APEX ALARM, APX ALARM MISREPRESENTED CONTRACT, DID NOT ALLOW US OUT AFTER FAILURE AND EVEN AFTER WE MOVED. SCAM Provo Utah

I am among the many residents being hurt by APEX ALARM's faulty and misleading business practices.

NOT ALL IS WELL IN DOOR-TO-DOOR SALES:
APEX Alarm (also APX Alarm) has been sending people door-to-door in our neighborhood for a while now selling their alarm services in aggressive competition against ADT and other services.

After two attempts we finally let the sales rep in. He was a young guy and seemed to know what he was talking about. He offered us free equipment and free installation. He even put a sign in our yard with a light. He scared us into getting the alarm system by showing us fake crime reports of our neighborhood. He even told us that our neighbors down the block were recently held at gunpoint.

Later we found out that this was all made up. At the time we were terrified. I told the sales guy that we might be moving within a year and he said that we could shut off service whenever necessary at no cost. Another lie. The system works through our phone line. My husband had the phone line shut off because we weren't needing it anymore and the alarm system failed.

I made complaints to APEX that our system was not working and that I would like to shut off service they would not let me out of the contract. I told them that we believed the sales rep lied to us -as we had mentioned we would be moving and may need to cancel service. They said that they were not responsible for what he said. They told us he was not even an employee of the company, just a summer intern and contractor working as part of a sales campaign. They said it would be impossible to track him down. (Even though his name is on the paperwork.) Let me just say this.

This company is so good that even my husband, an attorney, was fooled by the fine lines in the contract. Now we are stuck in a 60 month contract with them and watch as these college interns go door-to-door in our neighborhood scamming more people.

I called their corporate HQ in Utah asking for the name of their Director of customer service. I was extremely polite. The girl actually TOLD ME that she had been told to say that they do not give out last names, and only use first names. Unbelievable.

I got: "Andy", Dir of Customer Service and "Mike", Company Legal Counsel.

I have an attorney writing a letter to them to plead my case and we can't even get a full name. I will definitely be party to any class action suit against this company.

I've been fighting APEX alarm company for a while.  They told me I was in my contract for two years and I moved in 2009, try to canceled and they told me I was in a five year contract WTH.  Now I'm the type of person that has a file for everything but I couldn't find the contract for APEX, I have a contract for everything but not this company.  In the meantime, they send my account to a collection agency. 

What can be done about this?

I had a young man that rang my door bell on 6/17/2010 wanting to sell me an alarm system.  He went over the system and stated to me that it is a 2 year contract and the merchandise is free and all I would have to do is put the APX sign in the yard.  I stated to him that I dont plan on living in my house for that long and he was very convincing on why I should have it and that the contract wouldnt stand if I was going to move.  He was telling me that they are picking out all the neighborhoods in the area that have been getting robbed lately, which that alone made me think that it was maybe a good idea.  He was sitting in my living room going over things and he was shaking, which I figured he was new and nervous.  Now I come to the conclusion he was lying just to make a sale and a commission.  I did tell him that I wanted to think about it and look into the company a bit more and he told me that it wasnt going to be a problem to get out of the contract.  He sat in my living room calling someone else at least 3 times.  When I told him that I didnt want it installed tonight, he stated they are already here.  2 guys came in the house and as soon as you know it, they were installing the security system.  He also had the APX Company call me during all this to confirm everything.  That alone felt very uncomfortable because it was late and I still wasnt quite sure yet.  I spoke to someone at APX alarm and I told them that I was putting my house up for sale in May or June 2010 and I told her my story.  She said she doesnt know what they planned on doing if I sold my home.  I asked her what she meant, the young man told me not to worry about it.  I told her I would call back closer to the date.  I called today 10/07/2010 and spoke with Archie in customer service and when I told him that I have a buyer for the house, he stated that I am in a 5 YEAR CONTRACT.  I questioned him about it and told him I dont think so and he stated yes, mam you are.  He also said that there isnt a way that I can get out of the contract unless I move the system to the new location, which isnt needed, or I get someone else to take over the contract.  I then told him that I wanted to speak to someone higher up, not his supervisor, but someone higher.  Next guy who gets on the phone is Nick and calls himself a supervisor.  Right away I asked to talk to someone higher and he stated I am a manager and I can make decisions in regards to this kind of stuff: I told him about the situation in regards to what the young sales man said and he went over the same stuff as Archie did.  At this time I told him again that I want to speak to someone who can help me out here.  He again stated that he can do something about it.  When I told him again that this young man mislead me into believing something different, he actually stated to me EVEN IF HE MISLEAD YOU, HE WOULD NOT VOID THE CONTRACT.  I said to him again, I want to speak to someone higher up and someone that can help me.  After 40 minutes of this going back and forth with the two of them, nothing was done at all about the situation.  Nick finally gave me a name of Larry, phone number of 800-216-5232 ext 8058.  Nick said that he was going to email Larry right away in regards to this but that he wasnt going to be able to do anything for me either.  He asked me if I would like him to send me a copy of the contract and I told him that I have all the paper work from them in a folder, I keep everything.  I went home when I got off the phone, went through the folder and there is no contract in the folder.  Everything they gave me was about the APX alarm system and I never received a copy of the contract.  It is no wonder that this kid took the contract, everything that he told me was lies.  I dont want this service anymore and I dont want to work with a company who does business in this manner.  APX alarm system is a scam and anyone who does business this way is the real people who we need security from!  I would like to know what can be done about this and the next steps that I should be taking.

