I contacted Warrior Fitness in Valencia, CA seeking assistance in reaching my health goals post cancer treatment. I outlined my needs generally during an introductory email and then in elaborate details during a 2 hour session. I was informed by the owner, Tchicaya that not only did he have experience creating fitness plans for various cancer patients, but that he had specifically worked with TRAM (a surgery that removes Transverse Rectus Abdominal Muscles as part of treatment) cancer patients like myself. He went on to say that he specialized in cancer patients.

After purchasing personal training and agreeing to the per session cost, I agreed to be billed monthly through a ASF International. I trusted that I would get the TRAM cancer specialist services that were verbally agreed to. After making payments that were not credited to my account and paying for services I never received, I cancelled my contract.

ASF International continued to bill me even after my account was cancelled and applied my last payment to an account that had been closed 4 days earlier. ASF International would not even apply payments to my account where I had bank records to show the checks had been cashed.

At that time I found the oral cancellation terms were never implemented. I filed a complaint against him with the Better Business Bureau and the Department of Justice and he reponded by acting my character in contradictory statements that included:

1. We believe Ms. Smith's post cancer surgery is a crutch and that her demand and need for physical male attention has clouded the real issue.
2. "Ms. Smith did not wish to train with any other trainer.
3. Ms. Smith's desire for personal attention from many male trainers is certainly understandable.
4.She demanded that Tchicaya be the only one to do her training.

What's funny is, there were no female trainers at the gym for me to select and the times my trainer was changed it was Tchicaya that assigned the new person to me. I am a middle aged mother of 2 teenage daughters, who has been married to the same man for 26 years. I was shocked when I read his response. It was malicious and completely made up. My daughters went to the gym with me 95% of the time.

This man is from Africa and clearly has a problem with strong women. Every time I questioned him about my bill, he told me that I was speaking to him like I was a man and that in his country a woman would never speak with a man like I was speaking to him.

I am headed to small claims court in February 2008 to see if I can get my money back. I heard he is trying to get people to call the Better Business Bureau and say nice things about him. I think he will get alot of people to come to court as character witnesses. I will stand alone. I feel like David going up against Goliath. I feel like I am fighting for people that have been victimized everywhere.

ASF International is bad, but they are only carrying out the instructions of Warrior Fitness (or the other gyms they represent). I am still in shock at the events. It's bad enough that I have had cancer and had to go through many disfiguring surgeries and chemo. But to get ripped off on top of it is more than I can bear.

We must stand together and not accept this. We need to write letters and make phone calls to ensure that health clubs are held accountable for their actions.

Hi Victim in Santa Clarita,

First, thank you for speaking out.  There were several people that had the same experience that I did, including my witness in court, but decided they did not want the hassle of doing anything and I think that is wrong.  It allows the bad behavior to go unchecked.

I would always suggest you list your name when posting a complaint.  Annonomous posts can seem questionable.  But your story is exactly the same as mine.  Even down to the sexual harrassment and inappropriate remarks.  My daugther video taped my experience on her  cellphone, so I have proof it happened.   I would be curious to know if you are a minority or white woman, as my friend from Kenya says that makes a difference.  He said there is a certain type of African that marries white and caters to whites.  i want to test his theory.

Yes, he has me standing on the corner of Copper Hill, exercising and giving him free advertising as well.  I didn't realize what it was until later.   The exercises he had me doing were completely wrong (and dangerous for me post surgery).  Though he assured me they were not.  When I questioned why my money was not  being applied to my account he would always blame it on the billing service or the "white man" as he called them.  I felt sorry for him at first, thinking HE was being taken advantage of by the billing service.  But I quickly realized who was pulling those strings.

What was surprising (or maybe not) were his customers, and how quick there were to attack me.  I understand defending him and sharing your good experience, but there was no reason to get personal and tell me I was being acting like a victim and such.  These women don't even know me or my situation.  And yet, they were quick to defend their man and bash me.  That's cool.  God knows I am telling the truth and so does Tchicaya.  I think that is why he made up all of those lies about me wanting attention and all of that other stuff, to take away from the real issues.  I just celebrated my 28th wedding anniversary and he has been married 3 times.  I have found my soul mate.

I also did homework on him and found out the same thing you did.  Lots and lots of fiction.  I got an email blast from him the other day asking me to go to his book signing and bring 10 friends because the media was going to be there.  Why in God's name was my number still in his phone book?  I responded that he must have sent the email in error because he still owed me money.  He sent me something certified mail, I have not had a chance to open it, but it is probably a check.  He sent me a text stating he was sending me a check and I beleive him.  He has a book he is promoting, so I am sure he doesn't want me showing up anywhere ruining his "God Bless America, I am a Marine" image.

