I went to the ballys in altamonte springs fl today. It is just north or orlando and talked to a guy named Jim. I told him I was interested in joining a gym but wanted the 1999 special with no sign up fees and he just ignored me and started telling me that there was a sign up fee and that while taking me all around the center that the best thing for me is the super value plan at 4999 plus tax with a 90 starter fee. That was I could use the gym anywhere and anytime I wanted. blah blah blah.

I tried telling him that I didn't need all that and that I had to drive 35 miles to get there and it wouldnt be an everyday thing. Needless to say that he lied about there being a membership fee on the value plan 1999 program I felt pressured and lied to and after i came home and talked it over with my spouse and we decided that he was lying. My partner called and pretended to be someone asking about the membership and on speakerphone he told him that there was no signup fee on the 1999 value plan but kept going off in other directions and trying to mislead him.

I also felt that while i was there that he played me acting like he was into me since i was gay and working me like a real loser. I am trying to work it out with the management and will follow up later this week..

SOL Statute of Limitations in FL

AUTHOR: Carol - (U.S.A.)

POSTED: Monday, November 24, 2008

Hey FL peeps...the SOL in Florida is only 4 years, so if you are contacted by a collection agency for ANYTHING...ask when the original date of the "alleged" fee was...NEVER admit to owing anything...even if they think you do...If the bill is older then 4 years...say SORRY you are SOL!!! They CANNOT COLLECT ANYTHING from you...by LAW.

LOL! :-)

Thank you for your support and anyone out there that wants a true gym that doesnt want a contract go to (((ROR REDACTED NAME OF COMPETITOR))) in florida and georgia areas. they do not require a contract and you can cancel at any time. you even get your first month as a trial if you dont like it you get all your money for the signup and your first month back. No problems. Good luck to you all in the future.. Matt

sorry, allowing you to give a competitors name would instigate others to just file against their competition, to only come back later to suggest their company your comments on this policy are welcome! ALL gyms are scams!

AUTHOR: Elaine - (U.S.A.)

POSTED: Monday, July 24, 2006

Matthew, ALL gyms are scams!

Matthew, don't be fooled - there is no such thing as a "$19.99 Special". ALL gyms have "initiation" fees, "maintenance" fees and the like...different names, but they are jacking up the monthly fees. And yes, the sales people get commissions on the # of memberships they sell. My sister in law tried to join a women-only fitness place and pay the entire year up front in one lump sum payment. The gym manager said they couldn't handle the finances that way, they needed her financial information so they could debit her account. What a scam...they know that very few people actually use their memberships religiously, yet these scam artists continue to debit bank accounts and/or charge credit cards. If you want to get fit, work out together with friends by running, walking, playing a sport/game or hire a personal trainer to whip you into shape. A gym is nothing more than a money pit....with good intentioned people wearing out shortly after signing their contracts. And Bally's, sweethearts that they aren't, turns their financial stuff over to collection agencies if you fail to meet their contract requirements. Check out other reports re: Bally's here on ripoffreport.com. Good luck and good for you in persisting for your cancellation!!!

Well after reading the contract thoroughly and seeing that florida has a 3 day right of cancellation i quickly contacted corporate and requested to cancel and requested their name and a refund of my money. they told me that it would be cancelled and that i would get a refund within 3 weeks on my amex card.

Well i called amex and disputed the charge with them and then called an additional 2 times over thenext 2 days to insure that it was in the files that the contract was cancelled. i also requested the fax number of corporate customer service and faxed a cancellation request and also send one thru the website to their email addres on the link site. Well after all this and 3 weeks later the refund is here and i have a letter stating tht it was all cancelled and that there is no further auto charges to be made to my amex acct. The key to gettting these business's to do what you want is to read every contract that you are asked to sign and if you don't understand it take it to a lawyer before hand. If they won't let you leace with a copy then quickly leave because you know that they are going to defraud you in the end.

Good luck to all of you out there who are still trying to get your problem with bally's resolved.

BEWARE OF BALLY TOTAL FITNESS FOREVER
