How it all started was I went online to open a checking account because my boyfriend had wanted me to open an account and get a card so that it would make things easier when I had to stop for gas and such...............I used to be a tow truck driver and I made really good money at it, that is until this all happened.

I continually put money in my account and all of a sudden all of these letters came piling in saying that I was overdrawn, and they had sent the checks back.

What in the world is happening I thought to myself, I tried to call them and they did not even want to talk to me, just blew me off by telling me that I needed to deposit money.

I even sent my deposit book to them..............all to no avail.

I think they should have to pick up all of these checks that are bouncing around out there in my name and I also think that they should have to pay me for my pain and suffering, I am not sure how to go about doing anything but if anyone has a plan, make sure you let me know.

Steve ole buddy. You should really make up your mind about what I have done or where I have worked.

Before you thought I worked for Tropicana. I just wonder how you managed to go over 2 million commercial miles while you worked for Tropicana (considering that you just drove around around the lot with your loader. But then again maybe you have justified in your mind that these were commercial miles since you have a CDL. Right??? Please tell us how many of these miles were OTR and can be verified.

As far as assisting others. Well that is questionable since half the time you provide them with tactics that are barely legal (if not more than a bit shady). Seems a shame that you use rules and regulations meant for good people that have had bad things happen to get away with what amounts to credit card fraud. That is the legal definition of credit card fraud - obtaining credit and using it with the intention of NEVER paying it back.

Bman,

I read your post a few times, and you make some good points.

Please re-read some of the posts you have taken excerpts from to understand the progression of events so the statements are not out of context.

Also understand that I have been active on this site for approx 5 years, and early on I contributed tirelessly in helping consumers, and "rip off" victims in general.

But then, came the likes of Steven-Jacksonville, and all of that went out the window. You see, Steven - Jacksonville was [or is] a debt collector. Debt collectors have a very closed minded view of "debtors" and feel that every debt should just be paid with no excuses, and the amounts should never be challenged, and SOL means nothing, etc.

Furthermore, most of the posts nowadays are from people that clearly brought on their own problem through a lack of common sense, or sheer stupidity. Again, re-read some of these posts.

And then there are the posts from the illiterates. Well, sorry, no tolerance for illiteracy, because there is no excuse for it. Every single person living in this great country had the opportunity to soak up 13 years of education for free.

I tell it like it is. I don't sugar coat anything. That pisses people off. Too bad. That's the real me, and I'm not changing, as it works for me. That is who I am. I don't go along with the "system" as most sheep do. I fight the "system" around every turn, and by doing so for so long, I have learned to win in almost every instance. Some people are very jealous of that, like Steven-Jacksonville.

As far as walking away from the debts goes, that is easy, but it takes total discipline. A person has to "evaporate" for the entire SOL period. No bank accounts, nothing at all in your name. Nothing. I had fun doing it to those arrogant and greedy, and abusive banks. They got educated. Big time.

FYI..When I walked away from those debts, I was making well in excess of $2k per week, sometimes $4-5k weekly, and had plenty of money in the bank. That debt was debt that was carried seasonally in a business venture in Vegas. I carried that debt to maintain a high credit score, and high credit limits available based on usage. $170k sounds like alot, but not when that amount of income is involved.

I just got tired of being bent over by these banks who always wanted more. Whether it was higher interest rates, additional "fees", etc. I just woke up one day and had enough. I called each creditor to discuss these higher rates and additional fees, and get a resolution as a long term spotless paying customer, and got the same "take it or leave it" attitude from each. So, I left it. Don't give me only 2 choices as you may not like the one I pick!

I pisses people off only because they are in the same situation but do not have the backbone to do what I did, so they put me down instead. It's easier for the spineless.

Yes, I did this intentionally, and successfully dodged every moron debt collector like Steven-Jacksonville in the process. That is why he is pissed off here.

Another false statement. Every single word I have ever posted regarding my background is factual, and under-stated if anything. Prove me wrong. Give me specifics that are "exaggerated".

Steve - Bradenton (U.S.A.) the vindictiveness, cruelty, bigotry, and anger you exhibit directed at anyone that contradicts your rants appears psychotic. None of this may be true, but this is what you are presenting about yourself in this thread. My suggestion is that you tone down the insults and give the advice that you could easily offer those of us that have not the approach that you seem to embrace. Your competitive style, if I can call it that, would be of benefit if it us used with empathy.  