Good luck with your lawsuit.  It was totally worth it to me.  It was never about the money (obviously, as I have not cashed his check).  I was lied to and taken advantage of and that was wrong.   I have happily moved on.  But I had to laugh when I got this alert about your experience.  It's the same old story, just a different day.

WARRIOR FITNESS IS THE WORST!

Kim I never met you but am very happy to see someone got justice with Warrior Fitness. I am in the process of filing a case against them as we speak. He blew out my knee and injured my back having me perform exercises that are ridiculous and unsound (told to me by several NATIONALLY CERTIFIED personal trainers also holding masters in kinesiology and biomechanics). He does things that are different to try and get more business but in this case different isnt better its destructive! He is uneducated and lies to your face about his certifications that he can never show you. He claimed to have won awards from LA Fitness for clients trained and when I spoke with LA Fitness they said they dont give out ANY personal training awards and actually he was fired for training clients on the side and keeping the $! His main focus is never on you its on advertising and at the end of the day you end up injured and never recieving quality service. He made several sexual advances and remarks that led to my husband being very upset and insisting on the cancelation of the membership. He has several videos where he makes very sexual and innapropriate comments and has the nerve to put them on his website! After being injured, unable to workout, and my husband being livid, he still wouldnt let me out of my contract! He is a joke. Any of his clients that hes going to convince to respond to this can feel free but ask yourself if the exercises he has you do are best to get you to your goal or are they making you his circus monkey on a street corner to better his bank roll? I have ACTUAL LEADERS in the industry that are going to testify for me and they hae made it clear that his exercises are dangerous and WILL lead many to injury. Do your research on this crook and youll see that he is uneducated, unethical, and uncivilized. Ill keep you posted on my case.

I am a member at Warrior Fitness, and I am shocked by the accusations Kim has made.

Tchicaya has been my personal trainer for almost two years. Before him I had two other personal trainers within the last five years. Both of whom were unable to give me results. They lacked motivation and personal interest due to the fact they worked for someone else. Unlike Tchicaya, who is a trainer and the owner of Warrior Fitness, he wants to see his clients succeed. Happy and satisfied clients make for a successful and lucrative business, not to mention self satisfaction. So why would any business owner intentionally sabotage themselves.

As far as the comment Kim made about strong women, she assumes men from Africa don't respect women. Tchicaya respects anyone who deserves respect male or female. He boost on the fact that he love America and how much it has done for him. We have gotten into quite a few debates and not once has he pulled the male card. He has always respected my opinion and if we can't come to an agreement we agree to disagree.

My personal experience with Tchicaya has been nothing but positive. I have been suffering with panic attacks, anxiety and depression for several years now. Since my rigorous workouts at Warrior Fitness my panic attacks are gone and my anxiety and depression have gone from 9 to 4 on a scale of 1 to 10. The first two weeks I trained with Tchicaya I lost 6 lbs. Then my doctor put me on three months of a new medication and told me there was a good possibility I would gain some weight. I was horrified! I gained 4 lbs the first week while still exercising. I went to Tchicaya in tears, he told me to hang in there its only a couple months. After the three months past I had only lost 3 lbs, but after I stopped the medication the weight just started falling off. If Tchicaya hadn't believed in me I could have never done it on my own.

Lastly, I would like to say there are so many people who adore and respect Tchicaya and what he has done for them. But it only takes one jealous person to cause havoc in someone life. Time to let go Kim and concentrate on the happy things in your life.

I go to Warrior Fitness and I can't believe the report filed by Kim!

I have been a member at Warrior Fitness for over one year. I was completely shocked by the report written by "Kim" for many reasons.

First, if you know Tchicaya, you know it is a small family owned business where they truly care about their members and are helping people to achieve their health goals. They treat you as though you are part of a big family!

Second, we as members get to know each other very well and sometimes we may have difference of opinions but then we talk about it, and work it out. I even have had a disagreement with Tchicaya. When I went to talk with Tchicaya about it, he was open to talking and listening to me and we worked it out. I am an attorney and some may say "I am a strong woman" because I am very opinionated; however, I have never felt as though Tchicaya does not like me for being a strong woman. In fact, I feel the opposite, Tchicaya loves me for being a strong woman and will attempt to help make whomever, male or female, even stronger. Another fact in regards to the Warrior is the majority of members at the warrior are women.

