Wells Fargo Home Mortgage offered me a loan modification trial period for three months from Dec 2009 to March 2010 at a reduced payment amount.  I was left on the trial plan for 5 months.  All payments were misapplied, as if I went brain dead, and didn't realize what my monthly mortgage payments were after paying down my mortgage for 16 years, using a higher payment amount.

At the end of 5 months I received 3 separate denial letters. One letter stated that all the information needed was not sent within the proper timeframe.  Another denial letter stated that investor on the mortgage denied the request.  Yet another letter stated all the information needed was not submitted by me within the time frame required!  All letters came within days of each other.  To top it off, yet another letter stated that we should pay our usual mortgage amount in the same month that we paid the reduced amount.  This payment would be used to cover any costs associated with a modification (unknown amounts), and any balance left would be applied as a payment toward the mortgage.

They have created a delinquint notice of over $11,000.00 on me that is supposedly due and payable immediately.  They created this by deliberately misapplying payments, and never recording anything regarding a hamp trial modification period.

if there is any class action lawsuit you bet your butt i want in !!!!  they pulled the same bait and switch with us.   we fell behind like many other people in financial hardships. called them to work things out. got put on a  3 month plan / i western unioned every payment to have my proof they recieved ll of it. on that 3 month . made our payment anf callec them . did everything they aske and in the end were served foreclosure papers even though we followed everything they asked of us to save our home. we were also forced into ch13 to save our house from these greedy lowdown scum .  when is it that somebody will care enough to take on this shady company from making the economy worse by illegally foreclosing on people ???  they even tried to tell me i had not filled out they papers properly for the hardship packet . i made copies of everything. first they claimed not to have received it. i argued and said well thats funny because the usps website is telling me you got it days ago . are they lying too ? i think not. then she said i didnt fill out  the papers correctly so we didnt qualify because not it was past due date. nope . i got rude and called her a dumb bit*** that i had the copies of every paper in my hands as we spke. all of a sudden the tune changes ??? go figure. i suggest to anybody that ever has to deal with these crooks to have every single paper copied for your proof. EVERYTHING! ive even gone as far as recording convo of them telling me NOT to send in payments as it would "mess up the review process"  what a b.s. sham . if i had just went with my gut and not listened to them we would have avoided the ch13 we were FORCED to file to save our home .  i hope your situation works out for you and we all learn NOT to trust any company in the future . to always have our proof to fight against these shady practices.

I experienced the same problems with Wells Fargo Home Mortgage.  I missed two payments because I was jobless for over a year and used up all my savings.  I tried to refinance three months before, showing rental income that would cover the lower mortgage payment and got nowhere.  After missing payments, making many phone calls, a Wells Fargo representative finally told me about the Home Modification Loan option.  But her explanation of how it worked was misrepresented in so many ways.  She didn't explain that I would be charged late fees throughout, that my payments would not be applied until the full amount of the original payment was reached and that my payments would be reported as delinquent.  Other fees also accumulated, Wells Fargo "representatives" started showing up at my house unannounced, and none of the customer service phone representatives gave me the same answers or incorrect answers (many times taking up 45 min to 1 hr of my time and cell phone charges).  The program was never fully explained to me, I could not speak with one person for continuity and my local branch was completely out of the loop in this process.  In the end I got several letters at once, stating that I had not sent in the correct paperwork, had not sent requested documentation within the required timeframe, (10 days from when they sent the letters) or was rejected by parties involved.  I did send and/or fax paperwork at least three times, sent what was requested and sent it within the timeframe.  Who knows what happened to all that personal info.

I THOUGHT I was dealing with a reputable, honest, and scrupulous organization. What a trusting fool I was, because of my desperation.  After going thru this process for 4 months and being turned down, I was told I could start the process all over again. During those 4 months, I found a part-time job, started selling whatever personal items I could and raised enough money to pay off the delinquent amount, over $8,000, in June.  I am still struggling to catch up on my other bills. 

I've heard a few times that Home Modification Loans applications are big money for the banks, whether they are given or not. Does anyone out there know how much the banks are making or where this information can be found?

Unfortunately, I did not keep good records of my phone conversations or when I sent in paperwork.  I do think a class action suit should happen, but have no idea where to go to participate.

i would like to see a class action lawsuit with wells fargo, they did the same to my family and cost me thousands more that i did not have, i post on here also on 9/3/10 time 4:11 pm. i am from havertown pa. hang in there what goes around comes around

Yet Another Victim of Phony Promises by Wells Fargo

This is my second response to a report on this website today, and I am not even through the first page of reports!

We, too, have been wronged by Wells Fargo, in an almost identical way.  We have lived in our home for 15+ years, and last fall came upon some financial hard times.  We only got a couple of payments behind, but Wells Fargo PROMISED us they had programs (plural).  We were also placed in the HAMP, but only for a 3 month trial period.  We made the first two pmts. okay, then we had some serious family issues which needed our financial attention.

We called Wells Fargo every day, apologizing and explaining what happened.  They kept saying it was "okay, no worries, we have PLENTY of other programs for you."  For some unknown reason, I lost my mind and believed them (me, a former paralegal).  We waited and waited and heard nothing.  Months went by.  I called all the time, to get the same response - "Don't worry."  Then, came the foreclosure notice.  I called and stated that I needed to know what was happening and NOW.  I told them I kept very copious notes (which I do), of every employee's name, the date we spoke, and what was said. 

Long story short - we have to file bankruptcy to keep our home.  We offered them the FULL amount of the loan ($180,000+) for our near 50 year old house.  They told us to short sell it for $60,000.00.  Now, perhaps you can see why they are in financial distress, they cannot manage money.  They also told me they couldn't offer any other programs because "their investor" would not make a deal.  Are you kidding me?  One investor?  Looks like they need their charter revoked.

We are attempting to file a class action lawsuit, if you are interested.  Just reply to this and let me know.  We are gathering as many people from as many places as possible - they need to be made accountable.
