Cyberstitch

AUTHOR: Ben Worstell - ()

POSTED: Monday, May 12, 2014

I am Ben Worstell, and I am the owner of Boca Data. I contacted Dan about getting two shirts embroidered, and he was happy to assist. Upon talking with Dan, he agreed to trade software for the embroidery work. While I was at his shop, I noticed that his workstation was taken apart, and sitting on a stool with the hard drive out of the computer case. Needless to say, it is difficult to run a business with the heart of the digitizing workstation taken apart, and laying on a stool next to the work area. Upon discussing the situation with Dan, he also stated that he had lost all of the digitized files that had already been approved by his Customers. This is the reason I gave Dan the Dell Pentium 4 workstation stated below, and this is also the reason I gave Dan a login for my FTP Server; so he could copy off his Customer-approved art (digitized art) to a stable location.

I put a workstation together for Dan (4GB of RAM, 500GB Hard Drive, Pentium 4 Hyperthreaded Dell SFF desktop model. Loaded on the computer was also Windows 7 Professional, Office 2013 Professional Plus, and Adobe CS 6 Master Collection). This workstation was free of charge, as I felt bad that Dan had just lost Customer data, and he really did need a stable workstation to digitize from.

Dan and I agreed to trade legitimate copies of Windows 8.1 as well as Office 2013 Professional Plus from my Microsoft MSDN account for the embroidery work. I gave Dan the install media as well as the license keys in exchange for the embroidery work as requested.

I needed 11 more shirts embroidered, and Dan had stated that he needed a shirt that he previously embroidered for reference, so I kindly dropped off a shirt that he had previously stitched for me. Additionally, I texted Dan EXACTLY what the shirts should read.

Upon receiving the shirts, I noticed that every shirt was stitched with the logo and/or the name and title improperly. I had texted Dan to stitch the name "Ben Worstell / Systems Engineer" on (3) of the shirts, and "Patty Worstell / Systems Administrator" on (2) of Patty's shirts. I received the shirts back from Dan with the stitching crooked, and the name stitched as "Ben Worstell / System Engineer" and "Patty Worstell / System Administrator" respectively. The word "System should have been Systems". I will not wear these shirts, as the stitching is crooked, and my title is not spelled properly (please reference his spelling in the report above). I even took the shirts back to Dan, and he stated that he knew of the crooked stitching.

On the two shirts that I initially received from Dan, he stated that the cost would be $40 for a setup fee, then $5 per embroidered location on the shirt (so, $10 per shirt). After I picked up the second round of shirts (11 of them), he texted me that the cost on the first two shirts was $120. I have received numerous prices from Dan, after thinking that we had an agreement with the software trade; not to mention the workstation that I gave him. Additionally, Dan gave me a workstation that had been infected with Malware. I took the workstation, and successfully eradicated the Malware from the workstation. There were over 230 instances of Malware on his worktation of my memory serves me correctly. I returned the workstation to Dan the same day, and I never gave Dan a bill for the work I had performed on his infected workstation. This was also part of the agreement we had regarding the embroidery work on the (13) shirts Dan embroidered.

Finally, Dan texts me a picture of an invoice from his computer screen stating the following:

(1) Digitizing Boca Data Logo - $100

(1) Setup Fee - Names - $40

(14) Embroidery - Boca Data Logo w/name - $140

After receiving the invoice, I asked Dan why there was a digitizing fee of $100 on the second round of shirts, when there was no digitizing fee on the first round of shirts. Again, I am getting prices from Dan that is all over the place, even after we had an agreement to trade services.

I again received a text from Dan stating that the digitizing fee for the Boca Data Logo was $40, and the digitizing of the script (name and title on the shirt) was also an additional $40. When I told Dan that there should not be any charge to digitize text because text is not digitized, he apparently got upset and started texting me in Hebrew. I sent Dan an email stating all software pricing ($800+), as well as all of the work I performed for Dan, and reiterated to Dan that we agreed to trade services. I also told Dan that we were even, as I thought we were with all that I have given Dan as well as the workstation I provided him so he could digitize without the fear of losing more Customer data.

Dan continued to text my cell phone threatening *and I quote* "If that's the game you want to play, then let's play and remember what country I come from a$$hole" *end quote* So, yes, I told Dan to F*ck Off. I don't play games. I forbid anyone to text me like that. If I receive any more texts from Dan, I will contact the police, as I saved his threatening texts on my cell phone.

After Dan started sending derrogatory and threatening messages to my cell phone, I terminated his FTP account on my Server, as he did not pay for hosting services. I thought we had an agreement of trading services as Dan wanted to do in the first place.

Additionally, I am a brand-new business that opened on 4-15-2014. All of my Clients are in Cutler Ridge, Homestead, and Orlando, not Coconut Creek. Dan has no idea who my Clients are, as all of my work is remote access. I do not speak of my Clients with other Clients. Dan is being dishonest and blatently lying in the above ripoff report.

By the way, I translated the texts that he sent me in Hebrew, and he had called me "you m*therfu**ing bi**h".

I will not be doing anymore business with CyberStitch. If I handled this situation incorrectly, then sobeit. I have no apologies for anyone.

Sincerely,

Ben Worstell

Owner - Boca Data
