I bought a ford f150 fx2 truck from chapman ford on the 6th of May. I bought the vehicle without taking it for a test drive. I knew the truck I wanted and they had it on the lot. I was told there was 51,000 miles on the vehicle. I drove off on a Friday night in my new used vehicle and realized that there was over 57,000 miles on the vehicle. Almost a $1000.00 difference on the KBB. I told them they had lied about the mileage and was told by the salesmen that they would refund me $900 on my purchase. At first I was happy with that but it has been just shy of a month and they still will not cut me my check. I have been told by the saleperson 3 different times that i can get the check tomorrow and tomorrow does not seem to come. 4 days after driving the vehicle my truck over heated on the side of the road.

I was told that they would pay my other vehicle off in 10 days and guess what alost a month later I get a call from US bank saying why did you not make your payment. I said wait a second they said it would be paid off weeks ago. As of today I am now making paymnets on the car I traded in and the one they sold me. These guys will say anything to pacify you yet there actions are seemingly non existant. I would warn anyone thinking of buying a car here to not do it. Odd how a multi million dollar company cant process a 900 check or give me  a real odometer reading. They signed the secure odometer disclosure with the wrong mileage. A car is a major purchase and I am now of the opinion that these people can not be trusted.

The fact that they haven't paid off your trade-in timely is a well known dealership scam.  Definitely file a complaint with both the Attorney General for your state and the FTC.  

Then go to a private consumer attorney to see what recourse may be available to you.  The $900 refund from the sales rep might be difficult to prove unless you have something in writing, but bring it up anyway to your attorney. This type of dealership fraud (failure to payoff trade and misrepresentation of milage) needs to be stopped. 

Fortunately you are savvy enough to know that you have to keep making your payments on your trade-in vehicle until they receive the payoff to protect your credit. I wouldn't be surprised if the dealership wasn't deliberately delaying the payoff payment so that the final payoff would be less than when you traded due to you continuing payments to protect your credit.
