I just wanted to write in and confirm the report about the man made in regards to being ripped off by Benchmark Jewelers in Dallas. When I read the story it was like I was reliving the situation that me and my wife went through with these people. The store manager was very nice, really acted like they wanted our business (which he did), and then proceeded to feed us the biggest bag of bull crap I've ever encountered before. He told us no interest for one year....b.s, and no payment, but did not mention that if you don't make any payments for the first you would accrue interest that entire year. When we specifically asked him that, he was very convincing in telling that there was NO INTEREST AT ALL, for the first year, and that was a complete lie!!!! He also negelected to tell us that there two seperate fincance companies that we would owe, and that their terms and repayment options were nothing like the ones we were told about and had agreed to sign up for. We contacted Benchmark they gave us the run-around and said to get in touch with the store manager. We finally went down to the store we had purchased the ring from and the manager denied ever telling us the things he had to sell us on the ring. He was quite rude, and said that he explained all the terms and options to us the way they should have! Also he told us that he could not do anything to help rectify the situation it was out of his hands once we signed the contract. In Texas verbal contracts are binding in a court of law, he should have to stand trail as well as the Benchmark Corporation for the business practices they are using to earn people's business. My wife and I are smart people, college grad's, we know what he was told us, then he completely denied it and we were stuck with a binding contract that we were brought into by deception. The sad thing is we would have been loyal customers until this all became clear.

I am writing to say that all the information discussed here is true. This corporation does not care about thier customers; they just want their money. While the jewelry might look pretty; the truth is that it is all crap. I have worked in the jewelry business for almost 3 years and this is the only store that I worked at that had so many complaints about the jewelry falling apart on the customers. With a no refund policy and customer service that puts the "s" in sucks; the customer is stuck with upgrading to another extremely marked up piece of junk that they are going to have the same problem with later.

Dont get me wrong stones will fall out OVER TIME( I'm talking months to years), but when the same thing happens to repeatedly to the same customer 8 times with 2 different rings within a matter of months, and the option is to upgrade to a new one. There is something not right there.

I use to love jewelry until I started working for Benchmark; then I realized just how shady the whole business was from corporate office to the rings in the stores.

Oh and if you are a girl and you are approached with a job offer from Benchmark; do not take the job! I was thrilled when I was offered a position at what I thought was a stable professional working establishment; I htought somebody noticed my potential and wanted to offer me something better. After all that is what I was told by the manager; a sales man through and through. A month into the job I noticed that all I was doing was cleaning the store, and everytime I did get a future customer the manager came in and stole the sale from me. Later I was informed by the assistant manager that I was only hired because I was young and cute; the store needed "eye candy", and that was my purpose. I was to clean the store, look pretty, and initiate conversation with the customers until the manager could jump in and seal the deal. After working there for 4 month, and helping sale over $50,000 worth of merchandise I only made $200 in commission. After talking to a few past employees they were all treated the same.

In any US jurisdiction a verbal contract is binding with 2 (possibly more) exceptions.

1. When specified by state law; ex: real estate - a written contract is required for any real property transactions per NY State law.

2. When a WRITTEN contract is in place. A written contract CANNOT be altered, changed, or ammended verbally.

Indeed, that's the lesson for the future. WHENEVER there is a written contract presented - READ IT THOROUGHLY and understand what you've read. If necessary, get some legal professional to translate the "legalese" and answer any questions you have.

It's unfortunate, but there are sales folks out there that are less than "factual" with their sales pitch.
