You, sir, are wrong on every counterpoint.

FACT:  I submitted SCANNED copies of my SIGNED paperwork via EMAIL as outlined in the OFFER LETTER.

FACT: I also submitted SCANNED copies of the money order stubs via EMAIL - this was not requested by you but was a COURTESY.

FACT: This documentation was submitted to you on MONDAY via EMAIL.

FACT: The documentation was sent via TWO DAY delivery on TUESDAY and the TRACKING number of the parcel sent to you by EMAIL.

FACT: You sold the boat out from under me on WEDNESDAY.  TWO DAYS AFTER I had submitted my SIGNED documents.

FACT: You received the paperwork and money orders for the deposit AS PROMISED by 10AM THURSDAY.

FACT: Your behavior was UNPROFESSIONAL and UNDERHANDED. 

FACT: You are incapable of honoring a business agreement once made in the sole interest of PROFIT and will sell a vessel out from under someone without so much as a COURTESY call.  You are not trustworthy.  You do not deserve my, or anyone elses, business.

The agreement had been REACHED.  The offer letter SIGNED and SUBMITTED by the requested medium of EMAIL SCANS once SIGNED.

Your "rebuttal" is full of hot air, and you are a liar, Sir.

Admiral Yacht Sales is and will always follow the laws governed by the State of Florida Department of Business and Professional Regulation. The complaint above is totally erroneous and has no merit whatsoever.

He was upset that another buyer came in before him since it took him two weeks to submit a contract via US Postal Service instead of using email or fax. He also sent in four seperate Money Grams since he supposedly doesnt have a bank account.

As a professional I cannot rely on selling a customers boat on a promise of funds being there. This is why we always ask for funds deposited into our Escrow account.

61B-60.001 Definitions and Scope

“Negotiate” means any communication

made to a buyer, seller, or agent of a buyer or

seller in furtherance of the listing, offer, sale,

or exchange of a yacht. This includes

communications made orally, verbally, nonverbally,

or in writing through any medium at

any point in a listing, offer or sale, such as

during sea trials, showings of vessels, listings

of vessels, preparation of transaction

documents, and closings.

“Offer to sell,” “offer to buy,” or

“offer” means the solicitation, advertisement,

or inducement, or any other method or attempt,

to encourage any person to acquire, sell, or

exchange any interest in a yacht. This includes:

contacting owners to obtain listings, showing

vessels to prospective buyers, presenting

offers, accepting deposits, and presenting

closing statements to buyers and sellers.
