Joseph, As far as I am aware, once people make a complaint on here, it is up here for good. Ripoffreport does not remove complaints or posts. That is why you have the option to rebut someone if you feel that you have a different version of events. I am not speaking on behalf of ripoff report or am I an employee of them. In the mean time I think there is a better solution for your problems. Instead of going to court, i think the two of you need to shake hands, say your sorry, have a few beers and move on with life. Everyone wants to go to court these days and sue each other. Move on both of you........................

We have a complete file on you and your wife Kathryn Schoen, aka Kathryn Vader, aka Kathryn Peulicke. [by the way there is a new rip off report about her]

You were evicted from another house just prior to renting ours [see palm springs case PSC107470], you lied about the eviction[s] and the ones before that [case PSC103505]. You lied to the court when I was forced to sue for back rent. You never returned the rental agreement. You lied about your wife. Your wife threw you out. You lied about your marriage, when you were married and when you were not married. You lied about your dogs destroying the house. Your wife threw everything you owned into the desert to blow in the wind.

Brian, I even have a letter from you personally begging to take a payment less than what you owe admitting to your lies and your problems at that time. Not a single word you say in your fraudulent report posted here is an ounce of truth.

I have asked you before in writing to take this fraudulent information down from the Internet. If you do not I will be forced to file against you again Brian becasue you have posted pure lies and fraud trying to harm me and my company and it is recurring daily.

We have plenty of info on you Brian and you need to recant what you say or there will be consequences.

Mr. Miner was able to convince the court that he was owed for the check I thought he'd destroyed. Unfortunately, I lost my appeal. He lost his other small claims case against me for rent and damages he claimed were in excess of $5000. After losing that case against me, he sued my former girlfriend for the exact same thing, changed his story and lost again.

In between the suits toward me and my girlfriend. Mr. Miner brought an unlawful detainer action against Andy and Jill McNamara, as well as a small claims suit for damages. He later also brought an unlawful detainer action against Jay Johnson. All of these actions, a total of 6 different suits, related to the same house and were filed in a period of about 7 months. I don't understand how a licensed real estate broker can end up in court every time he rents his house and claim the same damages. I believe Mr. Miner has learned he can profit more from small claims court than he can from his rental house.

Because I believe they were uninformed, the McNamaras and Jay Johnson lost their cases and Mr. Miner was awarded roughly $7,500 plus costs. I would not recommend renting or buying a house from Mr. Miner, but if you do, please be sure to document everything in writing and with photographs. I would like to add that when I made the original post on this site I was in a very agitated state of mind and that any deragatory comments concerning Mr. Miner are strictly my opinion.
