This is a timely, personal, and urgent appeal to all men and women who now have and/or have had any auto loan business with WFS FINANCIAL or with WACHOVIA DEALER SERVICES as they are now known. I want to hear about all of your horror stories, misdealings, continuously chnging payments, refusals by WFS to talk to you about account, repeated attempts at repossessions even though you have timely made your payments, WFS intentional denial of access to the online payment portal through which you had previously made your payments, refusals by WFS to send out what they call courtesy billing statements, refusals by WFS to repay the money it borrowed from you when it received by assignment you promissory note from its dealer partner, and about anything else WFS has done to malign your life.

I ask this of you because I HAVE BEEN CONTACTED by a reputable, nationwide law firm who wants to pursue a class action suit of claims against this company. Because I have bona fide evidence of WFS's misdealings with me and because I can prove all of the things I've asked of you in the first paragraph. This huge law firm wants a piece.

If you have EVIDENCE of your complaints against WFS, I need to hear from you right now! This one is red hot and is moving really fast.

Insurance taken out!

They took an insurance policy with out me ever knowing. When I paid off the car I noticed I way paying four more dollars a month than agreed upon. I called them up and I had to provide proof of insurance which was a huge hassle months of calling!!! Now I am waiting to hear from a insurance department is they are going to cut me a check for the difference, I have also reported them to the insurance commission. Every six months when my insurance came due they always tried to slap me with a policy of there own. This is a scam!! They also charged me a late fee once and I had not paid late in a year!! I got them to take it off though after much deliberation. They need to be stopped. Or at least notify the customer what kind off crap they are going to go through before taking a loan out with them. I had First Midwest Bank on my previous car loan and they had perfect service, nothing like these people! Please contact me with more info about this lawsuit.

I would love to join the law suit

They respossessed my vehicle using an insurance fraud tactic. They put insurance on the vehicle, even though my insurance company verfied many times with them. They refused to give me statements, so I was paying blind. I finally wrote a letter to the president, who chose to do nothing, and a month later my car was gone. They still to this day will not give me any proof that I was late, anything that has to do with the repossession, or take any of my phone calls. It was after I suspect they added the insurance that the statements stopped coming. My vehicle was important to me, as I have twins that have special needs that have to be driven back and forth to various theapy appointments and doctor appointments. I am now driving in a vehicle that requires more gas that I can pay for. So I am up to this law suit. It's about time!

I also know people who could join in this class action law suit. My older brother and father got a car loan with WDS. Their collections department has been completely vicious. 7 calls at a work number despite being told not to call that number, 3 illegal contacts with 3rd party people, 2 illegal contacts to family members, 1 count of abusive language, 2 counts of harrasment (as a result of 3 calls in 1 minute), and 1 call before 8 AM. The grand total is 16 violations of the California FDCPA and 7 violations of the Telephone Consumer Protections Acts. In California, primary creditors count under the FDCPA and if they break it, they can also be punished under federal law under a recent update. Fortunately, they're current with WDS now.

In addition, Wachovia has attempted the insurance scam twice.

Please give me the contact information for the attorney so we can get some pay back.

I have also had a problem with Wachovia Dealer Services.  I was 32 days late and called to make the payment and was told that if I didn't make two months payment (the current payment was only 2 days late), that they could come and reposess my car.  The first person I spoke to was rude, aggressive and didn't want to help at all. I had been laid off and we had been late a few times, but they always got their money.  I asked to speak to a supervisor.  I was angry anyway because they called my Mother-in-Law who has nothing to do with the loan, and harrassed her about our where abouts.  Our phone was out of commission, but if they could find her cell phone, they could find mine and my husbands, but neither of us received a phone call.  The supervisor threatened me with repossession and told me that we were lucky they gave us the loan in the first place.  She was rude, obnoxious and less than helpful.  I did call their corporate office and made a complaint and the guy there was ok. He told me to fax a complaint letter to them and they would call me back, so I am going to do that and see what happens.

I hope I am not too late to join in! I have documentation, names, etc. Wachovia used my car payments to pay an unknown attorney for legal action against me. The crazy part is... I was never notified of any legal action, I never went to court, and Wachovia refuses to give me the name of the attorney or any information about what type of legal action or why legal action was taken against me. For five months October 2008 through March 2009, they used my money to pay an attorney and now they are telling me I owe them some crazy amount of money. I have all of my moneygram receipts for every one of my payments and when Wachovia tells me that they haven't received one of my monthly payments.... I try giving them the moneygram reference number. I have been informed repeatedly by various Wachovia employee's that looking up reference numbers is NOT their job. Since October 2008... Wachovia calls me Monday through Saturday 3-5 times a day! The purpose of their phone calls is NOT to solve anything... they are made to bully, harass, and convince customers to send Wachovia money that is NOT owed to them.

I just suffered the ignominy of watching my family minivan be repossessed.


Yes, we had suffered financial downturns and yes we were behind in our payments. However, when trouble first started brewing on the horizon, I attempted to negotiate some sort of alternate arrangements with Wachovia to get through the rough patch. EVERY representative I spoke to was curt, dismissive, and essentially gave me the "pay everything or else" message. When I told one particularly rude representative that his tactics and tone were insuring that I would never do business with Wachovia again, his response was "Well, with your payment history, we wouldn't WANT you as a customer." (Of course this was after soaking us with a 15% used car loan!)