For example I find this comment to be impressive and would like to know more: “So, given ONLY those 2 choices, I LEFT IT! That's right, I walked away from 32 creditors for a total ov over $170,000 and then I educated them as they tried to collect. I beat all 4 lawsuits, I beat down every collector like a punk, and have gone through the entire statute of limitations on each without any judgements on me at all. I must admit it is hard to accept as you post endlessly on this site yet maintain:  “The bottom line here is that I just tell it like it is, and I don't care who likes it. Simply doesn't matter to me. You don't matter to me.” “I have nothing to prove to you or anyone else. You are nothing. Insignificant.” So why write rebuttals or offer your opinions if no one on the site matters to you? This doesn’t make sense?  

Then there is a confusion that you create when you write:  “I have only challenged businesses or alleged businesses to post proof they are legit. I have never challenged an individual to post private info here. Never.” This is bizarre since you are conflating your position by doing with the person (that you respond to) what it is you say you do not do. Then you attack women (using body parts), a specific state, and individuals, as you edge individuals on first, then claim you are only defending yourself? You started by attacking Ronnie G.  I know he can have an arrogant stance, yet he does try to offer advice more than offer insults.  

Lets review some of your best ignorant comments:  “Go away now and write some more gay poems.” “What the hell are you talking about? Do you even have a clue? You are obviously sharing that crack pipe with Karl and Ronny G! Put it down! I believe that there is at least one derogatory term used in personal attack in each posted thread you offer. Nice touch with this one: “But, you must be very stupid if you would think for a minute I would post any specifics of my bank accounts, address, or any personal identifying information here with all of the wacko faggots and stalkers on this site.”  

Try to remember why most people come to this thread, for my part I wish to help people not fall into a financial hole, and had I known about this site before going through the Hell I experienced at the hands of banks in 2009, I may not be looking at this site at all. I offer my story and have on occasion attacked a liar when I found them telling other posts what I was told which threw me into my negative financial cycle. At the heart of my contribution I hope that others will benefit and do not sit on any high horse and proclaim my success, or insult them stating I will put my opinion here and I don’t care what you think. I would be lying to myself if I said that, which is what I think you might be doing? I also want to learn how to help myself and help others and offer what I can to help those that are suffering thanks to deregulation and being lied to for over 30 years. Credit cards were created because salaries were not raised significantly for 30 years, jobs closed down and went over seas, and prices of everything always goes up, and credit cards were sold to the public as a way to make ends meet. Then with lobbyists the rules were changed and usury laws were overturned, which helped place the American people onto the mess were are still in. I was ignorant, most people were ignorant, even Wall Street was ignorant. Yet the banks knew what they were doing and planned their attack against the poor since they worry about their credit ratings, and they hoped that many of the middle classes would fall into this debt cycle trap.  

If you can remember why we are all here and offer advise and not just say nasty inflammatory things against those that suffer (whether due to ignorance or the laws), and instead give us the benefit of your experience. A man was crucified 1,978 years ago for his crimes, correct? In 33 AD a man by the name of Jesus Christ was crucified, according to information available on the web. If you 'Google' this- SANHEDRIN TRIAL OF JESUS- WIKIPEDIA, you can go to that site and read the following quote:

"Jesus was then put on trial by Jewish authorities to determine whether his guilt, in their eyes, justified handing him over to the Roman Governor Pontius Pilate with their request that the Roman Empire put Jesus to death on popular demand from the people."

It appears that the people who were in control of the government 1,978 years ago are the same people that control the U.S. government, the governments of Europe, and many other governments around the world today, wouldn't you agree? In 1913 the U.S. government basically handed control over to the Federal Reserve, right?

If you 'Google' this- WHO OWNS THE FED?, and go to the site with the 5 charts you can read the names of the people and companies who appear in those charts. 

Maybe Jesus was alerting the people back in 33 AD to the truth, and the ones in control of the government didn't like what he was doing so they had him arrested, right? I believe that Bradley Manning was arrested for allegedly alerting the people of the world to the truth about what was going on in Iraq, correct?

