carmax claims on their website they will buy your car and when they do they will issue you a bank draft do not believe it its ascam the so called bank draft is nothing more than a business check that they do not want to verify the one they gave i deposited into my bank and they tried to verify 6 times 6 times they refused the amount of the so called bank draft was for 29.000 finally my bank gave up.ms salvatore e-mailed and told me she would issue me another bank draft i told her the first one was not a bank draft

why would i take a second one that was not a bank draft to this date i still have not been paid for this car.everyone that reads this would be wise to stay away from this carmax and all others all they are doing when thay claim they are buying your cars is running a check liting scheme where they are trying to sell your car before they will release the funds they are suppose to have paid you for the car.we hope the department of justice,state attorney generals offices will start investigating this practice since it leaves no protection for the consumer and they are using other peoples money to operate their business

The first payment does indeed say "Returned refer to maker". This can indicate a few things. It's not an indication of not enough money, that would be marked "Insufficient funds". Possibilities are that someone was forging Carmax checks so that account was closed, Carmax but a stop payment on it for some reason or Wells Fargo felt possibility of forged check. However the second payment is marked "Cashier's Check". This indicates that Carmax paid cash and got this from some institution (whether Wells Fargo or some other bank or store I'm not sure). As far as Wells Fargo "verifying the check", each bank has different policies. Some won't verify at all, some will verify only with account holder on line and some verify all checks. However, all the verification means is that when you called and said you had a check for (in this case) $29000, if the account had that much money in it the check would be verified. It doesn't mean when the check gets there it'll get paid. That depends on the balance when the check is presented. Hope this helps explain a little and I hope this works out for you.

To the above poster.  If you look at the dates on the checks it appears that they FINALLY gave him a Cashiers Check.  The first two were not "bank drafts", and if I am reading it correctly(they were a bit blurry) it appears that the first check did in fact get returned by Wells Fargo, and he has every right to not accept a 2nd check that may also be bad.

So while I don't see any evidence for the reasoning the OP gives for why this happened.  If they were truly doing this there would be massive reports of this happening.  But the fact that the check "bounced" may have opened up Carmax to some liability issues.  Where if the OP had any damages because of this, he probably has a legal right to go after them in Civil Court.  Also, because of the amount there may be some criminal issues to deal with, but since it appears they have now paid him off if there were they may not be a mute point.

It IS a bank draft

It says right on the front "Cashier's Check", which is another name for a bank draft.  There are only a couple of reasons one of those can bounce:
- It's fake.  If you didn't get it directly from Carmax, that might be what happened.
- Carmax or Wells Fargo made an error.  There are obviously fraud prevention measures (since anyone with a laser printer can print one of these checks).  They might have issued the check, but didn't tell the bank about it.
I really don't think they are doing what you describe.  That would be against all kinds of banking regulations, and they would get in big, big trouble for it.  Not to mention, Wells Fargo would not let them write cashiers' checks if they didn't have the money to cover for them.  I think it is more likely they made an error, and you should contact them and get the check reissued.
