I received a call from a group identifying themselves as "National File & Claim Service" calling from (855) 662-5287. They were calling to inform me that in 24 hours, charges were being filed against me at my local county sheriff's department for felony bank fraud, and felony theft of goods and services.
Confused, I asked what this was all about, and I had no idea what they were talking about. They refused to answer any questions and that I was to contact a company called "ADR Firm" at (267) 213-1794, where they were obligated by law to provide all information about the case. I was provided with a 'case number' which I was to give to them so they could refer to my records.
Naturally I called this "ADR Firm" to inquire as to what this was. A male answered and asked if I had a case number. I said yes and provided them with my case number. He put me on hold claiming he was pulling my case file. Upon returning, he simply asked if he was speaking with 'First Name Last Name'; and I replied yes. The man reitterated the same thing I was told before, but added that he was a legal mediator acting on behalf of their client, "Discover Cash Funding". He further stated that sometime in 2010 I took out a payday loan, loan to pay off a debt, or line of credit, and provided them with false banking information so they were unable to collect, and the aforementioned charges were, again, being filed with my local county sheriff's department.
I explained to the man that I had no idea what this was about, that I had never taken a payday loan, or money for anything he was describing. The man continued to badger me harshly despite my being very calm, cool, collected, and asking very simple questions about this situation that he either refused to answer or avoided answering to instill very serious urgency on the matter. The question he DID answer was "How much is this loan allegedly for?". To which the man replied $1338.00. I stated again politely that I had no knowledge of this debt, and all my debts from my past have been addressed and paid. The man stated that this conversation had gone on far longer than it needed to, and before I had a chance to ask another question, he stated, "We'll see you in court", and hung up on me.
I called back "National File & Claim Service" and explained to them what had just happened. They put me on hold. They once again to my to call back "ADR Firm" and ask for a specific person, who went by the title of "lead mediator". So, I did so. The woman was much more polite, but again, repeated the same things I heard before. I explained once again that I have never heard of this company nor ever used any of these types of money services they were claiming I had used. She indicated that this wasn't about the debt anymore, this was about the charges. I asked what did I have to do to clear this up. She stated that they could facilitate the payment to the client today (but they are not debt collectors?). I asked how do I go about doing this. She asked if I was going to pay the amount in full. I told her I was at work and needed to know how so I could make arrangements to leave work to fix this. She stated that because the matter was so urgent, the client refuses to accept any debit card, credit card, bank check, etc.. It had to be a MoneyGram. So I replied, you want a non-traceable form of payment? She immediately flipped out screaming they were going to sue me, see me in court, yadda yadda. I stated in jest, "Oh man, my local district attorney and regional attorney general's office are going to have a field day with this." She lost it even worse shouting explitives that I will not repeat here.
So, if anyone else has experienced this recently...
- They have no information on you but your name and a phone number. They don't know where you live, where you work, email address, nothing. So don't give them anything.
- When they place you on hold, take note of the hold music between the alleged two separate companies - the hold music is virtually the same!
- They do not behave like legitimate debt collectors. They play the "bad cop / good cop" routine to try to frighten the daylights out of you so the "lead mediator" can get on the line and hit you with payment options while you are sitting there shaking. No legitimate debt-collector will ever bully a person because the moment they do that, the debt is uncollectible and you can in turn sue them for violating fair debt collection practices.
- They will only take non-traceable forms of payment, like MoneyGram, Western Union, or other forms of wire transfer. Legitimate debt collectors BY LAW have to give you legitimately traceable and secure ways to pay off your debts.
- I am sure because I called their bluff, they will be changing names and phones, but if you receive calls similar to this, simple wish them all the luck in the world, demand that they don't call you again, and HANG UP.