We also were told the same crap as the rest of you by the door to door salesman back in Aug. of 08.  I called today (Jan. of 10) to cancel my service.  I was told I had two options.  To either sell my contract or buy it out.  Not one word was said to us about a 60 month sevice contract.  Only that we leave the sign in our yard and pay the monthly service fee of 44.99.  No mention at all about having to keep the service for any length of time.  After some angry words to the person at APEX I hung up.  Would gladly be a part of any action against this company.

We share your pain. We are APEX ALARM, since 1966, a service of 911 Inc, providing alarm and monitoring services nationwide from our offices in California.

We do not send door-to-door peddlers, install "free" alarms, charge high monthly rates, use "fake crime reports", trick consumers into 5 year contracts, make unauthorized credit inquiries, or use collection agencies. The authorized rate for APEX ALARM monitoring service, to monitor Honeywell and most other brands of alarm systems, is only $11.99 per month.

APEX ALARM is a trademark registered with the U.S. Patent & Trademark Office, and no other firm is licensed or authorized to offer APEX ALARM services.

We feel we are victims of identity theft, as we have discovered that there is another firm, operating out of Utah, calling itself "Apex Alarm" and/or other sound-alike names. Worse, they are subject of hundreds of consumer complaints, currently have an "F" rating by the BBB, and are reportedly subject of numerous government actions.

We believe that many consumers, familiar with our APEX ALARM brand name, when solicited by the other company's door-to-door peddlers, assume that they are us, and sign the contract thinking, incorrectly, that they will receive our quality APEX ALARM services.

We are informed that the other company uses a post-sales verification phone call, where their office folks ask the consumer to verify that they were informed by the door-to-door peddler that the monthly rate would be "locked for 5 years", and that they later contend that this is confirmation that the consumer was informed and understood and agreed to a non-cancelable contract term of five years.

We have requested, numerous times, that they cease using any name confusingly similar to our registered trademark, but they continue to do so. As a result, we receive many inquiries each day, from consumers, vendors, public agencies and others, who are confused about the source and quality of genuine APEX ALARM goods and services. Even worse, we note that in a recent Ripoff Report Rebuttal by someone claiming to represent them, that an effort is made to blame us, the real APEX ALARM, for their own actions and the complaints against them.

We are a reputable company, and are not the company which did this to you. Nor are we, APEX ALARM, the subject of any Ripoff Report complaints. Please do not confuse us, APEX ALARM, a service of 911 Inc, for them.

I was fooled and it sounds like we had the exact same sales person. It was a young woman who sold me the system and showed me faulty crime reports and told me how my neighbors just got the alarm system and about a family that was robbed the week before. Now after realizing the system does not work I can't get out of the "contract" so good luck with that. I quit paying them for services, because they're not doing anything. I hope you win your case because then we can all do the same.

It appears to me you are all victims of your own buyers remorse and you just want a mob to complain to.

I seriously doubt you will get anywhere with a class action suit due to buyers remorse. Do you complain about your satellite bill too? How about your cell phone contract? Do you whine when you pay your power bill? You probably complain about your SUV costing too much to drive. Is your house payment too much? Do you need a bailout? What about your car payment? Do you complain about that and start a class action suit? "They made me buy a giant SUV and now I don't like to use my money on that! Someone come and remove my obligations!! I can't handle being responsible for my own decisions!!! WAAAAAA!!!!!!"

