I went to Bill Heard Chevrolet on June 30,2008 and looked at a new HHR. The salesman pushed me into a new car even after confirming the fact that my credit wasn't that great. I got the car after about 45 mins of going through a bunch of paperwork (which I still have). I was told my payment plan and my interest rate and everything. I paid them a $7500 down payment but never signed a contract.

3 days later after noticing the car didnt have an antenna or anti-lock brakes, me and a friend attempted to return the vehicle. The dealership told me no I couldnt return the car and that the car was mine since I had signed a contract. I informed them that I had never signed any contract. Then the sales rep told me that I had signed a contract that he was going to retrieve for me. The sales rep couldn't find the contract and then proceeded to tell me that he would mail a copy of the contract to me. After weeks of calling the dealership all I received were evasive responses and promises from the dealership to get back with me. Never did I get anything paperwork about contracts or payments.

Well it's been a year now. A week ago I got a call from a friend who informed me that police are looking for my vehicle. I called the dealership and explained to them how I've been calling and nobody's returned my calls. Thats when Linda Patterson, who claimed to be the lawyer representing Bill Heard, was very rude to me and threatened me over the phone. She told me I had until 5pm to get the car back to her and if I didn't, she would have the police arrest me for grand theft auto. I asked her if we could talk about this?Could I could pay off what I owe? She told me no that was an option since I hadn't been financed and that she wanted the car back immediately. I told her I was in Austin and would have to have somebody deliver it for me. She then told me I had til 3pm to do such.

I then informed her I had recorded the conversations with the dealership since the day they told me I couldn't return the car. She called me a liar, I informed her that i had all the phone conversations since the day the dealership said I couldn't return the car. She called me a liar again and I told her that I would bring back the car. She then hung up on me.

I called Chevrolets's sales department and discussed my experience with them. They filed a report but havent been able to reach Linda. Another sales rep contacted me and told me that Novell Credit wanted the car since i NEVER Made a payment but i had been financed. I told the girl on the phone that wasn't what they had told me earlier that day. I have both those conversations recorded. I tried all day to contact them and no response to my calls. I had a friend take the car back to them and left the keys. I think they should either let me buy the car or give me some of my deposit back. I have the reciepts and feel I was ripped off.

What does "discriminated towards due to sexual orientation" have to do with it?

It seems a mistake was made by the dealer and the proper paperwork was never filed with a lender. I have managed car dealerships and mistakes like these don't happen often, but obviously can happen. A mistake is just that, not a justifiable reason not to pay for a car.

Gee, didn't it occur to you that in 12 months time you never got a payment book or made any additional payments? No, you thought the whole thing would slip between the cracks and you'd keep the car with no additional payments. I understand your motivation, however when it catches up with you, you use the term "rude" (maybe because you didn't like what you were hearing) and claim you were "discriminated due to sexual orientation".

It's easy (and maybe sometimes justifiable) to dump on car dealers. But claiming "discrimination" when it had nothing to do with what took place isn't right.
You weren't discriminated against by anyone, they just wanted a car back that hadn't been paid.

BTW, recording phone calls, without the knowledge of the other party is illegal. Stating you have done so makes you sound like a quack who was just looking for a mistake to be made.
