I am writing to request help with a problem I'm currently experiencing with the Wndham Professional, who is handling defaulted student loans for the Dept. of Education.

I have been off work for 4yrs. due to health problems. As a result, I was without income and could not pay on these loans. During of these 4 years, I have had 3 brain surgeries for brain aneurysms. I am disable and had to apply for social security disable which took over two year's to get.

I became eligible and started recieving social security disablilty benefits 11/08. At that time I contacted the Dept of Education about my student loans. The representatives were Rude, Misinformed and not very helpful at all. Here I was trying to do the responsible thing in resolving the school loan matter and was being treated like criminal or something less than being a real human being.

To add insult to injury these representatives are not well trained they do not know to much of anything about the particular's of your case or the policies that govern them.

For example: I wanted to enter into the rehabilitation loan program and had agreed to the terms of it. I made a good faith effort and paid the $500 down payment on time in 01/09. I made my following monthly payment 02/09 of $226.00.

Which is the monthly payment amount I agree to have taken out of my account on the 21st of each month. I did my part. I recieve a letter from social security adm that Dept of Education is planning to garnish my monthly benefits effective 3/1/09.

I called Windham about the matter and they stated I was not going to be garnished because I had entered into a satisfactory agreement. I was advised by a supervisor at Windham back on 2/6. that a letter was sent to SSA to stop the garnishment.

On 3/1/09 I was garnished 15% of my monthly benefits. I called Windham about the matter and was told I was supposed to be garnished as well. I told them I would not have agreed to a payment plan if that was the case and was very clear up front about it.

I can't afford to be paying a $226.00 month and them taking another 155.70 from my benefits. I called them again this week and was told they would send a letter to stop the garnishment. I told them, you were aware I was making timely payment yet they still garnished and as a result my payment for this month is a problem, I don't have the money.

Thier telling me the money taken in error I can not get back and that they may take another payment of 155.70. I am screwed in the mean time and still expected to make payments I did agree to. Yet they have failed hold up thier end of the bargain.

I've report this to them as well and have left several messages with the supervisor and he has not called me back. This payment is due on the 21st of this month.

Then, I read about other's who have been ripped off by them in a similar way and that the rehab student loan program is not working like they stated it should. I am very concerned and unhappy. It's a no win situation for the person trying to do the right and responsible thing.

This agency is ripping people off and don't care what they have to tell you or do to pull it off. They will lie to you and use trickery or whatever else to get more money. And they don't care about breaking the collection laws governing collection agencies to do it.

I have no other recourse but to report this and stop making payment as long as thier going to continue garnishing me.

Your assistance in this matter would be greatly appreciated. Thank You.

You are totally wrong. No judgement or court order is required to garnish someones pay when the garnishment is for a federal debt such as IRS, Student Loans, etc. and delinquent child support.

Generally federal benefits such as social security, s.s.i., veteran's compensation checks and a list of other

types of income are exempt from any type of garnishment except when it comes to a federal debt. and student loans are a federal debt. Thus, NO court judgement or court order required.

I do want to point out to the original poster __ you need to grow a backbone ! You made payment arrangements and the collection agency did'nt do their job and send a letter to the federal govt. stopping

garnishments. YOU NEED TO STOP SENDING ANY PAYMENTS TO THE COLLECTION AGENCY.

You are being garnished by the government, you are under no other obligation. Stop paying the collection agency as that money is probbely not being credited anyway.

Open a new bank account first, call social security and have your check re-routed to your new bank account at a totally NEW / different bank. Once you confirm your ss check is being deposited to your new account with no problems.  CLOSE the old account that the collection agency has the account number to.

Send the collection agency a letter telling them to stop drafting any money from your account. Tell them they are NO longer authorized to draft funds from acct. # xxx xxx xxx Tell them you have / are closing that account.

Send the letter by U.S. Mail, Return receipt requested. That way you will have proof you told them to stop drafting the money out of the old / closed account that you closed or will be closing.

Collection agencies LIE. They pull anything to get their commission.

The payment/garnishment being taken from your s.s. check is the amount allowed by law.

Do not double pay the idiot collection agency.

Make sure you open your new account with a totally new bank and not the old one !

Make sure yu call social security to have your check deposited to your new account BEFORE you close your old account.

Do not let that collection agency run all over you. Do NOT allow them to abuse you.

Send them a SEASE and DESIST letter to stop calling you or communicating with you in any way what so ever.

Now that your student loan is being paid thru garnishment, there is absolutely no reason for that collection agency to be calling/contacting you.

Send them the cease and desist letter to stop calling or contacting you by-- U.S. Mail Certified with Return Receipt Requested so you have proof.

Get online and look up the  FAIR DEBT COLLECTION PRACTICES ACT

It spells out how you can send the cease and desist letter.

(  e-mailing it, mailing just by regular mail will not be good enough)

If they continue to call or harass you after you get the green post card back fromt he post office where the collection agency got your cease and desist letter. Call an attorney that specializes in sueing collection agencies for violations of the F.D.C.P.A.

The law allows your attorney to make the collection agency pay his fee's.

