Was injured in Walmart Store 597 in Houston, Tx on March 12, 2014. A 2 liter bottle of soda fell on my left foot resulting in an acute intraverse fracture. Walmart refuses to take responsiblity for my injury stating I caused my own injury and that's not the store or the associates to remove items from places that could possibly cause injury to unsuspecting customers. The 3rd party claim adjusters denied my claim 3 times(once after writing the CEO of the company. The corporate office and the 3rd party adjusters(CMI) are all in the same building and have the same p.o. box 1288 in Bentonville, AR which is a highly predjudicedvstate. I am in Walmart stores shopping almost daily. I not only have a Walmart credit card but use cash as well. I feel that I need some type of closure on this matter. So I figure if I don't pay the credit card I will at least have something for my injury. Afterall $25.00 a month on a fixed income is $25.00. Word of caution Walmart pays people to not pay you.

How did it fall down on your foot? What did you do prior to the bottle falling? What did you do afterward? This should be the answer to readers.

PS: It is the worst and most stupid action to think that not paying credit card bill from their card would be a revenge. First the company who owns the card is not Walmart but a third party that partners with Walmar. Second, you WILL have bad consequence because you have made a bad choice in your life (again). Yes, your credit will be in bad shape for a very long time, and your fixed income may be even less. Please do not come back and make another complaint about the consequence. Oh and please do not blame others again because this is PURELY decided by your own.

 YOU need to be aware of what YOU are doing to yourself. Yes I agree IF walmart did something wrong they should pay. BUT!!! If it is NOT directly walmarts fault, as it appears from 3 denials from walmart corporate, then YOU have to accept the responsibility of injuring yourself. Hey it happens to all of us sometime. We do some innocent act and get injured. BUT!!!!! STOP LOOKING FOR DEEP POCKETS!!!! Because THAT is what YOU are doing. YOU are gold digging the situation. Ok we get it, a bottle of soda feel on your foot. The ONLY way that is going to happen is if YOU hit a display OR YOU dropped something on your foot in the store. Both of which walmart WOULD NOT be responsible for. It would be like blaming a stop sign for someone hitting YOU from behind. The stop sign is JUST a stop sign where YOU would have control over YOUR vehicle. Same would be true of a shopping cart. YOU are the driver!! If YOU run into a display and you become injured during the course of YOU pushing the cart into said display, YOU are the responsible party BECAUSE you were the ONLY party in control. Walmart CANNOT help how YOU would drive one of THEIR carts. All they can do is give you lanes to go up and down. Where I have sympathy for your situation, im NOT seeing a ripoff here. Just someone who has injured themselves and seeks to have the deeper pockets pay for THEIR injury. While it makes YOU feel better to place the blame on walmart, YOU must ask yourself this....Who was in control of the cart? Technically if a bottle of soda fell on you, it would be the vendor fault. The VENDOR sets up displays. The VENDOR is the one that states the dimensions involved in any display. Walmart is JUST the space they use. So say a bottle of coke fell on your foot, it WOULD be the vendor who is responsible BECAUSE they setup the display. Walmart would be an secondary responsible party. that is IF you had no part what so ever in the injury that has been caused to you. Because if YOU ran into a display, then YOU are 100% responsible for ANY medical bills garnered. Good Luck!!
