We bought a used car and were financed through westlake financial Services I left a check with the dealer to mail to WFS on 02/27/07 payment due 03/06/07, thinking that the payment cleared no problem till april is due checked bank account statement check was return for nsf on 3/13/07 my bad. So on 04/06/07 I sent in the late payment by western union and on 4/20/07 next payday send aprils payment plus late fees, the next day 04/07/07 when I came home from work the car was being repo, and I said I made my payment but you know how theifts are they care about money.

I called the repo person at WFS and left a very angry message. late monday she called us and spoke to my son-in-law who is also on the loan and she passed him on to someone else and then he passed the phone to me and the very rude and deceptive employee told me their policy is 30 days repo. They said the never had a current phone number to contact me then how did I get approved? then named all the contacts of family and friends they contacted but when we asked our referrences they said no one from that company called them, no messages or nothing on their caller ID's. from WFS
Who is telling the employees of this company to lie to customers or is this how they make bonuses by using this tactic They have my down payment thier fist payment, they want me to pay for the repo that I will not shall not pay and said they cannot reless the car back to me till I pay repo I said no way. No one repo's a vehicle after 30 days. this has to be some kind of scam and diffently a Rip Off. when they are prosecuted make sure each employee is also jailed and sued and Westlake Financial Services is terminated. excuse my grammer and spelling

They are scumbags, i have about 3 payments left before my vehicle is paid off.  When i originally got the truck i was late on about the 3rd payment, they told me they do not take any action until 19 days have passed.  Suddenly this month they are changing their tune, i was about 10 days late and they were threatening to repo.  They said their contract says they can repo at pretty much any time after a payment is late, even then next day. 

Look at it this way, they repo a vehicle that has only a couple payments left, they have made their money and can potentially get the vehicle back and re-sell it, nearly doubling their profits.  Scumbag compaines think this way, and im sorry, but they fall under the same category as payday loan companies, who are predators.  I am sure thats what their intentions are.  Now i do not predict that i will have any problems with them because my vehicle is just about out of their hands, but i don't trust Westlake as far as i could throw them. 

 I will absolutely never deal with them again.  Having bad credit doesn't mean you deserve to be treated like shit.  Whether it was on time, or 15 days late i have always made my payments, im not stupid enough to hand them over a vehicle.  Also i recently moved, so they couldn't find it even if they wanted, but still, thats not the point.  I have never been treated this way by any other company in my life, they deserve to get shut down.

Panic? or "Ignore" the threats?

I am also a new customer of Wilshire Consumer Credit, who is using Westlake Financial to harass me.  I get it, I get what they are doing and WHY they are doing it.. just their techniques are what is frustrating.  Their unwillingness to work with the customer and instead resorting to threats is what is messed up.  My first payment was due August 1st, 2010.  I told them August 2nd, 2010 when I hadn't made my payment yet, that I would like to setup a payment for August 20th over the phone.  They refused to do that saying, "It is not an option" over and over again.  So, I went in and setup an automated payment for August 20th, 2010 through their automated attendant.  My question is, do you think they will follow through and repossess my vehicle, even though a payment is setup? or do I just talk with them everytime they call and "ignore" their threats.   Today is Saturday the 14th, I was going to talk with them again, so I called back and Westlake forwarded me to Wilshire who is gone on Saturday.. nice..  Do I panic? or just relax as long as my payment is made on the 20th and from here on out, on the 1st which is on-time??

1st of all I'm not sure if you read your contract but it clearly states that any holder of the heh can take legal actions that's why there the lienholders of the veh. 2nd if al you fell behind on your 1st payment on your veh that's not smart. Last of all how many times have u been late since that incident probably on all ur payments. You just need to make your payments on time and you won't have to worry about your finance company taking actions on your loan.

The repo with 30 days past due

Its hard to understand a concept when something so important as your car is involved. You have to not only see your side of the picture but of the whole picture.

Your were under a finacial and legal binding contract. Im pretty sure if you look at the back of your contract it would state what your consequences are. I was a consumer of Westlake Financial as well. It explains under section e on the back of your contract your consequences of when you fall into default of your contract.

And if you dont know what default is in a loan, its the day after your past due, of course the company wont take any actions taken if your 10 days past due. When your past due payments are falling behind and effecting your credit and the account as of 30 days is hitting 2 payments behind, the business decision needs to be taken.

Thats why its very important to keep in contact with the company, make sure you follow your contract, and make a reasonable arrangement with the company.

Its not unheard of nor insane or crazy getting your vehicle picked up when the account is 30days past due.

read up and see the response Jody the employee has made, Thats exactly the response that WFS gives its customers, name calling and harrasment,,,
i also wanted to add to the fact that yes i have been late on my payments for reasons i am not going to justify on here , lets just say life kind of got hard for a few months, wfs would call my house and work and friends so much we finally had our home phone turned off, i would make a payment arrangement with them, with every intention to honour it and they would call me back 5 min later asking what i was going to do, it got frustrating, anyway i just wanted to reply to all the stuff i have read on here, im getting ready to post my own complaint, trisha id liek to talk to you via email if you dont mind, they also harrased my 15 yr old son both in person and on the phone, its insane, anyway look for my post in the next couple of days and if im allowed i will add my email adress, if they dont allow it then id like to communicate with you and anyone else wfs has verbally harrased over the phone,

Your Credit Dictates the Type of Lender Who will Finance You

I agree with the comment the person bought up about the type of lender this person financed with. If you have a low-credit rating and lenders consider you a high-risk. The best thing to do is avoid these type of finance companies altogether. The best alternative for someone who has delinquent credit to pay off in order to bring their scores up is to -- pay cash outright for a car.

