Wayne County F.O.C. Sent me a letter stating they had my back child support payments that they held in an escrow account from the back owed amount till my 18th birthday. When i called them to findout when and where to expect my check or payment they said the account was closed. Later i found out they sent the check with the full amount back to the payee of the owed amount.. needless to say they gave back the child support which was owed, back to the one who was suppose to pay it. Since when did the FOC become the "Bank for Dead Beat Dads"?? in total the amount was a check for 27k for 18yrs of support which was never paid to the child or the family the rightfully it was intended for...Whats my next legal recorse for this such abuse of a system ??

Typed payer, but missed the typo

Im the child, in which the state sent me a letter directed to me after my 18th birthday stating they were holding the check for me, and when i told my mother she said thats correct as i was now an adult and that they sent her a letter stating the same thing.. but after contacting them they told me it was closed, and when i requested to know where it was sent they gave no answer. Upon asking my father he told me they sent him the check "not sure if thats true" . So i guess my question is WHY would they do that? And shouldnt i be able to go after them for it?

Double check to see if it was the PAYEE or the Payor they sent the money back to. If it was the PAYEE, then that means your mom got the money and never told you. If it was the PAYOR(your dad) and they sent $27,000 back to him, my dear, THAT is not a DEADBEAT DAD, a DEADBEAT PARENT(I would like to get rid of the abused term DEADBEAT DAD since their are mothers that don't pay their support either but a big deal isn't made about them because alot of dad's are too embarrassed to either ask or enforce support), is a parent who is ordered child support and or parenting time and refuses to pay the amount orderd or refuses to show up for visitation time with their children(EXCLUDING those that are denied visitation from the other parent for reasons OTHER THAN(the Non-Custodial

Parent posing a threat such as refusing/threatening to not give the child/children back or is/has patterns of ANY ABUSE, physical sexual, mental verbal, drug/achohol abuse). The latter part of this paragraph, is in my eyes, the ONLY justified reason for denying parenting time.

DID your mom contact the Friend of the Court everytime you moved and keep them informed, within 10-21 days of moving, of your new address. This is the only reason WHY that amount of money would have been withheld and not paid to her. Besides, with an amount like that, she should have been on the phone with Friend of the Court finding out why she wasn't receiving it, unless she didn't want Friend of the Court to know where you were so your dad couldn't see you and in that case your mom is at fault for not receiving that money and for not seeing your dad. NOT, saying that is what she did but it is a possibility. I would question her and find out why she never questioned the Friend of the Court where the money was.

PETE! I am really confused!

To Pete, I am really confused at 2 of the statements you made. First, what is "your mother's fight of EEOC, what is EEOC and what the hell did the landlord statement have to do with anything. I reread the original complainant and didn't see anything in there about a lanlord.

As far as the two children that received a letter stating that their money would be held in escrow until their 18th birthday. I have never heard of such of a thing and I not only had a father that according to my mother, paid religiously until he passed away when I was 13, but I also too have not only paid child support when her father had custody of her for 6 years(after which he hadn't paid but 5 $50 checks in the first 6 years I had her) but didnt pay a dime when I got her back after the 6 years he had her until she turned 18, but I am also OWED child support and am currently fighting for that. As far as the money being owed to the children for the time you were growing up, that money isn't owed to YOU directly, it is owed to the custodial parent or guardian who raised you to help pay for YOUR part of rent, heat, electric, laundry, cable, phone, transportation, sports in school, etc...

Although, I do agree if the child turns 18 and is still in school but living on their own, then I ahve no qualms with the money going to them from then until it is terminated.

I have a 14 1/2 year old daughter that is under the same impression, that the money is owed directly to HER so she can but things such as IPOD etc..she honestly and as a matter of fact stated exactly, "that is stupid, I should be able to get a $200 IPOD instead of you trying to pay off bills with it". Mind you, as some knows, I am on disability and only get $600 a month total for myself to not only support me but 2 children on and no child support. I said, "A home phone for emergencies is more important than an IPOD and she said, nasty might I add, "NO, it isn't". The child support is NOT to PAY THE CUSTODIAL PARENT FOR TAKING CARE OF THEIR OWN CHILD", which is a statement some outraged father made about women, it is to SUPPLEMENT the support the custodial parent/guardian already pays for that child.

I will however contact Wayne County Friend of the Court about the sending a letter to the child about THEIR money being in escrow unti they turn 18. Like I said, in my 25 years of knowing and dealing with child suport on both sides of the fence have never heard of, so if this is true this is the first time I have heard of it.

First..
Payor is the person paying support.
Payee is the person receiving the support.

If you are the child on the case, you cannot receive the support. The court order that had the payor pay the payee, stated just that..

For you to receive any payments , as a child to the payor, you would need a court order stating the same.

You didn't say what happened to the parent that had custody of you.. However, if you were under 18 then someone had to have custody of you.. That person could have went to the court and got a court order for the payor to pay them.

New law

Their is a new law know they just past again, when you turned 18 you could not collect your child support from your fathers taxes, know they have passed a law beginning next year you can collect your back child support from your fathers taxes. When you turned 18 like 5 years ago you could no longer get your child support from your fathers taxes know i would be get the child support that is owed to me know that i am 24 you can know get your back child support this will help me from all the hard times my dead beat father put me threw, so beginning of next year if he has worked any this year he will not be going to collect his tax he has to pay his tax money to me for my back child support. My fahter could not pay me $25 a week to help me instead he had to buy booze & beer with it looks like we will have our way after all, after all the kids left behind who the child support recovery failed to make the dead beat fahters pay their own child support & let them get away with it!.

'Later i found out they sent the check with the full amount back to the payee of the owed amount..' If this is the case, the righful claimant of the money received it. The 'payee' of a check is the one to whom the money is paid. The 'payer' is the person who issues the check!

And, since when is the money owed to the kid? The money is supposed to be for the kid's support, used by the custodial parent/guardian.

Charles, go back to fighting your mother's EEOC claim or continue your so-called lawsuit against her former landlord.

Some of you complainers don't know what the h@ll you're talking about.

The allegations in your rip off report dont make sense.....if the funds were sent to the FOC and were not distributed .......the problem was not your fathers fault....he paid and the state had no address to deliver to you. Therefore you must not really know dad and were hidden from him.

You need to ask mom if dad paid then why did he not see me or his money get sent to me to support me.

The sad reality again is the system failed you as they did not look for you so you could receive support.....your dad is NOT a deadbeat by your own words.....you have a deadbeat mom.

It works both ways. lien placed on my house for non-payment of child support

Just this week I found there is a lien placed on my house for non-payment of child support of two children, and I was refused a loan. I am now a deadbeat dad, apparently. Problem is, my children are all grown, this is either a fraud or a mistake, and the state says, they "can't" reverse their action against me. The pinheads that work at child support must be a bunch of the biggest retards ever, even worse than those at the DMV.

The child support recovery have always protected my fahter from making payments his ignorant lawyers have also protected him. My fahter has lied about my mother my mother has suffered alot of emotional abuse & so have I do to my fathers mental abuse he was an drunk always had to have a bottle in his mouth & yet he is allowed not to pay me or my mother child support, I have suffered abuse for years they should be a class action lawsuit agaisnt the child support network who protect fathers besides doing whats right by protecting the kids who have to suffer threw no fault of their own like I had to all threw my life.
