In 2006 I was diagnosed with heart condition, and in Aug 2007 I was forced to exercise my rights under the fmla for intermediate fmla use. I was also suffering from stomach issues so another specialist had me file intermediate fmla to have test and possible surgery done on 9/14/2007. Prior to this in June 2007 I began reporting issues with w/c cts symptoms to management, which triggered refusal to report the issues to 3rd party Sedgwick and harassment. September 24th, 2007 do to much unbearable harassment and need to gain control of my heart condition my dr. had me file std, this was approved and at that time orange employees had Nationwide handling fmla claims. std, ltd.
Why I was out I received letter from nbh offering me return to work accommodations under the ADA ( I also received new paperwork I should not have) , so my dr allowed the return on 10/22/2007 part time only. The merge with blue and orange employees caused the company disability tracker to malfunction. This malfunction was caused by the blue employees having the same employee Id's as orange employees and since that is what is used to to identify employees fmla use and benefits some employees were getting other employees paperwork and , employees that did send in paperwork were being wrongfully denied NBH/Sedgwick claiming they had not recievced the paperwork when in fact they did, and they wrongfully filed it in the other employees file with the same ee id. ( note nbh did full asset protection investiagion and all at&t had done was get rid of nbh and go with Sedgwick in addition to changing orange ee ids in January 2009 reason is speculation but evidence is pretty convincing and enough to get subpoena, no victims of this issue had been reinstated to my knowledge )
In December 2007 my ada return was changed in the system to full fmla use and the tracker stole 192 hours of fmla . I had actively and aggressively addressed this with everyone prior to my term. Not one person would help me including HR . ( including Ralph De La Vaga and Hr vice President Lew Walker after termination ) .
After many , many, I mean many failed attempts to get my work injuries reported I was successful on 2/14/2008 when my manager went on vacation and a decent manager filling in for her was leading her team. When she returned she was pissed and promised me my employment with the company would not last much longer. My 192 hours of fmla that was stolen was not even attempted to be returned and days I missed related to work injury were also denied do to malice on part of Sedgwick and at&t management. Denied even after my dr.'s requested accommodations under the ada while my claim was pending. ( oh remember I have discovery documents most of what I am telling you can be proved hands down ! ) AT&T had Sedgwick deny my claim with out even ime and at&t fired me for my attendance for those days missed on March 18th, 2008. I had not even recievced any coaching outlined in the company's attendance policy , nothing , notta , zip no idea I was even being reviewed for termination !!!!!
( there is much more to this story then I can cover ) .
I then contacted Ralph De La Vaga and other leaders whom forced the local cc to return the stolen fmla , but they did not return all stolen fmla still keeping work injury time missed on my history and enforcing the terimantion . I was then finally sent for IME, April 28th 2008. The IME doctor confirmed all my doctors findings and advised Sedgwick my injuries ARE related to my work duties! Ya, surly you can imagine how much worse the harassment got when the news hit them. So the shady company's approved my wc claim from date their ime dr. said the injuries were related to work ( not date of injury) . They sent the ime dr letters demanding he "amend" his report and the case is "litigated" the ime dr would not and did not "amend" his report to be the lie they hoped for. Even after Sedgwick promised to pay me they refused and delayed payment for more the 30 days after the promise trying to get ime dr to "amend". Prior to filing complaint against at&t I requested my fmla records in pursuit to hippa so I can prove to them I was right, in hopes to resolve without the courts assistance. I was sent the employee that filed the report on your site dated February 3, 2009. I was the one that sent her records and P.I. to her . I am the one that gave her records to the union to help get her protected. Yes, I can validate that victims story.
I would like to try and keep this short but does not seem possible. I am stopping here in fear of further retaliation, please understand what at&t and Sedgwick has done and continue to do has had devastating effects on myself and my family. I had even elected to have my treatment through the ime dr. since his honesty impressed me , and hoped that things would go much smoother ( ya RITE ! ) I am still trying to get the last sugery that ime dr. sugested approved and Sedgwick now sending me for another ime , so they can get reason to deny what the 1st ime dr is suggesting ) They have stopped my benefits 5 times and surgeries 2ce I can not bare anymore retaliation , sorry. I hope the information I have provided at least helps others seek information they need .