Maybe the government back in Jesus' day needed to operate in secrecy, just like governments of today, so the people aren't aware of the truth, huh? It's too bad that Jesus was sent to trial for awakening the people, wouldn't you agree? If Bradley Manning was the person responsible for leaking all of that information to WikiLeaks, then his crimes could be similar to the crimes that Jesus was guilty of, right?

You can 'Google' this- COLLATERAL MURDER, and watch that video on the web. I guess the ones who are controlling the U.S. government didn't like the fact that so much information was leaked, especially that video, right? Thank goodness Bradley Manning won't be crucified like Jesus if he is found guilty.

It seems that telling the truth can get someone put in jail for life in the USA, right? If Bradley Manning is found guilty, he could go to jail for life. It appears that Jesus Christ and Bradley Manning made the same mistake of exposing the Sanhedrin, which controlled the government in 33 AD and the current governments of the USA and Europe, wouldn't you now agree?

I only answered a question left here by another nut case..Karl. I answered the question by CHOICE. I know of no written law that requires labor wages to be taxed,,and I feel it is unconstitutional. Do I pay it? Yes...why? Because I know I can get locked up regardless of if these laws are unconstitutional, or if I "believe" they are unconstitutional. Maybe there was a time that the way to fight this was to declare war on the Government but we are dumbed downed and disarmed..so I reluctantly pay income tax, and sales tax, and inheritance tax, and capital gains tax, and road tax, and license tax and DMV registration tax, heck I might as well pay tax to wipe my ass.

No. But I am forced like the rest of us to live in a country that is supposedly based on a constitution , but apparently does not live up to it. It is SO clearly apparent that the only reason you come here is to knock others and this some how makes you feel better about being a big fat LOSER. Defects in Ratification of the 16th Amendment The Sixteenth Amendment to the Constitution of the United States was never ratified by a majority of the sovereign States. This is the Amendment that allegedly entitled the Federal Agent (government) in the federal territory of Washington, D.C. and their private collection company, the IRS, to collect "income tax" as falsely declared to be ratified in February 1913. After an exhaustive year long search of legislative records in 48 sovereign states (Alaska & Hawaii were not admitted into the Union until after 1913). The only record of the 16th Amendment having been confirmed was a proclamation made by the Secretary of State Philander Knox on February 25, 1913, wherein he simply declared it to be "ineffect", but never stating it was lawfully ratified. Even if the 16th Amendment were properly ratified, according to Article 1, Section 9 of the Constitution, it has always been unconstitutional for the U.S. Federal Government to directly tax We the People in their property, wages, salaries, or earnings. The judges of the U.S. Supreme Court rejected any claims that the 16th Amendment changed the constitutional limits on direct taxes in Brushaber v. Union Pacific R.R. Co., 240 U.S. 1, when they ruled that it "created no new power of taxation" and that it "did not change the constitutional limitations which forbid any direct taxation of individuals". We are not counting the failure to designate the Income Tax Amendment as the "XVII" amendment, since there was arguably a 13th Amendment that was ratified but which is not published in official copies of the Constitution with Amendments, and the number is not necessarily part of the amendment (It wasn't part of the first 10.). The authority usually cited for the criticality of ratification without errors of spelling, capitalization, or punctuation, is from DOCUMENT NO. 97-120, of the 97TH CONGRESS, 1st Session, entitled How Our Laws Are Made, written by Edward F. Willett, Jr. Esq., Law Revision Counsel of the United States House of Representatives, in which the comparable exactitude in which bills must be concurred under federal legislative rules is detailed: ...Each amendment must be inserted in precisely the proper place in the bill, with the spelling and punctuation exactly the same as it was adopted by the House. Obviously, it is extremely important that the Senate receive a copy of the bill in the precise form in which it passed the House. The preparation of such a copy is the function of the enrolling clerk. (at 34) (emphasis added). When the bill has been agreed to in identical form by both bodies (either without amendment by the Senate, or by House concurrence in the Senate amendments, or by agreement in both bodies to the conference report) a copy of the bill is enrolled for presentation to the President. The preparation of the enrolled bill is a painstaking and important task since it must reflect precisely the effect of all amendments, either by deletion, substitution, or addition, agreed to by both bodies. The enrolling clerk... must prepare meticulously the final form of the bill, as it was agreed to by both Houses, for presentation to the President...  each (amendment) must be set out in the enrollment exactly as agreed to, and all punctuation must be in accord with the action taken. (at 45) (emphasis added) It should be noted that in his report on ratifications of the Income Tax Amendment to then Secretary of State Philander Knox, the Solicitor of the Department of State, recognized many of the defects of wording, spelling, capitalization, and punctuation, although he seemed ignorant of the constitutional and procedural defects at the state level. He also pointed out similar defects in the ratifications of the 14th and 15th Amendments. Therefore, Knox had plenty of clues to the problems in the ratifications, sufficient to justify that he inquire into the matter further and demand corrective action by the states. Because he failed to do so means that we now have adopted and enforced legislation for more than 80 years that is plainly unconstitutional, requiring not only that it be repealed, but that all the funds collected be refunded. The states could, of course, re-ratify the Income Tax Amendment, but they could not do so retroactively. That would allow re-enactment of the Internal Revenue Code, and re-issuance of all the supporting regulations, but none of them could apply to the period prior to proper ratification of the amendment and due notices of the regulations. Readers are invited to independently confirm or refute these results and to similarly investigate the ratifications of other constitutional amendments, both at the federal and state levels, and to issue similar reports on what they find.

