I ask this of you because I HAVE BEEN CONTACTED by a reputable, nationwide law firm who wants to pursue a class action suit of claims against this company. I would love to join the law suit

I also know people who could join in this class action law suit. My older brother and father got a car loan with WDS. Their collections department has been completely vicious. 7 calls at a work number despite being told not to call that number, 3 illegal contacts with 3rd party people, 2 illegal contacts to family members, 1 count of abusive language, 2 counts of harrasment (as a result of 3 calls in 1 minute), and 1 call before 8 AM. The grand total is 16 violations of the California FDCPA and 7 violations of the Telephone Consumer Protections Acts. In California, primary creditors count under the FDCPA and if they break it, they can also be punished under federal law under a recent update. Fortunately, they're current with WDS now.
In addition, Wachovia has attempted the insurance scam twice.
Please give me the contact information for the attorney so we can get some pay back.

I have also had a problem with Wachovia Dealer Services. I was 32 days late and called to make the payment and was told that if I didn't make two months payment (the current payment was only 2 days late), that they could come and reposess my car. The first person I spoke to was rude, aggressive and didn't want to help at all. I had been laid off and we had been late a few times, but they always got their money. I asked to speak to a supervisor. I was angry anyway because they called my Mother-in-Law who has nothing to do with the loan, and harrassed her about our where abouts. Our phone was out of commission, but if they could find her cell phone, they could find mine and my husbands, but neither of us received a phone call. The supervisor threatened me with repossession and told me that we were lucky they gave us the loan in the first place. She was rude, obnoxious and less than helpful. I did call their corporate office and made a complaint and the guy there was ok. He told me to fax a complaint letter to them and they would call me back, so I am going to do that and see what happens.

I hope I am not too late to join in! I have documentation, names, etc. Wachovia used my car payments to pay an unknown attorney for legal action against me. The crazy part is... I was never notified of any legal action, I never went to court, and Wachovia refuses to give me the name of the attorney or any information about what type of legal action or why legal action was taken against me. For five months October 2008 through March 2009, they used my money to pay an attorney and now they are telling me I owe them some crazy amount of money. I have all of my moneygram receipts for every one of my payments and when Wachovia tells me that they haven't received one of my monthly payments.... I try giving them the moneygram reference number. I have been informed repeatedly by various Wachovia employee's that looking up reference numbers is NOT their job. Since October 2008... Wachovia calls me Monday through Saturday 3-5 times a day! The purpose of their phone calls is NOT to solve anything... they are made to bully, harass, and convince customers to send Wachovia money that is NOT owed to them.

I just suffered the ignominy of watching my family minivan be repossessed.
Yes, we had suffered financial downturns and yes we were behind in our payments. However, when trouble first started brewing on the horizon, I attempted to negotiate some sort of alternate arrangements with Wachovia to get through the rough patch. EVERY representative I spoke to was curt, dismissive, and essentially gave me the "pay everything or else" message. When I told one particularly rude representative that his tactics and tone were insuring that I would never do business with Wachovia again, his response was "Well, with your payment history, we wouldn't WANT you as a customer." (Of course this was after soaking us with a 15% used car loan!)
Funny, but when my WIFE called a few days later, she was given some latitude and we were able to make a couple of partial payments until another financial downturn.
Finally I had to send a cease-and-desist order because they were calling us 8 - 10/day from 8 AM - 9 PM. A recent NY Times article highlighted that -- much like doctors who admit mistakes are less likely to be sued -- when financial companies who treat their customers with a modicum of respect and understanding generally have been able to recoup 90% of overdue debts as opposed to the 40 - 45% recovery for the "hard-ass" collection agencies.
The rep I spoke to as the repo man was hooking up the car said "Once you sent us the cease-and-desist order" we couldn't talk to you anymore -- which is a blatant lie. The law says they then have to stop CALLING (which they did cut back, but did not stop) and must use WRITTEN CORRESPONDENCE, which they did not. If a utility company can send you a statement in an envelope with a red stripe to alert you to an overdue account, why can't a multi-billion dollar bank (a recipient of TARP funds, no less!)
Finally, to add insult to injury the repo man informed my that Wachovia is BRUTAL in their tactics. When I said to him that my family was stressed to the point of contemplating telling Wachovia to TAKE the car because they would likely get $5, 000 on the $11, 000 note we owe. The repo guy then added, "Yeah, but then they'll go after your house" -- to make sure they make a killer PROFIT. Not a reasonable value for the vehicle but the sheer (high) interest profit.
