Ok, my boyfriend was caught stealing at walmart on january 18th 05. he was followed into the bathroom where he was opening a dvd. he knew he was caught but he also knew that he would be charged with criminal tresspassing because he is not allowed on wallmart property. He sounds like an awful person but really he has so much s**t on his background that when he finally decided to straighten up, he couldnt find a job or get much help. After coming out of the bathroom, the LP was standing outside the door and asked c-ron (my boyfriend) to follow him. When ever he saw the opportunity to get out of going to jail, He made a stupid decision to run from loss prevention but soon stoped because he knew he wasnt going to get anywhere. He then did what they asked until the police got there because he knew that going to jail for a couple weeks would have all his traffic tickets cleared and he would have a clean slate. . . . well, he was then notified that he was being charged with criminal tresspassing and robbery(which is a felony) because loss prevention claimed he tried to "swing" at him when attempting to run. My boyfriend swears up and down that there is no way in hell he tried to swing at him and the tapes should prove it. I have been wondering as well as c-ron how to find out any information about the security camera records or anything because his lawyer will not tell anything and he couldnt come and have a meeting with c-ron because he was sick last weekend. So, he's still sitting in jail with a 75,000 dollar bond and his traffic tickets will be cleared on the 5th of feb. so we were originally hoping we would know something but his lawyer hasnt done s**t. Does wallmart usually have all the surveillance videos from inside the store? And is LP allowed to hand cuff him before the police arrive? I've heard so much diferent stuff I dont know what to believe!

I have worked for several retailers and now work for walmart. All retailers I have worked at have allowed the use of handcuffs with the proper training but only if the suspected shoplifter resists by running or fighting. One rebuttal was also correct that Walmart LP is NOT supposed to make stops on persons whom have eentered the restrooms or the fitting rooms. Unless of course they are taking something that is still visible when they exit such as a purse or shoes ect...
But also remember most thiefs lie so most likely you are not getting the full story.

The prisons are full of "innocent" people.. I'm sure he was innocent with all his other arrests/convictions.. I believe not only taking a deeper look into those you associate yourself with, but also to the amount of bull**** you allow yourself to believe may make things better in the long run..

For a minute there I thought that some criminal's chick was upset because her boyfriend c-ron was going to the big house for stealing and she couldn't figure out the sheer mechanics of it. Kate, You aren't "romantic," you're a loozer. This is your chance to escape the life, and you're passing it up. If you stick with this clown, be prepared to spend your Sundays standing in the sun, waiting to see ol C-Ron on visiting day. Hopefully you haven't had kids with him or you're just raising future convicts that will "have to" steal also. Anyone that considers a couple of weeks in jail as simply "clearing his traffic tickets" isn't long for this world. Some citizen is going to fing him in their garage some dark night and eliminate him from the gene pool.

The store i work at doesnt have any type of loss provention in the store on overnights. They have them during day shift, and evening shift, but no over nights. Ive worked in pets and have found open cd cases, toy cases, food containers, and whatnot and no one stops the theives of the night. talk about messed up. Your boyfriend went into the restroom w a dvd? How could that happen with so many associates, customers, management and whatnot walking the store. I go around on lunch and check out cds, movies, toys, and whatnot, and no one stops me, or watches anyone through the pegboard.

Kate, I truely feel for you due too some of the responses you had gotten on here. Its a shame that people are the way they are. You did get a few on here that may be helpful to you though. I do want to say, you might want to get a better lawyer and if you cant afford one for your man, do what ever you can to look up the laws for his situation. Someone suggested that you have his lawyer get those tapes in court. That is a good idea. I do wish you luck and hope all turns out well for you and C-Ron.

I used to work for Wal-Mart Loss Prevention in the State of Texas and I know that first, they are not supposed to make what is called a "restroom stop". Meaning, once a subject enters the restroom, you can not make the stop, because you have lost one of your elements. Second, they are supposed to let the subject pass all points of sale, another element in making stops. They are probably using the fact that your boyfriend was criminally trespassed once before but they shouldn't have been able to accuse him of stealing, because they lacked elements. Also, just a suggestion, maybe you should find another attorney.

Did C-Ron already have a theft rap? He knew that he was not allowed on WalMart property already, why was that? He seems to be pretty familiar with the criminal justice system.

Sounds like C-Ron is a B-Loser (big).

Maybe, to further make some good life choices, Kate could get a cash advance on all her credit cards to bail out C-Ron.

The store can use any resonable means to detain a shoplifter. Being that your boy C-Ron had already tried to bounce once, the handcuffs were completely legit.

As far as C-Ron promising he did'nt hit the LP guy. C-Ron the thug got caught stealin, for which he knew he'd get into extra trouble for cuz of his rap sheet, so he ran to keep out of prison. I can totally see how C-Ron is not the type of person who would swing at a LP officer.
I think WalMart should pay you $1,000,000 for tarnishing C-Ron's obvious upstanding reputation.