Also you can get a settlement from the collection agency for violating your rights under the FDCPA

Do not allow that collection agency to bully you.

The garnishment from your ss check is all that required to be paid.

Grow a back bone and stop allowing them to abuse you.

I have also had threats and intimidations from this company. They called me at work and demanded that I choose one of their options or my wages would be garnished. I refused and Mrs. Mitchell, extension 7306 threatened to garnish my wages and became verbally abusive when I refused her options. I told her I was at work and could she please call me back in a few hours becauseI was in a meeting. Her response was "well I am at work too," and then she began to berate me for being in debt with the government. I huing up on her. These people need to be investigated and prosecuted. I have never encountered such a foul person in my life. No professionalism, all intimidation. DO NOT AGREE TO ANYTHING THEY OFFER!!

Look up Adminstrative Wage Garnishments. There is lots of good information out there. From what I understand only the Loaning agency or the feds can issue one. It does not have to go thru court. If you are in default and receive any federal money it is very likely that the feds will grab it. It is also my understanding that untill your payments are completely caught up you will be in default statis. Thank you for your tip I was going to start making payments though this agency but I think I will contact my lender and find a better option.

A new developement in my case. My April 09, benefits were garnished. I called Windham and told them I could no longer be apart of the rehab loan program and to discontinue w/d money on the 21st of each month in amt of $226.00. That happened in the first week of 4/09. I spoke with two representatives and my assigned respresentative. I requested that debit withdraws stop effective immediately.

I get a call today a friend I used as a referrence, stating Windham Prof had called her about me. I called them asking them why were they calling her when we had been talking and they had my telephone #.

More, why were they calling in the first place?? They stated that my payment's did not go thru for 3/21 or 4/21. I find that quiet interesting given I had previously requested a stop be put to these deductions becasue of the above problems I'd already had with this agency.

The representative today stated I had to pay 3 consecutive payments, previous to this I was told 2 consecutive payments and prior to this I was told no other payments except what I had agreed to.

When I initially started making payment's I was told since I reached and satisfactory agreement with Windham Prof. And had paid two consecutive payments prior two the garnsihment on-set date 3/1, I would be garnsihed. Well none of that was true and now even tho I'v requested they spot w/d or trying w/d out of my account. Their trying to override everything we talked about and what I requested . And keep pushing forward and taking.the payment anyway.
In our conversation today they were more concerned about me withdrawing out of the rehab program that anything else.

I told them I could not afford to do business with them this way and that I just did not want to participate in the rehab loan program. They did acknowledge and seen this same info in the notes I have been misadvised and given erroneous info by thier representatives. This particular agent did apologize to me but still tryed to get me to re-engage and participate in the rehab loan program. I told her no and terminated the call. I tired of being lied to, cheated, given misinfo and having my money taken. These representative are untrained and always give conflicting, contradictory info about how this rehab prog actually works.

I hope that I'm done with having to deal with this agency as it is definitely not worth my while nor to my best interest at this point,

After many telephone conversations with Windham Professionals about this matter and continuously being told misinformation I finally decided that it was best to just protect my own best interest.

I waited to see if my social security check was garnished by them this month and it was. I called them today and told them that I no longer wanted anything to do with thier loan rehab program. I lived up to my end of the deal and all they could do was find ways to rip me off more.

I have chosen not to just keep enduring and waiting for Windham to deal legally and fairly with me. I truely don't believe that day would have ever come. I hope in the future others suffering from the same type rip-off tactics of the Windham Professionals decide to file a class action law suit.

This is probably the best way deal with this type student loan predator and put a stop to these harmful ripping off scams and faulty collection practices. It's not okay to decieve, lie and trick people in an effort to collect a debt.

And that is what Windham Professionals is best at and upholding these faulty practices thru a web of deception in dealing with the debtor.

We all have to f ight back and fight to win against such predatory dealings.

I spoke to Windham Professionals again on 3/20/09, regarding my concerns with this delimma I find myself in with them. They allowed me to move the payment date as a one time thing until 3/31/09, dependent upon the early arrival of my SSAD check.

I ask them why I could not get credit for the garnish amount of $155.70 they'd taken in error. They ignored the fact it was a error of thier part and reinterated that since it was a involuntary payment I can not use it as apart of this months payment altho it will be applied to my account balance.

I was told originally that the request for the garnishment stop was sent on 3/5. I learned today in a telephone conversation with Windham that the request was not actually sent until 3/24, which was news and a shock to me. So, I question the agent about it and she started the representative only talked to the supervisor about the matter on 3/5 but never sent the request to stop the garnishment until 3/24.

This means for me that my April benefits will also be garnished and they are expecting me to also make this month and next months payment as well. I explain this to them and was told that basically it don't matter.

This is not right or fair dealing at all and leaves person with no other recourse but to protect themselves from being financially taken advantage and ripped off by Windham Professionals.

And they cannot get a garnishment without a court order. So they falsified court documents to get it.

COLLECTION AGENCIES WILL NOT FOLLOW THE LAW!
STOP EXPECTING THE COLLECTION AGENCY TO THE RIGHT THING BY YOU!
