His excuse is he's not getting your email or it takes a long time to send your refund back, or maybe he's got a different excuse now because he's been singing the same old tune from way back.
He thinks people will believe him and will not bother to complain about it since they'll just lose a $100 (actually more than that but since we agreed to pay for the $25 initial access fee and $45 monthly subscription, we can't cry scam even if we feel that it is). But the clear scam is when he doesn't return the promised refundable $100.
He's very clever in scamming people with his well-knit proposal letter from the mail, but his excuses for not paying back the promised refund is so stupid. Beware of this guy and his website, he is a true blue scam artist who has only one thing in mind - to rip you off.
