the apartment. At that time I paid a $500.00 deposit plus the monthly rent; I was specifically told by the then manager (a black lady who spoke Spanish) that the lease would be for one year and afterwards the lease would go on a monthly basis. 

When the lease year was up, the management had changed; I was informed by the present manager that I had been randomly selected to go through another audit to see if I qualified to be a resident, (this seemed odd to me, specially when I had a perfect paying record).  I submitted all the required documents and waited for the results.  I was never officially notified, nor I heard anything; a couple of months later I asked and the manager told me everything was ok. 

I recently bought a double wide trailer and decided to move, since I was going by the word of the former manager, and even the actual manager told me I had to have a walk through inspection to determine if I would get my deposit back.  The day I turned in the keys, the apartment was clean and it passed inspection with the maintenance person; that is when I was told by the manager that I was breaking the lease and that I would not be getting my deposit back.  When I asked what did she based her allegation on?  She showed me a lease where I supposedly chose that option. I did not remember signing that particular lease, so I asked her to show me the signature; that is when I noticed the signature was forged.  In other words the second lease, the so called audit, the never notifying me of the results seems to be a major blunder or scam.

I cannot believe this company makes it a practice to illegally retain monies from senior citizens that live on fixed budgets.  I expect to get my deposit back ASAP or I will go public with this complaint and expose the fraudulent practices that are going on in this company.  I already saw major complaints filed against the company in the Internet; I will do likewise, plus I will use every avenue at my disposal to expose the abuse being perpetrated by your company against senior citizens.  I expect to hear from you soon to resolve this matter.

If the signature is forged take them to small claims court

Send a letter to the management company via return receipt request demanding your security deposit back. In fact, the management company is obligated to send you a letter outlining why your deposit is not being refunded. they have to send you that letter within 30 days if they are retaining the deposit and an itemized list of why they are retaining it. Or they have 15 days, in Florida, to return the deposit without deduction from the time you vacate the property. Make sure to notify the Landlord in accordance with your lease.

If they do not send you the letter and do not respond to your letter, then take the landlord to small claims court to get a refund of your deposit + damages and filing fees.
