I have also been contacted by ACS (Robin Jackson). Told me I was being sued over a payday loan that I haven't paid. I was asked if I had a attorney and if I did I needed to have him call him. When I asked about this payday loan all he wouldn't tell me where it was or how much. Never-the-less I got mad and started swearing at him and then hung up on him. That was about two weeks ago, he call me again today at work, said he was a lawyer this time, and once again said that my attorney needed to contact him, once again I got mad and hung up on him. He then called my boss and told him that he was going to be subpoenad to court and that he would fax him some information in an hour. Never did. I have contacted my attorney and I advise any one else being scammed or harassed by this company to do the same.

It is a scam

These type of "companies" were profiled on ABC news months ago
They hacked into payday loan companies and stole the information
Just let them know they are nothing but scammers and hang up
Report them to the appropriate agency - you cannot be arrested for a debt unless it is a bad check period (same thing happened to me - sued them in District Court and won)

Possible clarification needed

Regarding my previous post, if ACS IS the company claiming that you owe this money, the FDCPA doesn't apply. It would only apply if ACS is a collection agency. Otherwise, you would have to look to other laws, such as state harassment statutes.

FDCPA Violations

No legitimate attorney apprises you of a pending legal claim by telephone call. It sounds like they may have committed some FDCPA violations, including:

- making it appear as though a communication is from an attorney when it is not;

- misrepresenting the status of a debt;

- illegally communicating with a third party about the debt;

- unecessarily calling your workplace.

I'm guessing that the first call, asking you if you had an attorney, was a "recon mission" to gauge the risk involved in violating the FDCPA: they tell you to have your lawyer call them; if your lawyer does call they stay within the law because you have a lawyer; if no lawyer calls, they go ahead and violate the FDCPA because you don't have anyone to advise you of your rights.

If I were you, I would make them the following offer: I will release any claims I may have against your company for violations of the FDCPA in return for a written release of my liability on the claimed debt.

But, of course, your best option is probably to hire an attorney.

Tell him this the next time he calls

I would tell him the next time he calls that you know this is a scam and you will be reporting him to local PD and FBI . I even know of another person who went through the same thing a few years back and knew it was a scam .He told me that he told the caller to go Fu-- himself and the caller hung up and never called back.
