My husband and I went through a LPO (Lease Purchase Option) thru at that time Clayton we paid our payments on the first of every month for 6 months then on August 2, 2006 we signed the papers and bought our home. SO WE THOUGHT. We have lived here since Feb 2006 and everything has been fine, and then out of no where we get a new park manager and then another all within a month.

So on August 18, 2008 we get a notice from the sheriffs department telling us we have 24 hours to vacate our HOME that we are RENTING from now Yes! communities because we are behind 1 month on the LOT rent. I called on 8/6/2008 and spoke with the park manager and asked him exactly what I owed and he states to me $560.00 so i tell him my son is on his way to get the money order right now and he will be there with it in a few minutes, so in return he tells me NO, I am not taking your money, we are not accepting any more payments from you. So now we have been kicked out of house that we are buying over lot rent.
WE WILL SEE ABOUT THAT>

Stay as far away from YES! COMMUNITIES, VANDERBILT MORTGAGE and CLAYTON as you can.

terrible place to live

i am stuck here in this h##l hole rossville ga,i was a truck driver who got injured while working and in order to participate in tn workmans comp you have to be there,so i had to move around chatt with no income(workmans has you 3 wks behind) and now my hearing to settle is in 13 days,i have been deemed unable to drive a truck medically,i pay rent in a mobile home park yesterday made 2 wks behind. i have contacted a friend to borrow some funds but it hassnt made it to me yet,i was informed thay are filling eviction notice tues am. i have an 8 yr old child thay know my sitiuation and just dont care.i am not behind in my elec and what am i to do? not to mention i recently bought a car so that i could find employment (restarunt ect) that my med restrictions would allow and the car had a busted head gasket i went to the car lot less than 24 hrs and wanted my money back because it broke down,he laughed in my face. that place is T & S auto sales on chik in rossville.tell everybody u know he is a rip off,has not since of deacency.iam am so tired of this place everyone is so money hungry. my hearing is sept 16 i dont have any money or realitives near by. dont know where or how i will be living next week,but when i get my settlement i am getting the heck out of here.

I agree that Yes Communities is a big rip off

I have been reading the reports here on Yes Communities & I agree this company is a big rip off. I lived in a park owned purchased by them in Pearland, TX called Raintree Estates (was previously owned by Clayton Homes). Upon moving out they would not return my lot deposit of $160 or answer my emails/phone requests for my money they owed me. When living there they would not respond to simple maintenace requests, but wanted their lot rent on time or would charge a high late charge, sometimes even claiming they didn't receive mailed lot payments, so they could charge a high service fee. I feel this company is a total ripoff plus they are located in Colorado & operating out of state businesses. Even though they have a website, they would not answer my emails or phone calls and in my opinion that in itself is a very bad business practice on their part.

contractors not being paid in timely manner

I was a contractor for yes communities in DFW texas and had to wait 6 or 8 weeks to get paid for my work. I was told the checks were printed and sent out or a certain date then it would take up to 3 weeks to get the check. as of today I have over $6000.00 that has been billed and have waited for over 60 days to receive the checks i have been told that the check was mailed on 11-19-2008 and here it it 12-12-2008 and still no check. how do they expect me to pay my employees if they refuse to pay in a timely manner? They want my rent on time but the refuse to pay.

Possible Solutions for You

As an ex-employee of one of the companies in question, I have a few suggestions for you to resolve this situation in your favor. First, in order to file any eviction proceedings, the park would have had to go to court. Were you notified of any actions against you? Most of the time these documents must be via certified mail, so it's something you would've had to sign for or pick up. Did you receive a missed letter notice and not pick it up?

Also, most states require that the park give you written delinquency notice a certain time before they can file any actions. Did they notify you in writing that the lot rent was late? If so, did they wait the required amount of time before they filed the eviction action? Can they prove that they notified you? If not, take your $550 that you had to pay the park and get an attorney. Since you were locked out, if they did not follow proper procedure, in most states you can file for damages on wrongful eviction.

The documentation that you received from the deputies that attended to the lock out should have info on them on the judge or magistrate that signed off on the action. I would contact your local clerk of courts and find out if you can still file an appeal. Most states give you 10 days from the decision date to file that, so you may still have that option.

Another option you have,albeit not a great one, is to move the house. There are parks out there who will pay for you to move your home into them, so you have not out of pocket expenses besides paying the rent. Just because they evicted you from the park does not mean that they can hold your home hostage.If you are not behind on your mortgage, you still have every right to your home. What they will do is if you are gone for a certain amount of time, they will deem your home abandoned, and even if you are still making the payments, they will repo it, so make sure if you want to keep it that you move quickly!

The bottom line is that there is a paper trail somewhere for when and how they did this. They have to follow the law, and likely did if the sheriff attended the action. That does not mean that your rignts were not violated somewhere along the lines.