Several YEARS ago (2 or 3) I posted the exact CITE of law about wages and income taxes.  In other words fool, I posted the CITE of law that deamed wages as taxable for income tax purposes.  At that time YOU refused any further comment.

The 16th Ammendment (circa 1812) is what made income tax a NON constitutional issue.  Do I like it?  Heck No!  Is it legal?  So far, until the constitution and/or federal law is changed, it is.  It was this ammendment that opened the flood gates for the Fed (and later the States) to tax and spend at will.

Oh, and as a pop quiz, what political party was FOR the income tax?  For extra credit, what political party opposed the income tax?

Here's a hint.  Originally, an income tax was imposed as a TEMPORARY TAX on the minority of earners (estimated as 1 % of earners) to fund our efforts during WW1.

There is no law requiring an American who earns a salary or a wage on his or her labor to pay Federal Income tax. It's voluntary. Federal Income tax is a tax on 'profits' and 'gains'. When a person earns money as a result of their 'labor', that is not a 'profit' or a 'gain' because there was an even exchange. The tax is mainly for companies and corporations.

However, a person who purchases a lottery ticket or a ticket at a horse track, which becomes a winning ticket, is required to pay Federal Income tax on the winnings because that is considered a 'profit' or a 'gain'. Winnings at a casino are also taxable, but one's labor is not taxable under any Federal law. 

***Suggestion to the OP: Get rid of your debit cards immediately and only use cash or checks. It's that simple. The banks will continue to manipulate their customers in order to make profits and gains. They are in a situation where they have to do this because they are not loaning money to customers like before. Banks used to make most of their money by loaning money out to consumers. The banks' business model has changed. They are now targeting the most vulnerable people who are living paycheck to paycheck. They know that these people can be manipulated into overdrafting their accounts, and the banks are making huge profits as a result.

P.S. To Ronny G: It appears that "OPINION POEM" could be entitled- "FACT POEM", right? Since the masses in America have been manipulated into believing that their 'labor' is taxable under Federal law, it becomes clear that the USA really is a lie, wouldn't you now agree?

There is no constitutional issue here. People have challenged this thousands of times over the years and all have failed.

The U.S. government should use the same logic that all of us should use when figuring out our finances, but in 1913 the U.S. government decided to allow the Federal Reserve to control the finances of our country. It was obviously a mistake, because the Federal Reserve isn't an entity that concerned itself with the masses of people in America. The Federal Reserve is mainly interested in the people and the companies who are linked to it.

Since the politicians have benefitted tremendously from what the Federal Reserve has done since 1913, they continued to allow the ones at the Federal Reserve to make the decisions for our country. However, these decisions have mainly helped the Federal Reserve, Wall Street, and many in the government, like the politicians who work for them. 

