On July 23, 2003 I purchased 2 items. A verbatim CDRW which had a manufacturers rebate of $30 and a Kbyte 256mb ram which had a rebate of $20. Both were advertised in the Best Buy sales circular. All forms were properly filled out and mailed the following day.

I told my girlfriend about the Kbyte rebate and she purchased one the same day, followed the same proceedure.

On 12-04 I was wondering where my rebate was and emailed Verbatim. I received an email from Verbatim that the CDRW was made by Cyndine under their license and that they had filed for Chapter 11 bankruptcy. In otherwords, lots of luck.

On the same day I called Kbyte and asked about my rebate. She informed me I needed to call 1-877-529-8363 and ask for ext 4013. Upon being connected I listened to a recording advising me they too had gone bankrupt, nothing else I could do and that they really did think they could pay the rebates at the time of the promotion.

I called Best Buy and was informed by a manager there was nothing they could do because it was a manufacturers rebate. They had no control over manufacturers rebates. I advised them I felt they should be responsible because they were drawing customers in and making profit based on those rebates. Still told basically lots of luck.

DO NOT buy anything with a manufacturers rebate. I've had good luck with company rebates but this does it for me. I threatened to call the local news channel and did they want that kind of publicity since they were pushing more rebates during the Christmas shopping season. The reply I was told? "Okay". I will now see what I can do with the SC attorney generals office and the FTC regarding this

according to Attorney General Office they are responsible for making that rebate amount good

While I appreciate your response, according to a phone call to the SC Attorney Generals office, if a merchant uses a rebate in their advertisement and lists the final price "after" the rebate as the final purchase price, they are responsible for making that rebate amount good.

They further said, the merchant is the one who used that rebate as a tool to draw a customer into the store so that they can receive financial benefit from the sale of that item with the rebate so, the merchant has in effect stated a contract price as long as all terms the customer has to meet is done in accordance with the rebate requirements.

They ended the email by saying the only way a merchant can distance themselves from the responsibility of the rebate is for the advertisement involving the rebate to have a disclaimer stating "best buy cannot guarantee the rebate will be received".

I don't know if this is the law everywhere but it is the current law in South Carolina. They asked did I wish to file a complaint and I chose to email best buy home office first and give them a chance to clear it up. I also included the email from the attorney generals office. if they still wish to decline this I will then file the complaint with the Attorney General to do as he sees fit.

Hello there. I am not a type of person to be rude or argue with a person but I do want to state one fact: Best Buy carries thousands of products from thousands of manufacturers. Each manufacturer will offer promotions in the form of a rebate. This ensures that only a percentage of people will actually apply for said rebate so they will not lose out on too much revenue. Now, if you follow the steps correctly like it is written on the rebate form, usually all will go as planned.

There are rare occurances like you are in, where a company goes through problems of some sort and is unable to fulfill its obligation.

You can't say that it is Best BUy's fault for that manufacturer going bankrupt. They are mearly attempting to keep a product available at a very competetive price for the consumer to purchase. Every retailer is the same, with the same rebates, so please don't bash Best Buy's name and drag them through the mud because the manufacturer is the problem. Rebates can save you a great deal of money, but in the real world, there are chances that we all take. I purchase stuff periodically from Best Buy myself as an employee and I have had problems with manufacturers, but I don't pin the blame on the wrong company.