Lastly, since I have been training at the Warrior (for over 1 year) there has always been a female trainer available for me to choose from. If I am unhappy with a trainer for any reason, all I have to do is communicate it and it will be taken care of where I can get a new trainer that will work best for me.

The real victim here is Tchicaya. It seems to me that this woman would like to destroy his business but anyone who knows Tchicaya will know his intentions are GOOD.

Tchicaya takes pride in what he does and the success of his members. The only thing I would like to add is that I feel honored and privileged to have met him and these accussations toward him seem FALSE. In my opinion, it seems these actions could be deemed slanderous and/or libelous.

As a side not to "Kim", stop making yourself a victim and move on in your life. This is not David and Goliath, this is YOU fighting with yourself.

I Won My Lawsuit Against The Warrior Fitness Camp Valencia Tchicaya Missamou

I won my lawsuit against Warrior Fitness Camp Valencia 3 months ago and I still have not gotten my money. I did get a letter from the corporation in September (2 months after the court awarded me damages) stating that if I signed a release I could have my court judgement payment amount in full in 5 business days. I declined the offer stating that the court did not make my signing a Warrior Fitness release a stipulationin in getting my judgement. I did say I would file the necessary court papers once the court ordered payment was received and the check cleared. But I still have not gotten my money.

It is solely my opinion, but it seems that this business has a double standard when it comes to money. When taking money, they will use every resource available to them to get it promptly. But when they have to pay, they find every excuse in the book not to put that check in the mail. Though I whole heartedly disagreed with the tactics of Tchicaya at warrior Fitness when it came to my training, I always paid my bill. Even when I was fighting to get my overpayment applied to my account or credit for missed sessions, I paid my bill. That' s called upbringing.

The court has ordered judgement, and the company has not followed the rules. To the very end, this company has lived up to everything I have every said about them as it relates to my experiences with them...my experience is just that...MY expereince, MY opinion. And all of my experiences with this company have sucked!

It is evident that Kim's questions were answered through email correspondence, by Samuel Lugo (ASF Employee). What is the problem? The emails were clear and answered every question she had. My previous response was based solely on telephone conversations with Kim. By her responses and by the response from the health facility, it is quite clear that Kim has difficulty dealing with anybody in a professional manner. This is our last response to Kim's accusations as the problem has been resolved.

This response is not fact based. As usual, Tchicaya is not addressing the real issues, but insteads chooses to attack me personally to draw attention away from THE REAL ISSUES. In business you deal with difficult customers as well as non difficult customers. That's business. If I am a difficult customer, it is only because I feel you have not been up front in your dealings with me and I am seeking resolution. This is AMERICA, it is my right to do so.

Tchicaya, you can get as many people as you want to give you 5 star reviews with the Better Business Bureau and it won't change a thing. YOU had to solicit them to di it. They did not do it on their own without prompting from you. YOU know deep in your heart you have lied, especiallly in your response to the Dept. of Justice. GOD hears and sees everything you do and karma is going to come back to you.


I know you will rally your loyal members and have them write glowing reviews about you on this website. But the issue is not THEIR expereince with you. I am complainin gabout MY expereince with your way of doing business. I am NOT attacking you personally like you are doing me. It is MY expereince with the money I paid you not being applied to MYaccount, ME being charged for sessions I missed and you misrepresenting yourself to ME. You could have 100 people that had a good expereince, but that has nothing to do with me.

If I lose in court, so be it. I just want to be able to present my case and be heard. The money is already gone and I have moved on. But I can tell you are scared of something or you wouldn't be lying and trying to discredit me like you are. Everything I have said is fact based and I have documentation to prove it, via bank statements, emails or phone video footage.

1. You stated both male and female trainers are available. That may be now, but there were none available when Debbie and I signed up. YOU personally assigned yourself as my trainer. YOU assigned Jaime as your replacement.

2. You stated that there are no signs of disfigurement and I thank you for that. But medically speaking, a mastectomy is the removal of the breast and it is disfiguring.

3. You stated that I did not give you a medical release. You never asked for one for me or my co-defendant Debbie. If I had refused to give it to you, why didn't you refuse to provide service for me and Debbie for liability reasons?

4. You have not once acknowledged that there were any billing issues with ASF International with regard to my account.

5. I have never used my cancer as an excuse e while training with you or Jaime. Immediately after terminating my contract with you, I found another trainer and we are proceeding on schedule WITH NO PROBLEMS. Not once did I ask you for any extra services for no payment. I only wanted the services that I was paying for.