Those who don't agree with this answer can simply 'Google' the following documentaries and watch them on the web for proof that the Federal Reserve controls most of the U.S. government, Wall Street, the Mainstream Media, and most of the elected officials in the USA-

*I believe that those five documentaries will clearly prove that the Federal Reserve is in control of the U.S. government. Pay close attention to what Congressman Ron Paul's brother stated at around 57 minutes 36 seconds into the documentary entitled- 'The Obama Deception', okay? Wayne Paul stated that the American people, and social security, were given as collateral to the Federal Reserve so they would continue operating our country. I believe he also said that the USA has been operating on an "emergency" basis, due to all of the debt.

It appears to me that things are beginning to unwind, and if the debt ceiling isn't raised the USA will most likely default on some of its obligations with other countries, who have provided the necessary funding to keep our government going, wouldn't you agree?

Actually, that person you spoke of was some debt collector that was all high and mighty on some sort of moral crusade. I had to just shut that cunt down, which I did as she has not come back.

As far as the "cut and paste" thing. That was exactly what happened, and I already figured it out. I did cut and paste as stated, but went to far with my highlight and copy and hit the red title which made the whole copy red. The next time, I figured this out, and avoided it. Real simple, even for you.

Furthermore, I will reiterate my position as far as your claim of me boasting, bragging, whatever. If you look at the progression of events, I never made any sort of financial claim unless it was in response to someone elses insult towards me.

But rest assured, you DO NOT know who I am, and you know nothing about me. Guaranteed.

I have nothing to prove to you or anyone else. You are nothing. Insignificant.

I live my life by my rules, and it works for me. It doesn't have to work for you, because you don't matter to me. Only my family and my close friends matter to me, and they are the only people who matter to me. You don't.

You are just pissed because you are some kind of self proclaimed expert in the financial industry, probably a bank teller or some other menial job, and I have consistently stepped on banks and collectors and have won every time.

Years back, I got pissed off at the greed of several banks in the way they feel they can just raise rates for no good reason and add fees, etc all with impunity. Well, that was not acceptable to me. I made phone calls to each, and each one gave me the same "take it or leave it attitude".

So, given ONLY those 2 choices, I LEFT IT! That's right, I walked away from 32 creditors for a total ov over $170,000 and then I educated them as they tried to collect. I beat all 4 lawsuits, I beat down every collector like a punk, and have gone through the entire statute of limitations on each without any judgements on me at all. I never paid these arrogant idiots 1 penny, and never will.

So, I guess I am some kind of expert in this area after all.

And the funny part was, I had plenty of money to make these payments, and had assets. I chose not to pay simply because they pissed me off. Now, I still have all of my money and all of my assets, and NO BILLS!

Only in America!

I don't remember the ladies name but she reminded you about debts you walked away from. One of the cut and paste responses to her was in red ink which you said happens when you cut and paste but then your next cut and paste wasn't in red ink.
You present yourself as some kind of financial guide but your suggestions are often wrong and almost always rude. When I first started posting on ROR you gave good information and were pleasent to people. However lately you've become quite rude to everyone.
And yes, if you boast that you have 3 or was it 30 times $1000 in your account and that you spend $1000 for dinner, then you're boasting. The only reports that should be about you are the ones you post as OP. But you seem to enjoy trying to show off your financial knowledge and be center stage. Basically all you've done is put yourself into a group with Charles and Karl as posters that are read for a laugh but not taken seriously.

P.S. Could you also prove to us that you have "well in excess of 30 times" in one of your bank accounts than Ronny G has in his bank account? Can you please provide copies of the restaurant receipt from last night, and copies of the receipts from the club you attended that will prove to all of us that you spent more than $1,000 last night?

Also, since everything you have is paid for, I'm certain that you'd have no problem proving it to all of us, right? Please make copies of the title to your car/cars, showing us that they are paid in full, okay? You can also take pictures of your car/cars, and your house/condo/town-home for all of us to see. And please make copies of the information proving that your residence is paid in full, okay?

You can also provide us with the information documenting your net worth. That would prove to all of us that you are a sincere person who wouldn't lie to anyone, okay?

The bottom line here is that I just tell it like it is, and I don't care who likes it. Simply doesn't matter to me. You don't matter to me.

The fact of the matter here is that you are an idiot. Fact. Go back to your cubicle at Best Buy now. You act like you are so smart and so successful, but just about a week ago, you posted your bank account info here on ROR and had just over $1000 total in your account, whining about $50 or so that wasn't showing as available.