I am one of several HUNDRED THOUSANDS of APX Alarm customers. I am very happy. Everyone I know that has an APX alarm is very happy with their service.

I agree with you about APX ALARMS!!!

My husband and I are in the same situation as far as "deceptive sales tactics & practices" go with this company. I was not home when they graced our front door and got my husband to listen to their sales pitch. He was NOT informed of the fees and charges that went along with this contract and he was told we could cancel ANY TIME if we were not satisfied. He also told us that we were getting the 1st 6 months free but not to discuss it with anyone else because we were getting the better deal. Unfortunately my husband took this guy at his word and signed the darn thing and when we called to cancel, we were told the same thing. Come up with the balance of $2400+, sell it to someone or just keep it. Our contract is for 60 months also and this company only cares about getting their money any way they can. The other bad thing about our contract is that my husband didn't look at the contract real good because he was in a hurry to go to work. The sales rep didn't write down the free months on the contract either so now the company says we "allegedly" were told this. To top it all off, one of their employees even admitted to me over the phone that they know this guy lied to my husband and that their legal department is dealing with him and he no longer works for them. Now that, to me, sounds like enough grounds to get our contract cancelled but they still won't. I believe their sales rep. violated the contract, not us.

I know you are across the other side of the US but I will be a party to any "Class Action" suit also if you hear of anything. I cannot believe this company has been able to keep doing this over and over to thousands of people in several states. I need an attorney also. What type of attorney should I be looking for? Any help or info you could provide I would truly appreciate. I have lost many nights of sleep and lots of stress over this issue. I just want it resolved. I have been working on it since Oct of '08 and I'm getting really tired but I'm not giving up. Thanks...

They are not obligated to give you their last name. I also ask for the ID# associated with the first name. If they give you a false #, now you file with the BBB, Attorney General, Ripoff Report and let them know they also falsefied information. Ask them if they are recording, too. If they record you without your knowledge, now you have them on record giving false information. Hope this helps you. I'm also having my own alarm security problems from 2007 due to these creeps (want to say worse, but) that went door to door.

I ignorantly purchased this system as well. My system failed and I contacted the company on three different occasions. The first time (after being on hold for over an hour) I was eventually hung up on. Waiting until the next day to gather more patience, I called again. I was told they do not service the equipment as they only monitor. I was given another phone number and I contacted that number and got an answering machine. I left a message...received no response.

Then a couple of weeks later, attempting to solve the problem myself, my alarm went off and I was unable to get it to stop. I called the company again and after an hour of holding I was finally instructed to enter a series of codes. This did not shut the alarm off (alarm is still sounding throughout entire time). Then I was instructed to completely disconnect the system. (unplugging it) And I was told someone would be out to repair the issues. This never happened. I waited about 3 more months and cancelled the automatic withdraw from my accounts. Now I am being harrassed by the same Anderson Crenshaw everyone else is. I have told these individuals to take me to court. They also kept repeating that I was under contract, so I asked them to send me a copy of this as I obviously didn't receive one. They sent me ONLY the one sided copy of the contract that explains my responsibilities. (The company's responsibilities were on the next page - of which I did not receive....go figure).

Anyone have any suggestions of what to do from here?

I have told these individuals to take me to court. They also kept repeating that I was under contract, so I asked them to send me a copy of this as I obviously didn't receive one. They sent me ONLY the one sided copy of the contract that explains my responsibilities. (The company's responsibilities were on the next page - of which I did not receive....go figure).

Anyone have any suggestions of what to do from here?

Class Action Suit? I want in!!!

I would also like to participate in a class action suit against Apex Alarm. My scenerio is pretty much the same as most, except I never had any problems until I had to relocate to another City, sold my home and moved into an apartment which did not allow placement of a security system. The individual who purchased my home did not want monitoring at that time, so I contacted Apex to find out what I needed to do. They told me that I could of course transfer service, have a family member take over, or pay out the difference which I was only in my contract for a little over a year. I had no idea that I could not cancel. As much as I hate signing contracts, I asked the young lady who sold me the system if I could cancel and I specifically remember her telling me it was o.k. I have not been in my home since November and I am paying for a system that I am not even using!!!!! Help!!

I also was "told" we could cancel after one year with no penalties. now they want the full amount to cancel or we have to sell our contract to someone else. I would prefer not to sell to someone else as I have not needed the product and don't feel they are a reliable company.
I would be interested in any class action suit as well
