Just recently for fathers day, my wife and I decided to spend a little money and do some irregular spending we made a lot of small charges knowing that we had enough money in our account with the exception of two somewhat larger charges at the end of the weekend. On the last charge I went over what i had in my account, and thought well...it will only be 35 dollars. Wrong, what the banks can do with out letting you know is finagle your account so that the large transaction is done first and then all the small charges get over draft fees. I'm not talking about just credit card charges, even debit.

So If its Friday and you have 100 dollars in your account and you make ten 10 dollar charges on your debit, your fine. but then sunday you make one 100 dollar charge on your debit thinking it will only be a 35 dollar fee. YOUR WRONG they will reverse it going from highest to lowest making sure you get ten over draft fees which equals 350 dollars in over draft. which is what they did to me. How? well they have a brochure called IMPORTANT LEGAL INFORMATION,DISCLOSURES, AND TERMS YOU NEED TO KNOW. You can find it if you look hard enough through it.

I want to do something about this, lets do a class action lawsuit.

Just how much where to 2 somewhat larger charges, you do not state that you were going to tranfer money to cover them, just it's only 35 dollars, it you were that tight on your account how can you say oh well just 35 dollars, times 2.

First of all, it is common knowledge by now that this is how banks post-largest to smallest. Don't you read your statements or check online and see how things are posted? This isn't new.
Secondly, what makes you think you will be successful at suing them when you said yourself that they tell you they do this in the contract you received when you opened the account?

Lawsuit for what?

AUTHOR: Ashley - (U.S.A.)

POSTED: Thursday, June 25, 2009

You said yourself that its in the disclosure agreement from the bank. You signed agreeing to the terms. The bank is holding you to the terms. If you don't like the terms, don't bank there.

here's a tip: Don't overdraft your account. best way to avoid overdraft fees.