Funny, but when my WIFE called a few days later, she was given some latitude and we were able to make a couple of partial payments until another financial downturn.


Finally I had to send a cease-and-desist order because they were calling us 8 - 10/day from 8 AM - 9 PM. A recent NY Times article highlighted that -- much like doctors who admit mistakes are less likely to be sued -- when financial companies who treat their customers with a modicum of respect and understanding generally have been able to recoup 90% of overdue debts as opposed to the 40 - 45% recovery for the "hard-a*s" collection agencies.


The rep I spoke to as the repo man was hooking up the car said "Once you sent us the cease-and-desist order" we couldn't talk to you anymore -- which is a blatant lie. The law says they then have to stop CALLING (which they did cut back, but did not stop) and must use WRITTEN CORRESPONDENCE, which they did not. If a utility company can send you a statement in an envelope with a red stripe to alert you to an overdue account, why can't a multi-billion dollar bank (a recipient of TARP funds, no less!)


Finally, to add insult to injury the repo man informed my that Wachovia is BRUTAL in their tactics. When I said to him that my family was stressed to the point of contemplating telling Wachovia to TAKE the car because they would likely get $5, 000 on the $11, 000 note we owe. The repo guy then added, "Yeah, but then they'll go after your house" -- to make sure they make a killer PROFIT. Not a reasonable value for the vehicle but the sheer (high) interest profit.

I filed my own Ripoff Report against Wachovia on 7/14/09, but I am MORE than willing to participate in a class-action suit. Can you imagine, with nearly 800 complainants on this site alone against Wachovia?? With Statutes of Limitations varying from state to state, and lawyers needing to be licensed to practice or affiliated with someone who is in each particular state, we should definitely get this pursued as quickly as possible. Anything I can do from my end - let me know. I was a paralegal for 20 years here in Arizona, and am willing to do some research, legwork and whatever is necessary to take some pressure off any attorney(s) who are interested.

My situation with Wachovia Dealer Services aka Wells Fargo and some other aka's to many to mention!! LOL!! is located on here, with the BBB in TEXAS (Irving where the President's Office is), Attorney General's Office in Texas and North Carolina (corporate office headquarters). I have tried everything to make my situation resolved with this company. I am now going to have to file bankruptcy in the next few months when they come after me for the deficiency on my 03 Lexus GX470 I had being paying on time on for almost 2 years. Was only 19 days from due date and 4 days past grace period and my car gets voluntarily repocessed two days later after talking on the phone to some horrible, mean, disrespectful and jealous hateful people who have nothing better to do but harass and degrade people whom are trying to pay on their bills!!! It is a long story and one I have told many many times.. but look mine up on here to get full details.. I have names, addresses and dates, times and paperwork, but alais no telephone recording to show how awful they were to me and how they twisted two separate conversations with two different people around to make it sound as if I gave up my car voluntarily.. which I did NOT!!! I called to make a payment, they didn't call me!!! This company needs to not be saved by our taxpaying money and needs to be sued for all they are worth!!! Yet another victim of Westlake Financial harrassment!

I too have a vehicle financed by Westlake Financial Services. I too have spent the last 2 1/2 years being continually harrassed by their employees. I have, in the past, made "payment arrangements" with a particular representative on a Friday afternoon agreeing to make a payment the next morning via Money Gram. I got up the next morning (Saturday) to go to the bank and found that my car was gone!! They had repo'd it! I had to wait until Tuesday to pick up my car and it cost me $1200 (my entire bank balance) to get it back. It actually cost me more than that because I had to miss work on Monday and Tuesday because I didn't have a car to get me to work! When I woke up that Saturday and found my car "missing", I immediately called them explaining that I had just spoken to them the day before and made arrangements to pay that morning - their usual response - that they had no indication that any arrangement had been made. It seems that every time I have talked to one of their reps over the last few years, no notes are made on my account and the next person I talked to called me a liar and said that I did NOT speak to anyone there. This is by far the worst company I have EVER dealt with. They are rude, agressive, horrible customer service. Once you are 1-2 days past your due date, they call work, home, references several times a day. I am happy to say that I have only 1 payment remaining with them which will be made in 2 weeks and I will NEVER deal with them again. How do I join the potential class action suit against them? What sort of proof do I need of their harrassing, illegal tactics?

I Totally Agree Wachovia is the Worst Place i have ever Tried to work with...I was in a car accident 2 months ago the accident was not my fault however I have been outta work for 2 months and have not been able to make my Payments...I called yesterday to make my August payment and they refused it they said unless i come up with it all the August and September payment then i should just hand them over the keys to my car...So the guy i was talking to was VERY Rude...i hung up and called them right back and demanded to speak to a manager..I told her my situation and she Got very rude with me she was even ruder then the other guy i had talked to...I dont think they are gonna get anywhere being that rude there is no call for it....I just wish there was something i could do I dont want to lose my car but they wont except my payment...I Will Never use wachovia for any thing in the future once i pay off or refinance my car...but my credit score has gone down drastically so i cant refinance with another company yet...Thanks for everyones time...Sometimes you Just have to be able to get it all out or you'll burst....