6. Neither you, your staff or your customers have been the victim of racial slurs or personal attacks. My mother is Mexican and my father is Black. My grandmother is White and my great-grandfather, Jewish. ANY racial term I use is purely for identification purposes, nothing more. Americans that were born in this country typically do that type of identification.

YOU are the owner of the company, if felt I was verbally abusive, why did you not kick me out? 95% of the time I showed up for training I had one of my two daughters with me. Also no one else was in the gym. You taught the class and provided me with personal training after it was over. I never spoke with anyone in at the gym except you, Jaime, Debbie and Marisha. WHO has been a victim of racial slurs? If a person is Black, they are Black. If a personis white, they are white. Those are facts. If I used any other profanity, it was in relationship to you and I said it to your face with regard to the caliber of service I was getting.

Go tell everyone to write in. That's how you operate. But going forward, let's deal with the facts and not fiction.

Fitness Training works but it does not make miracles

Warriors Fitness Camp trainers are highly trained professional fitness trainers. Several of our trainers are former military. Our facility has both female and male trainers.

Within our membership we have many cancer survivors, and some who are currently undergoing a protracted course of medical treatment with a doctor's release. Kim was photographed, weighed and measured at the beginning of her membership. She showed no signs of disfigurement as she claims and she did not provide any kind of medical prescription for what she was endeavoring to do. An initial membership contract was signed and modified later 3 additional times to accommodate her financial needs, her specific concerns, and her whims. She enjoyed the benefits of our facilities and our trained staff.

We have acknowledged billing problems regarding ASF International in correspondence with the BBB (Better Business Bureau) and with Kim. However, Kim's account was credited properly and additional billing has stopped. We apologized for the inconvenience this may have caused.

We take pride in offering a unique approach to fitness training. We like strong women and those who specifically would like to accomplish better nutrition, eating habits, and an overall improvement on their outlook to life for themselves. We encourage excellence and teamwork in our approach to fitness training.

Kim may be a cancer survivor but what we have found is that it has been an excuse to demand extra services for no payment.

Kim received the benefits and personal fitness training from our courteous and professional staff. Unfortunately, our customers and staff have been on the receiving end of her racial slurs and her personal attacks. We will gladly go to court. We are certainly no Goliath. We are a small business in a small community trying to provide a healthier and happier approach to life. The Warriors Fitness Camp feels victimized in this case.

Chris Peterson, Customer Relations Manager for ASF International Thank you for pointing out the fraudulent information in your company records. As seen in the email correspondence with Samuel Lugo Asf International, Administrative Assistant, I was in constant communications with ASF International trying to resolve my billing issues. I also attempted to return phone calls several times, but the hold times were too long. (I wonder why?!)

THANK YOU for helping me build my case against Warrior Fitness. My lawyer says the information you have provided has been most beneficial. I look forward to hearing from you with any additional information you have.

I wish no one ill will. However, with the number of complaints against ASF International, I think 30 years in busines is too long given the caliber of service being reported across the country.

Non-violent boycotts have worked wonders in the past and will work equally as well in the future. It is not a crime to discontinue the use of services that provide poor service, and this includes not doing business with companies that do business with disreputable companies.

I also think an apology is in order.

For the record I was not uncooperative and I did try to resolve the issues I had. If I had been incorrect in my allegations against ASF International, I would have been woman enough to admit it. Rebuttal to ASF International

AUTHOR: Kim - (U.S.A.)

Chris Peterson, Customer Relations manager for ASF International stated the "We called Ms. Kim several times to give her the appropriate cancellation process. We did everything we could, but she would not cooperate with us and informed us several times, that she would take care of it at the club."

That is incorrect, as the following email will prove. I was in constant contact with ASF International in trying toresolve my issues. I was directed back to the club by ASF international and I understand that ASF International was only doing what they were instructed to by the club. However, to say that I was uncooperative is simply not true.

Unfortunately, ASF International does not have any say regarding the services a member receives at the health club. Our role is to process payments and help them with cancellation processes according to the terms and conditions of the agreement. We called Ms. Kim Smith several times to give her the appropriate cancellation processes. We did everything we could but she would not cooperate with us and informed us, several times, that she would take care of it at the club. Our records do indicate that her membership was cancelled in December and she does not have any financial obligation to ASF International.

It is very disappointing that Kim would state in the title of her complaint that ASF International ripped off a cancer patient, knowing that we were only following the terms and conditions of the agreement she signed.