I have once done Loss Prevention for a year back in 2001 - 2002. I never ONCE mistreated someone that I was arresting like what happened to your boyfriend. That is NOT how Loss Prevention Agents are supposed to act. I always treated them with the utmost respect and you know what, they always gave it right back to me because they knew they were caught, wrong, and busted, and I was treating them with dignity.

I never got into that cowboy bullcrap of slamming a shoplifter up against walls and being rough with them.

One night a few years ago I was in Wal-Mart, and I was about to check out, and all of a sudden out of the clear blue I see two people running and they both basically tackle and bodyslam this person that had stolen something, THERE IS NO CALL FOR THIS, unless they are wanting to fight you and resist arrest, then you should not be rough with them.

Also, yes companies, bars, etc.. are allowed to use handcuffs to make an arrest, this is to protect themselves and everyone else in case something happens.

The handcuffs actually protected me a couple of times before because there were a few times I made an arrest and the person was just way way out of control. I did this for Tower Records, it was a kewl job.

I hope and pray everything works out for you and your boyfriend KATE... BTW what the hell is up with the $75,000 bond, never once of any shoplifter had I arrested, EVEN with a prior record was a bond that steep and high. Something is up with that.

I think the main story here is not who is right or wrong in regards to this Walmart issue. What we've witnessing folks, is a touching ,modern day ,Romeo and Juliet story that should go down as one of the greatest romance's of all time . C-ron decided to be a criminal and commit an illegal act,(theft).

It was his choice.Kate still proclaimes her true love for her main homie in spite of himself. C-ron may not be perfect and has done some bad things,but he's still the apple of Kate's eye.Hey,so who is perfect? Kate could probably have any upstanding law abiding fella with just the wink of her eye,but she has decided to give her life's devotion to C-ron.

Thru thick and thin,in sickness and in health,thru court rooms and jail cell's,C-ron is still the one. Her one and only. Folks,love, truly is a many splendid thing.Here is living proof. Sigh!

Walmart should have a video of the incident. The lawyer representing the accused doesn't appear to be in your best interest. You can subpeona the tape before the trial.

Walmart security will have witnesses on their behalf. You can request shoppers to assist you. There is almost always people who are in the area to witness these events. It will take some work from you.

Solicit customers by standing outside the door using signage requesting help. Or, take out a personal classified ad.Purchase a police report and find a legal aid service if needed. The accused will have a big challenge due to his background history.

There is no clean slate. Just time served. Look into the laws for shop lifting in your state. Some states don't consider it a theft until the accused has gone past the last available register and exits the door without paying.

Going into a public restroom only arouses interest for an overzealous security person wanting to justify their job. Although the accused has implied by his actions that a theft was imminent, it does not prove intent.

Especially if the accused had enough funds in possession to cover the item in question.

Yes, they are allowed to handcuff him. Since your boyfriend committed trespass and theft, and because it was committed in the presence of the LP officer, the LP officer is allowed to make a private persons arrest on behalf of Walmart.

The robbery charge sounded fishy to me at first. But after looking at the definition, it might be the correct charge. In Texas, "A person commits robbery if, during a theft, he or she intentionally, knowingly, or recklessly causes bodily injury to another person, threatens a person, or places another person in fear of immediate injury or death."

Using this definition, it seems that the LP officer could state that he felt threatened by your boyfriend, and therefore robbery would be the appropriate charge.

If robbery is not charged, they might charge him with burlgary. In some states, shoplifting can be prosecuted as burglary. It seems Texas is one of those states. "Burglary is entering into a building, portion of a building, or habitation with the intent to commit theft or a felony there."

If the prosecutor can prove that your boyfriend entered the store with the intent to steal, then the burglary charge could stick. For example, if he was arrested and a subsequent search revealed that he did not have the means to pay for the item, it can be concluded that he had the intent when he entered the store to commit theft, and therefore could be charged with buglary.

If your boyfriend took a swing at the LP officer, why wasn't he charged with assault or attempted battery? Just a thought.

As far as the video tape goes, you could probably get the video if C-ron's attorney subpoenaed for it. It probably will not help him get out of jail before trial. I'm sure the police officers reviewed the tape the night he was arrested. If there was insufficient evidence on the tape, I do not think the officers would file robbery charges and would have opted for a lesser charge. But on the other hand, they could charge him with the most serious crime, knowing that your boyfriend might plead to a lesser charge later. It depends on what their policy is.

Just a bit of personal advice. Evidently, C-Ron is a grown man and as such, he is responsible for his actions. Don't make excuses for him, because he brought all of this on himself. None of this would have happened if he had not knowingly trespassed on Walmart property. I have no doubt that he entered the store knowing that he was going to steal something (why a DVD?). I don't care how hard a life he has had, that is no excuse. If you want to do right, you will. I can tell you this from personal experience, trust me. Maybe you should not invest your time on someone who has sticky fingers or impulse control problems. There are plenty of good men out there, so don't waste your time on someone who doesn't care enough about himself (or you) to stay out of trouble.