You keep calling me a "sub prime loser", but I have well in excess of 30 times what you have in just one of my three bank accounts, everything I have is paid for, and I owe no one anything.

You are obviously jealous of my financial strength,and the fact I don't have to care what anyone likes. That pisses you off as you go off to your loser job everyday and try to bolster that meager $1000 bank account. I spent more than that for dinner and out to a club last night. YOU are the loser here, guaranteed.

Furthermore, I have NEVER bounced a check or paid an NSF fee in my life, and NEVER WILL. This is because I understand that I have to properly manage my account, and that keeping an accurate checkbook register is essential in achieving that goal.

Also notice that the OP has not come back here to respond, as she now realizes that she is just too stupid to live, and her problem was self inflicted and not the banks fault.

Those overdraft notices are automatically generated each time an NSF situation occurs. 10 nsf's, 10 notices. That's how it works. And, the rep is not going to waste time with someone over the phone who can't properly manage thier account. The OP should have gone into the branch in person and sat down with someone to get the problem taken care of. She failed to do that.

No rip off here, just stupidity and laziness.

..that some people are so stubborn, they are beyond reason.

You see, someone like Steve does not really care about the banks, or the customers...all he cares about is making others feel bad on this website since this is a great way for a COWARD to do so..or for him telling others they are stupid. All I can figure, is this is a way to somehow make himself feel better because he can not deal with the fact that he himself..is human, and makes mistakes.

It is almost a disease.

I read this report AGAIN..and I still do not get it enough to pass judgment either way..there are questions which are unanswered. Granted, I know people do make mistakes and overdraft the account, but at the same time and even the great Steve has lodged a complaint, the banks do try to scam customers.

This report states letters are piling up regarding overdrafts and bounced checks...but the bank will not even talk about the reason. So either the bank is hiding something, or the poster is. I only ask to post more info..then decide. I do not need a lesson from the sub prime welfare loser Steve on what a register is for.

Keeping the accurate checkbook register is the first step in the proper management of a checking account.

Spending only what is posted and available for use is the next step, and stop spending when there are no funds available.

Are you really too stupid to figure out what is "posted and available"?

This is where a person uses online banking or telephone banking in conjunction with the accurate checkbook register.

The telephone banking and online banking will tell you what transactions have posted.

Now you know!

I want to believe as a fellow human being you mean well and are trying to help and not just knock others around who post complaints here. So I need to ask..

I agree, there are many that incur a bank fee because they spent more then they had in the account, that is a given..no breakthrough or epiphany there.But my questions are..

1) How do you know this OP tried to float any checks?

2) If as you state the "register is key", and then state "Money must be in your account, being posted AND available BEFORE you initiate any transaction or write a check"...well how on EARTH does a register let anyone know what is posted or available? All the register tells anyone, is what they deposited, and what they spent. It does NOT tell anyone when a check has cleared, or if there are any holds or unauthorized charges in process.

I am not saying your advice is bad..but perhaps you should not be so condescending before you know the facts or at least inquire. Ar you that perfect that you feel you are in position to judge others so harshly? What did this bank do for you that inspires you to automatically assume they did nothing wrong and the customer is a dunce? What has any bank done for you Steve that they deserve your devotion to defending them on this website? What have any consumers done against you that you feel the need to devote your time to coming here to mock, ridicule, insult and belittle them without even knowing the facts..but just assuming they are dumber then you?

Banks don't bounce checks, people do

Keeping an ACCURATE checkbook register is the key. This is where MOST people fail who are having NSF issues.

Money must be in your account, being posted AND available BEFORE you initiate any transaction or write a check. Many people do not understand this.

You cannot "float" transactions. Those days are LONG GONE.

Your "deposit book"? Do you mean your checkbook register?

I can guarantee to you that the bank did not cause this problem. You did.

Pay attention and manage your account the right way.

Pain and suffering is really only the result of physical injury so that is a no go since I can not imagine bounced check fees causing any physical injuries.

However, can you post any evidence as to why this bank sent any checks back? If they did anything illegal, advice will be left on what the next course of action is..but evidence of wrongdoing needs to be presented first or it is hearsay.
