Ok I am going to make this brief. I am fuming out of my ears. I took 6 months to build my consulting firm adding Aflac as one of the center piece of Catastrophic Planning. I went in to attend a Monday morning meeting and I get pulled off to the side and told my contract was canceled in February.

I was never legally notified by anyone from Aflac at all. The state office continues to send me emails from Chris Hoff even though he requested the cancelation of my contract. Its nice to know he wants me to be informed of everything but the important stuff.

I was offered a Broker contract by Alan Clonninger at 8:30 am and by 5pm the same day I was told I was having an exit interview with the state office and was asked when was I available. I have placed 30,000 dollars of my own money into growing my Aflac Career.

Fortunately I live in the State of Oregon and the Oregon Insurance Division requires a 90 day notice. I was never given that. Is it still legal to cancel my contract? I was never told why it was canceled. I was even told I could appeal it as so many other agents have done under the previous administration.

I need help and I need it fast. I have invested alot of time effort and money to make where I am possible. I work with Brokers, Businesses and individuals. I cannot just stand by while my business is taken from me.

Does anyone know how to initiate a formal appeal and what process should be taken? bear in mind I have reached out to my Regional and the state numerous times and to no avail.

I am NOT an employee of Aflac, but I am an experienced businessperson, and I have some feedback for you (I realize you posted a year ago, and may not even read thsi, but you might...and if my suggestions help even one person, it is worth it.)

 1.  You claim (I am quoting directly from your post) "I have placed 30,000 dollars of my own money into growing my Aflac Career."

I know people who have contracted with Aflac, and they didn't need to spend such a large amount of money.   I could be wrong, but the last time I checked, all that Aflac requires of you is a valid license (in Health, Life or both) from the state in which you will be selling policies.

Where did you "place" $30,000?  If you bought an office building, or hired a staff, that money isn't necessarily lost, just because Aflac terminated its contract with you.    I think they are a very good company, but there are a LOT of good compnaies out there.  Why dont you simply look into contracting with one of them?

Surley you read your contract that you initially signed wtih Aflac, and knew that they had the right to terminate at any time, w/o providing a reason, correct?   If not, (and please, don't take this as condescending in any way; I'm truly trying to help) never, ever sign anything w/o reading it first, word-for-word.    My grandfather taught me that one of the most oft-said and dangerous phrases in business is "It's a standard contract."   There is NO SUCH THING as a "standard contract" anymore.

I wish everyhone had a wise grandfather, (God Rest his soul) who taught them the hard realities about being in business for yourself. I'll ist a couple:

1. The only reason people go into business is to make money.   Every rule, tenet, plan, goal, & deicision is based on PROFIT.

 2. Do not expect anyone to help you.    If you're looking for coopeating and teamwork, become a social worker, or join the Peace Corps.   The business world is cut-throat, harsh, and full of very greedy people.

 3. The vast majority of people aren't cut out to be business owners.   They want an easy, predictable 9-5 job in which they are paid every week, don't have to worry about the market, and have a clear-cut job description.     There are plenty of jobs like that, and plenty of people who are more than happy to fill them.   Low risk, low reward.   You won't get rich working a 9-5 job or being a cubicle jockey, but you can earn a decent living, and have a happier, less stress-flled life than the guy who is PAYING you and is presiedent of the company.

 4.  If you DO want to be one of the players, and own a busienss, then prepare to have your plans disrupted, goals to get side-tracked, expenses to pop up unexpectly, and for people/companies to fire you for no resaon at all.     You need to grow a skin, and a thick one at that.

Back to your post:  Okay, so you invested $30K and you had a company unexpectedly terminate their contract with you.  Want to know what I would do?   Forget about it and MOVE ON.   This won't be the first, last, or only time you're going to get the rug pulled out from under you...the key is HOW YOU REACT TO IT.

You don't make money with an insurance company by pouring your OWN money into it.  That may be part of it, but not the important part.  You need to KNOW your products (cold) BELIEVE in them, and learn how to CLOSE a deal.

You need to get out there and start making contacts...any way you can.  Join something (it really doesn't matter what, as long as it puts you in contact with people on a regular basis; pick something you enjoy...mine as well.)   Make up goals.  Yearly, quarterly, montly, weekly and DAILY.   Print them out in a BIG font, and stick then on a wall where you will see them every single day.

Then get going.  The world owes you nothing, and you are responsible for creating yoru own success.   I dont' think you were ripped off...sorry, but don't.   And how you react to this unexpected turn of events is going to speak VOLUMES about how well you will do in business.

I apologize if I sound harsh, but every word I've written is true.   Right now, it isn't important WHY Aflac terminated its contract wtih you.   They can legally do it, they DID it, and it's done.   Don't waste one more precious second of your time on this...there is money to be made, people to see, and trust me, plenty of other carriers who will be happy to contract with you.

Get going...and GOOD LUCK!!
