I was rear ended by someone insured by Allstate on 10/28/2009 in Atlanta, Georgia. The driver was proven guilty in court. The suit against Allstate, as of 5/25/2011 is STILL ongoing! They are deliberately dragging this out to torture me.

Prior to getting an attorney, when I had to deal with them alone, I endured the misfortune of communicating with an adjuster called LaSonya Parker. She was one of the rudest, most condescending, dishonest, racist, and minimally literate creatures that I've had to interact with in a long time. She did NOT read the police report, she can't read well, she can't pronounce simple words, she's very ineffective and frankly, she's downright arrogant. She continued to deliberately mispronounce my name with emphasis multiple times after being corrected twice, which is obviously an act of racism.

I went over her head to Kathy Turnley, who claimed to be LaSonya Parker's supervisor- these people lie so much, I have no proof this woman is her supervisor. This woman lied to me and gave me false deadlines, and when I told her I was getting a lawyer, she became very rude and tried to intimidate me saying, "I would advise you not to do that." Eventually, the case was passed on to an adjuster called Tracey Watkins, and she has deliberately done everything she can to drag this out, delay payment and make my life a living hell.

My medical expenses are $7, 458.83, plus lost wages of $462.64, then $242.50 to file suit in state court, plus the expense of transportation to and from medical appointments, attorneys office and the additional expense of photocopying/printing/faxing. To this very day Im STILL in pain, and those figures do not include ongoing treatments!

My quality of life was negatively impacted, marital relations with my spouse were negatively impacted, and because of my pain, we have had to postpone starting our family! Before the wreck, we had planned to have our first child in 2010. Don't get me started on the stress, depression, anxiety and mental anguish this has caused me!

My attorney and I demanded $20,000.00 to cover these things. Tracey Watkins forced him to fax over my work records (for proof of lost wages) TWICE. She constantly requested documents, and then every time we would fulfill the requests, she would say it was insufficient or claim she didn't have it and force us to do it again or force us to fax it to multiple numbers. She usually failed to respond in a timely manner, and it was a constant game of phone/voicemail/fax/email tag.

When Tracey Watkins finally responded with a settlement offer, it was $6, 928.00! Bear in mind, my lawyer does NOT work for FREE. He will get his fees, then what's left for me is what I have to pay bills with AND compensate me for the other expenses, wasted time, pain, suffering and mental anguish. After fighting with them since 2009, David Wallace recently offered to increase the settlement to $8,000.00; after my lawyer gets paid, the remainder wont even be enough to cover my medical bills!

The driver who hit me was required by Georgia law to have insurance on her car. When she got her policy with Allstate, she paid them MONEY in exchange for INSURANCE. They agreed to protect her from financial liability in the event that she was at fault for a collision. Not only are they screwing me, they're screwing their customer, too. They are doing a poor job of protecting her; they're flatly REFUSING to do the job they were PAID to do. They basically took her money and RAN, because now, I'll have to sue HER to get the money Allstate is refusing to pay! After becoming acquainted with her in court, I dont think she has that kind of money, so it will be like trying to get blood from a turnip. Do you think SHE'S going to be pleased with Allstate's "boxing gloves" service? If Allstate would just do their job and PAY UP, then I would NOT have to sue her! I NEVER wanted to sue her; I just wanted the insurance company she hired for liability protection to properly compensate me for my losses, which is what they are SUPPOSED to do!

I and the driver who rear ended me are NOT the first people to get shafted by Allstate. They have a LONG history of abusing people; as you can see right here on this site. When does it end? How many more years will they be allowed to continue this thug behavior? When they accept money from a person, then refuse to provide the agreed upon service (in this case its liability protection for the other driver), thats basically THEFT. Its no different than ordering a product from a catalogue and never receiving it.

Allstate representatives who have deliberately caused me unnecessary financial hardship and psychological distress by intentionally wasting time, delaying payment, insulting me, attempting to intimidate me, treating me like garbage and refusing to pay the reasonable sum of $20k, which is required to adequately compensate me for my losses and suffering:

LaSonya Parker (Adjuster) Kathy Turnley (Adjuster) Tracey Watkins (Adjuster) David Wallace (Allstate's legal representative)

I have no doubt they are also causing their customer unnecessary psychological distress and financial hardship by refusing to compensate me.

 You haven't got a clue what you're talking about.

  If the lawyer is telling you to settle for $8K, it's obvious that you cannot document $20K worth of damages.  That's what you have to do when you go to court, prove you had $xxxxx in damages.

"Admit no liability?" The other driver was found GUILTY in COURT! Now they want me to sign a statement that says the driver is NOT liable! "

  That's how a settlement works, you nimrod.   The insurance company is responsible for the other driver's liability to you.  In exchange for the settlement amount, you have to agree that it will satisfy the other driver's liability to you in this action.   Every insurance settlement comes with that piece of paper.   If they didn't require it, there would be nothing stopping you from claiming more damages later.   If you really refuse to sign a liability waiver in return for a settlement check, you will never get a settlement.    I'll bet your lawyer is pulling his hair out right about now :-)))

I really did not want to settle for $8,000- it's NOT sufficient, it doesn't cover anything and it's insulting when, according to the Wall Street Journal, Allstate's CEO Thomas Wilson rakes in $9.3 MILLION per year. As it is, we already did these criminals a favor by reducing the demand from $30,000 to $20,000- which was my attorney's idea, not mine.

Remember, my attorney does NOT work for free, he gets his fees first, then what's left is to cover the damages, so I will only have a portion of the settlement for debts and other compensation.

However, my attorney suggested that I "settle or dismiss," which left me with the impression that I shouldn't expect anything better. I begrudgingly told him to settle for what amounts to Thomas Wilson's pocket change. I then received two documents that I'm expected to sign in order to receive my laughable scraps:

1) INDEMNIFICATION AGREEMENT- I am expected to "hold harmless" and "indemnify" Allstate AND the driver who was found AT FAULT in COURT back in 2009!

2) RELEASE OF ALL CLAIMS- They want me to sign a document that states that I was not "induced" by "representations" made by my attorney and physicians regarding any aspect of my case. HA! But wait, there's more! It goes on to state that "the parties hereby released admit no liability" and that the settlement "is made to terminate further controversy."

These conditions were NEVER mentioned prior to or at the time I was advised to settle, and these documents were NEVER made available until afterwards. Had I been made aware of these things prior, I would NEVER have agreed to anything.

"Admit no liability?" The other driver was found GUILTY in COURT! Now they want me to sign a statement that says the driver is NOT liable! Furthermore, they're supposed to be compensating me for damages, not just "terminating controversy."

These are very sick individuals who have chosen to carry out the inhumane, unethical, infernal schemes of Wilson, Liddy, Allstate's stake holders, and McKinsey & Co. Evidently the individuals responsible for hiring at Allstate make a point to recruit demented "like minds." Someone who has the skills and qualifications to process insurance claims can find a decent job doing something better than ruining the lives of others. A lawyer has infinite job opportunities; he/she doesn't have to defend unscrupulous corporations. Nobody is "forced" to become employed by Allstate, it's a choice. If they don't like the way Allstate abuses victims and customers, they're free to seek employment elsewhere. They stay because they get pleasure from inflicting psychological and economic abuse on others.

Needless to say I am NOT signing those documents!

In the beginning I had no plans to sue the driver because I (mistakenly) thought that her insurance company would do what she paid them to do. Now, I have no choice! They're forcing me to sue their insured!
