Our car was t-boned in a parking lot on October 1, 2013.  We had bought the vehicle two days prior to the accident.  After the accident, we had the vehicle towed to a local storage facility where it sat until October 30, 2013.  During that time, we had been in contact with the claims adjuster numerous times to determine how to proceed and when to expect an appraisal of the damage.  The claims adjuster was unresponsive to messages and requests for information via telephone.  

On October 28, 2013, the claims adjuster sent an email requesting a copy of the title.  The email stated (and this is a direct quote), "I need copy of title please --"  We had already faxed a copy of the title transfer receipt from the tax office.  We did not have the title yet, because we had just purchased the vehicle and had not received the original in the mail from the tax office.  Why they couldn't send an appraiser to appraise the damage is beyond me, but they claimed they couldn't do the appraisal without a copy of the title.  

On October 30, 2013, the adjuster sent an email stating the vehicle had been moved to the company's storage facility to stop storage charges.  This was the first we had heard of this.  We had not approved the move nor signed any paperwork giving permission for the move.  In that same email, the adjuster attached total loss figures for the vehicle.  We were provided with two choices:  if we chose to declare total loss, the insurance company would reimburse us for the loss;

if we chose to take possession of the vehicle, the insurance company would pay only a certain amount for damages/repairs.  We were not provided a report of the appraisal of damages.  We were never asked if we wanted the vehicle towed to the repair shop of our choice.  We were not even provided an address or phone number for the facility to which the vehicle had been moved.  We had to ask where the vehicle was and it took several days to get a response.  It had been moved to a facility fifty miles away.  Now we will have to have it towed fifty miles to the shop of our choice.  

On November 8, 2013, we requested a copy of the appraisal report.  The report showed only body work estimates, no mention of any mechanical damage or repairs.  We showed the report to two mechanics that we know and trust.  They both advised us to contact the state board of insurance to file a claim.  On November 13, 2013, we spoke with two representatives with the state board of insurance and explained the situation in detail.  

Both of them were confused by how this was handled and stated we should definitely file a claim.  We have also contacted a lawyer and we now cc him on all correspondence to the insurance company.  Also on November 13, we requested a full appraisal of the vehicle, including mechanical damage, via email and cc'ed the attorney.  This was around 2:00pm.  As of 10:00pm, we have yet to receive any reply from the adjuster.

I am compiling all documents related to this claim and sending them to the state board of insurance.  I am also making a copy of the documents for our attorney, as well as copies for the two mechanics from which we are requesting estimates.  

When this issue is resolved, we will come back and post an update.  There will be no satisfactory resolution because of the way the insurance company has handled this.  We have been given nothing but the run around.  The vehicle should not have been moved without our permission and the appraisal is incomplete.  The fact that we will have to file a complaint with the state board of insurance and possibly retain a lawyer to get this company to correct their mistakes is beyond comprehensible.  It is fraudulant and criminal.   

We will go out of our way to discuss our experience with this company with everyone we know and meet.  I work in a very large school district and travel from one school to another every day, meeting with teachers, administrators, students of all ages as well as their parents.  I also work for a community college as an instructor and assist with registration.  Every student, every janitor, every director, and every instructor I have seen in the past month has heard about this story.  My daughter attends a different community college.  

I'm sure whe is spreading the word at her campus as well.  I also volunteer in my community for a variety of events.  Everyone we know and everyone we meet will hear about this story.  We will be posting about this on our Facebook pages (I, alone, run several fan pages on Facebook), our Twitter accounts, our Tumblr blogs, my blogs on Blogger and Wordpress, my Google Plus accounts, our Instagram accounts; we will be everywhere.