That's what a friend of mine did. She paid $1,900 cash for a car to get her to work and just ride around her area locally. She is working on cleaning up her credit so she did not want, nor could she afford to paid a high-interest car loan. She is using the money she saving not paying a monthly car note to pay off her debt. Sometimes you have to "make due" if you know your credit is bad. You can't ride around in that late model car if you KNOW you're not going to get a good interest rate. You might have to go down to cousin Ernie's house and buy his old 94 honda for $1,000 until your credit situation improves.

My friend refused to go to the buy-here-pay-here lots, or to the high-risk finance sharks where their interest can be as high as 24% and they aggressively repossess after 30 days for non-payment. Nobody should have to pay 24% interest on a car loan. Why not work to clean-up your credit so you don't have to deal with these type of lenders.

I Have A Few?????

First of all I'm sure William knows the definition of a subprime borrower , but to those of you who don't Subprime borrowers typically have low credit scores due to histories of payment delinquencies, charge-offs, or bankruptcies therfore giving a loan to a sub prime borrower is considered high-risk. Also keep in mind that this was your first payment, which is by far the most critical payment on an auto loan.


You said that you left the payment at the dealer to be mailed on 02/27 to be received by 03/06, then you said you realized your payment was late and send the late pymnt in on 04/06. But you never mentioned what you did within those 29 days. According to you, you were aware of the NSF on your account on 03/13. (Please dont try to say that you were not aware of NSF until 04/05 and made the payment the next day, because i am sure that your bank sent you a notice or contacted you regarding NSF, and I am also sure you check your account balance at least a few times every month)

Im curious, did you ever consider contacting Westlake Financial to check the status of your account, or to set up an arrangement since your account was already past due when you noticed NSF. Well apparently you did not, since you waited until 04/06 to make a payment. So I cant imagine how you were suprised that your vehcile was repossesed.

Wow I thought it was just me

I have also felt extremely victimized by this company. They have lied to me threatened me. They have called family members and gave them all of my information. They call me constantly and harrass me tellin me they are going to make a "final decision" One rep even told me that if I didn't western union a payment in 7min she was going to come get my car. I was 5days late!! All of this sounds pretty bad right,Well,The same rep called my house,my 8yr old son answers the phone and she tells him that he better grow up and make a payment or we were going to come take his car. She even asked the address of his school. He is a second grader!!!! When I called the company back and personally adressed this issue with the rep she had the nerve to tell me I was a bad mom and that people who use there children have no credibility with her!! Now this has to be against the law. There was no reason to involve my child,this is a buisness matter,they have made personal. I am not a revenge kind of person however,it has gotten to the point that my kids can not answer their own phone,or feel safe because someone might show up at their school and take something from them. There must be something done about this! Please let me know if anyone knows what I can do. Any advise would be much appreciated

no matter how you slice it wfs was wrong no ifs and or buts..

they still got their money get it. and now they have a vehicle to resale.

Now what I'm suppose to come up with a payment plus $450.00 in thief(repo) fees plus $20.00 a day in pound fees..

Are they trying to push my over the edge?? it sure seems like it. just keep pushing..

People need to open their eyes and see the real picture of the greed and injustice.. soon the right person or persons will see

MIssing the first payment is especially bad.

Put yourself in the lender's shoes. There's no need for name-calling. I'm not saying WFS is a good company, but any other company needs to operate by about the same rules in order to maximize their profits.

When the first payment is late, any company will start to wonder if the buyer is willing or able to pay for the car at all. So they move to repo rather quickly while they can still find the car.

Later after the loan is established they won't repo as quick because they know most people will never make another payment after that. The car will not sell for as much as they'd get if the buyer eventually catches up the payments. So they'd lose money.

That is until there are only a few payments left. Then an unscrupulous company might grab the car for being only one day late, and resell it at a profit. This happens particularly with the "buy here, pay here" dealers.

William,

Westlake Financial is a NON CONFORMING auto finance company. Do you know what this means?

It means that every person they finance could not get financed by a traditional lender. This means they are taking a very big risk.

You say that nobody repo's when your only 30 days late? Time for a reality check! Lots of banks do it, buy here pay here car lots repo even on 1 day late, and most credit unions will repo at 30 days if the next scheduled payment has not been recieved, or if there is a history of late pay.

A due date means that the payment will be RECIEVED on or before the due date. That is what your contract says.

The entire reason you had to go to Westlake in the first place was because of your bad credit and/or questionable income. You obviously have had serious credit problems in the past, or you would not be with Westlake now!

Think about it!

If I was renting a place and I was late on my rent a honest person or laget company would work with or help a customer out not degrade their selves and revert to dishonest tactics to steal from their customers or say that they try to contact when they mostly never showed up for that date or tolk a long lunch break and said they did the job...
Plus you waited to long to cash the check the payment was paid by western union, but lazy employees just can't do their jobs right. A good business waits 90 days to work with a customer before they repo any item..
So when you wake up in the morning and look into the mirror you'll see the real loser that the world knows.
Do the world a favor you know whats needs to be done.

Repo fee's ripoff

Talked with WFS employees and they want me to pay $650.98 to get my vehicle back. Then I called the repoman and he said he thinks and then he said yes he does charge $450.00 for a repo and that the bank can have your vehicle repo if the first payment is not receviced.

I told him it still a ripoff and a scam. I made my payment I am not able to pay for a repo that high and I never called to have it repoed so that lies in WTS hands to pay.

How much more is WTS and the repo people going to get away with?
Will it be stopped in time?

Do we have to mail out flyers to residents that WFS area of service so everyone knows when they hear the name WFS to refuse their scam service and not be a victim and tell their ripoff story?

If they are not stoppped this will keep on happening because they know they are getting away with.
